BATCH - Supplemental - 0008 0010 White Street
BOND FOR LANDSCAPE WORK KNOW ALL MEN BY THESE PRESENTS, that New England Telephone and Telegraph Company, a corporation duly established under the laws of the State of New York, hereinafter "NET", is holden and stands firmly bound unto the City of SOUTH BURLINGTON, a municipal corporation within the State of VT, hereinafter "City," in the sum of NINE HUNDRED DOLLARS 900.00 to the payment of which to the said City, or its successors or assigns, said NET hereby binds itself and its successors and assigns in accordance with the Site Plan/ Landscape Agreement dated May 28, 1998, and Findings of Fact and Decision of the South Burlington Planning Commission dated May 12, 1998. WHEREAS, VINCOM LLC -is the owner of the property located at 8-10 White Street, South Burlington, Vermont and has authorized NET to install and maintain a building housing telecommunications equipment and buried cable, underground conduits, and manhole, with the wires and cables to be placed therein, pedestals, posts, markers and other fixtures on, over and under the property at 8-10 White Street ; and WHEREAS, by the Decision dated May 12, 1998, the " DECISION" has authorized NET to perform the above work and to provide landscaping as outlined in the Decision ; the said landscaping is to be maintained by NET for a period of not less than three (3) years from the date of the initial planting; and NOW THEREFORE, in consideration of the City's approval, NET will perform the landscaping work under the said Decision and should NET fail to perform the landscaping requirements under the Decision, then NET shall be given 30 days written notice and should the work still remain incomplete then the City of South Burlington may draw down on this bond in the above amount in order to fulfill the terms of the Decision. NOW THEREFORE, if said NET shall indemnify and save the said City, harmless from all loss, cost, damage or expense arising from or growing out of the work to be undertaken by it under this said landscape agreement, and shall fulfill all such agreements with said City, and its duties under the same, then this obligation shall be void, otherwise it shall remain in full force and virtue. This obligation of NET to perform landscaping work under the Decision shall remain in effect for three (3) years from the date of the installation of the facilities by NET unless cancelled by the City upon thirty (30) days written notice, but terminating no later than the latest expiration date of any then existing landscape agreement. Anson, SR/WA Manager - Right of Way -VT Bond received for filing on: 1998 City Clerk LANDSCAPE AGREEMENT THIS AGREEMENT, in duplicate, by and between NEW ENGLAND TELEPHONE AND TELEGRAPGH COMPANY, hereinafter referred to as "NET" and the CITY OF SOUTH BURLINGTON, hereinafter referred to as "Municipality". WITNESSETH: WHEREAS, NET has received approval from the Municipality for the development of a Telecommunications Equipment Hut as depicted on a plan entitled " Site Plan, NET Proposed Telecommunications Site Property of VINCOM, LLC, 8-10 White Street, South Burlington, VT." Prepared by Dunroven Associates dated January 1998 recorded in Volume Page of the City of South Burlington Land Records ( the "Site Plan") ; and WHEREAS, NET is required by said approvals, at its own expense, to complete all landscaping of the development site in accordance with the requirements of the Planning Commission; and WHEREAS, the parties to this Agreement wish to secure the obligations of NET as set forth in the Municipality's approval with a bond provided by NET. NOW THEREFORE, the parties hereby covenant and agree as follows: (1) NET will, at its own expense, complete all of the landscaping set forth on the Site Plan and approved by the Municipality's Planning Commission. (2) NET shall complete the landscaping set forth in Paragraph 1 no later than June 1, 1999. (3) NET shall repair or replace any defective work or improper material and specifically replace any diseased or dying plants or other defective aspects of the landscaping which may appear within three (3) years after completion. (4) For the guaranty of NET's performance of all the requirements hereinabove set forth, and prior to the issuance of any zoning permit for construction of the Telecommunications Equipment Hut, NET and the Municipality agree that the bond attached as Exhibit A shall be available for payment to the Municipality in accordance with the terms herein set forth. (5) If the Municipality shall file with NET a statement that NET is in the judgement of the municipality in thirty (30) day default under the terms of this Agreement, NET shall from time to time pay monies pursuant to said bond tot he Municipality, in amounts not to exceed a total enabling the Municipality to complete improvements and requirements set forth in this Agreement. The Municipality , in its statement, shall provide NET with reasonable cost estimates of the work to be done. (6) The Municipality shall not file with NET a statement of default until thirty (30) days after notice has been sent by it to NET by certified mail, return receipt requested, setting forth its intention to do so. (7) All monies released by NET tot he Municipality pursuant to Paragraph 5 shall be used by the Municipality solely for the purpose of performing obligations imposed upon NET by that portion of this Agreement upon which NET is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such a manner as in the judgement of the Municipality shall accomplish the work most expeditiously and economically. The Municipality shall provide NET with receipts after the work has been completed. (8) If monies are released by NET to the Municipality pursuant to Paragraph 5 and it shall later develop that a portion of the released monies are surplus tot he Municipality's needs, any such surplus shall be refunded by the Municipality to NET. (9) NET will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement. Said statement shall contain a certificate of compliance with the notice requirements of Paragraph 6 of this Agreement. (10) NET unconditionally, absolutely and irrevocably guarantees the payment of any fees and expenses including reasonable attorney's fees incurred by the Municipality in successfully enforcing or seeking enforcement of the liability of NET under this Agreement. (11) This Agreement shall terminate and be of no force and effect upon performance of all the requirements contemplated hereby, and upon the completion of the warranty period set forth in Paragraph 3. If the Municipality has not delivered any written notice to NET of any faulty or defective work by the end of the thirty-sixth (36th) month after completion of said improvements, or if notice has been given and the