a great advantage to have the right of way black topped
as you suggest.

I move that the South Burlington Planning Commission approve
the site plan of 'Edmund Chastenay, for an addition to the existing
Norco Auto Parts Business, as depicted on a plan entitled.....
......., drawn by George Brady, dated August 1977, subject to
the following stipulations:
1) The following items shall be layed out and installed as
approved by the City Engineer: curbing around parking lot, storm
drainage, radii returns on both entrances.
2) The Williston Road sidewalk shall remain undisturbed.
3) The entire parking area shall be paved.
4) All 29 parking spaces shall be delineated by striping.
5) Applicant agrees to make the use of his Williston Road
curb cut availab3a to the abutting property to the east, Champlain
Oil Company, Inc.
6) Applicant agrees to allow landscaping to be installed
over a minor portion of his right of way across the Champlain
Oil Company property, when and if the Champlain Oil property is
redeveloped.

Dear Scott and Spencer:
I reviewed the South Burlington Land Records to determine the
ownership and use of the Williston Road frontage of the Chasteny pro-
perty. The property has a frontage of 50 feet with an additional 15
foot right of way on the easterly side of the parcel. This right of way
extends northerly 88 feet to the southerly boundary of the Chasteny
property. For reference purposes the right of way description is in a
Warranty Deed from Howard H. Peterson, Rowland E. Peterson, and Peterson
Motors to Champlain Oil Company, Inc, dated April 20, 1956 and recorded
in Volume 39 at Page 269 of the Land Records. This right of way is for
unrestricted access in perpetuity.
As far as your landscaping and parking plan is concerned, you can
landscape the westerly portion and utilize the right of way for your
driveway. For access purposes, it makes no difference whether you have
a fee simple ownership interest or merely a right of way.
