Re: Change of Tenant, hair Salon, Unit 4c, 100 Dorset Street, South Burlington, Vermont
Dear Mr. Judge:
It is our understanding that there is to be a tenant change at your 100 Dorset Street facility. It is also our understanding that while the use within the individual unit will change, no changes will be made to the exterior sewer and water service piping.
The State of Vermont Agency of Natural Resources Department of Environmental Conservation,
Drinking and Groundwater Protection Division, Environmental Protection Rules, Chapter 1,
Wastewater System and Potable Water Supply Rules, effective April 12, 2019, paragraphs 1-304 13 and 14, provides guidance when this situation occurs. This “Exemptions” portion of the rules directs that no permit or permit amendment is required if there is a change of building use, but no change to the exterior piping. If the new flow, based on the flow tables, found elsewhere in the
above referenced rules, is greater than the previous flow, the rules direct that allocation for the new
flow be obtained by the responsible sewer and water authorities and that an engineer certify that the existing water and sewer services serving the building are adequately sized to handle the new flow. This certification is to be then recorded in the land records. The total flows from all the existing (and historic use in the case of vacant units) units, with the proposed tenant change, are less than the total permitted flows found in the latest permits from the
State, WW-4-0511 and WW-4-2965. Also attached is an updated flow matrix showing the projected flows from the proposed and current tenants that shows that the projected flows are less than the permitted flows. In this case, no allocation is required, and no analysis of the water and sewer services is required because the projected flow is less than the previously approved amount. You should keep this information on file, and we recommend that you record it in the City land
records to officially commemorate the changes (and do so with future changes) so that a clear trail of documentation exists back to the two referenced permits.
