WITNESSETH: WHEREAS, Developer has received site plan approval from the MUNICIPALITY'S Development Review B and for the development of property located at V as depicted on a site Ian entitled " ^u ", dated o , and prepared by WHEREAS, Developer is required by said approval, at its own expense, to complete certain improvements; and WHEREAS, the parties to this Agreement wish to establish an escrow account to secure the obligations of the Developer as set forth in the City approval; and WHEREAS, the Bank executes this Agreement solely in the capacity of escrow agent. NOW THEREFORE, the parties hereby covenant and agree as follows: 1. For the guaranty of Developer's performance of all requirements h��(Cbov� set forth, and prior to the issuance of any zoning permit for �6 , Developer and Bank agree that the sum of shall be set aside and held in escrow by the Bank and shall be available for payment to the Municipality in accordance with the terms herein set forth. 5. If the Municipality shall file with the Bank a statement that the Developer is in the judgement of Municipality in default under the terms of this Agreement, the Bank shall from time to time pay monies from said escrow fund to the Municipality, in amounts not to exceed a total enabling the Municipality to complete improvements and requirements set forth in this Agreement. 6. The Municipality will promptly submit to the Developer a copy of such statement as it files with the Bank. The consent of the developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality , nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. 7. The Municipality shall not file with the Bank a statement of default until thirty (30) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 8. All monies released by the Bank to the Municipality pursuant to paragraph five (5) shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this Agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such a manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. 9. If monies are released by the Bank to the Municipality pursuant to paragraph five (5) and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this Agreement. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. This agreement shall terminate and shall be of no force or effect upon performance of all requirements contemplated hereby, and the completion of the warranty period set forth in paragraph three (3). 12. I feel these are excellent for the property as far as height and thher ability to yield privacy. these trees have the ability to grow to 60-80 feetinore if they aren't trimmed. Philip & Barbara Wagner 5) W1CKIS LUMBER, 1825 SHELBURNE ROAD Wickes Lumber (Mark Beaulac) received permission from the Zoning Board of Adjustment to construct a 30 x 125 foot shed and to complete internal renovations to the Wickes building. ZBA approval was required because lot coverage is excessive, for a conditional use approval. Although this does not require site plan review, the Zoning Board of Adjustment requested that we review the landscaping on this site. Seventy four percent of the site is covered with buildings park- ing and outside storage. Of the 26% remaining, there is little space for additional landscaping. However, the plan shows $8943 in new landscaping consisting of red maple willow, spirea and cranberry. The applicant proposes to plant low vegetation along the entrance so the view from Shelburne Road is not blocked. The proposed construction requires $9240. This seems to be the best location for the landscaping since there are no other grassed areas. (See enclosed letter) 6) AUTOWORKS, 29 BERARD DRIVE Thomas Chase and Michael Barry propose to construct a 4200 square foot addition to the existing 6000 square foot building. The 3.43 acre property is zoned Industrial -Commercial (I-C). Access: Access will continue from the existing driveway from the cul de sac at the end of Berard Drive. Circulation: Circulation is adequate along the front of the building. A 27 to 29 foot fire lane is provided around the western end and the back of the building. Parking Seven parking spaces are required for this use; the plans show eight spaces. Landscaping: The proposed addition requires $2400 in new landscaping. The plan shows white pine, juniper and red maple that meet this cost requirement. Other: The total lot coverage is 21%. The building coverage is 6.8%. See Bill Szymanski;s and Chief Goddette's comments. 7) NUZZOLO,} 10 COTTAGE GROVE AVENUE Drs. Nuzzolo propose to convert the existing office and residential structure to a medical office and residential structure. Zoning Board approval was required since these are multiple uses and apartments are not permitted in a commercial district unless it is a PCD. Access: Access will remain from the existing 27 foot wide drive- way on Cottage Grove Avenue. Circulation: Circulation is adequate with access on three sides of the building. Parking: Seven spaces are shown plus the space in the garage. The 864 square feet, of office require 4 spaces. The 1070 square foot apartment requires two spaces. Landscaping: No new landscaping is proposed although $15,000 in internal renovations, roof repairs and siding requires $450 in new landscaping. I suggest that the applicant plant at least two large trees that can be seen from the street. Other: This is not in a traffic overlay zone although it the first lot in from Williston Road. However, the applicant projects that a maximum of 8 trip ends will occur during each of the peak hours.