defective work or materials or plantings have been corrected or replaced by NET. (12) This Agreement shall not only be binding upon the parties hereto, but also their respective heirs, executors, administrators, successors, and assigns. Site plan application of Wolfstein Architecture to convert a 1092 sq. ft. single family dwelling to general office use on a lot which contains a second principal building (telecommunications hut), 8-10 White Street: Mr. O'Rourke stepped down during this hearing due to a conflict of interest. Mr. Wolfstein noted the telecommunications building is not yet built. The property used to be 2 lots but is now 1. The telecommunications building will be built and the use of the existing house will be changed to office. No changes are proposed in lighting or boundary lines. They will add some landscaping. The parking requirement is 6 spaces, but the applicant requested 26. They are proposing to use the facility for training sessions for restaurant managers, and will need the spaces for those sessions (about once a month). There is an access agreement with the property to the west. All setbacks will be met, and there is ample place for snow storage. Trees will be added on White Street to screen cars. One utility pole will have to be relocated. Mr. Smith, representing Zachary's and Vincom said there has been an exchange of easements between the two properties. Mr. Dinklage asked how much parking would be paved. Mr. Wolfstein said they don't plan to pave any parking. Mr. Dinklage asked if any spaces would be rented out. Mr. Wolfstein said no. Mr. Smith said they may move the office functions of Zachary's to this building. He said the training sessions could result in 20-25 people a session twice a month. They are well within lot requirements even with the extra parking, he said. Mr. Dinklage explained that the Commission needs to understand the potential uses of the building when a use is approved. He asked what the average daily number of vehicles parked there might be. Mr. Smith estimated 8-10. Mr. Dinklage suggested restricting the use of the building to a training facility as described with average daily use of 8-10 vehicles and 25 vehicles twice a month. Mr. Carroll said there is not a parking problem per se on the Zachary property. The problem is use by adjacent businesses that do not have adequate parking. All the adjacent properties suffer from inadequate tractor -trailer access and drivers park in Zachary's lot. There is even another business owner renting spaces to someone else on the Zachary's lot that they don't own. Mr. Dinklage asked if Vincom will train managers for any other companies. Mr. Carroll said no. Mr. Weith said the Commission has to be careful because this could become a educational use. He wanted it made clear that this is a general office use and not a training facility use. Mr. Dinklage asked if they would have to come back to pave any or all of the parking. Mr. Weith said that because of drainage issues they would. Mr. Carroll said they don't want to pave it. Mr. Smith said they would agree to get Planning Commission approval if they plan to pave more than 6 spaces. South Burlington, Vermont," prepared by Dunroven Associates , dated January, 1998, with the following stipulations: 1. All previous approvals and stipulations which arc not superseded by this approval shall remain in effect. 2. The site plan shall be revised to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show three (3) parking spaces. b) The site plan shall be revised to add more landscaping to meet the minimum landscaping requirement. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the telecommunications but will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 4. All new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. Prior to permit issuance, the applicant shall obtain approval from the City Planner for the proposed building mounted light. 5. Prior to issuance of a zoning permit, the applicant shall post a $900 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 7. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the building. 8) Any change to the site plan shall require approval by the South Burlington Planning Commission. The ZBA on 3/23/98 granted the applicant a conditional use permit and a variance for this facility. This property located at 8-10 White Street lies within the C1 District. It is bounded on the west by a restaurant/indoor recreation facility and a personal service building, on the south by White Street, on the east by a bank with drive -through service, and on the north by multi -family dwellings. Access/circulation: Access is provided by a 15 foot curb cut on White Street. No changes proposed. Circulation on the site is adequate. Coverage/setbacks: Building coverage is 4.8% (maximum allowed is 30%). Overall coverage is 17.3% (maximum allowed is 70%). Front yard coverage is 18.5% (maximum allowed is 30%). Setback requirements are met. Parking: A total of three (3) parking spaces are required (two (2) for the dwelling and one (1) for the hut). Staff requested that the plan be revised to show these three (3) spaces. The minimum landscaping requirement, based on building costs, is $900 which is not being met. Proposed plantings, which include Northern White Cedar, are $95 short of the requirement. Plan should be revised to add more plantings to meet the requirement. Lighting Proposed lighting consists of one (1) 50 watt high pressure sodium light mounted on the building. Applicant has not yet submitted a cut sheet for this light. Prior to permit issuance, the applicant should obtain approval for this light from the City Planner. Sewer: No additional sewer allocation needed. Provide size of proposed plant material. The cedars proposed will be 6-8 feet high at time of planting. 2. William Szymanski noted that our proposed conduit and manhole system might be in conflict with an existing 8" sewer line and a water -service. We will confirm the location of these services, show them on our plan and adjust our conduit and manhole system to avoid any conflict. 3. If an exterior light will be used, provide a cut sheet and show location on plan. The only exterior light proposed is a small 50-watt security light attached to the building over the door (Lithonia TWL series -high pressure sodium). 4. The Fire Department noted that the access road needed to be wider. This is an existing 9' right of way at 10 White Street to the lot at 8 White Street. VINCOM owns both lots and assured us they can coordinate with NET and the Fire Department to provide a satisfactory access to the site. As we noted in testimony at the Zoning Board meeting, this unit poses no significant fire hazard. 5. Show parking spaces for maintenance person ( 2 ) spaces required for the dwelling.
