Nowak saidinitially the commis- sion could send it to council in completed sections, but Louisos said the council would lose sight of the bigger picture. They agreed that council would receive and review the full document, and Louisos suggested holding a joint council/commission meeting as a public unveiling. Conner said having a handful of input meetings at different times and locations prior to the official public hearing(s) is an option as well. Nowak said the timing is ideal since it's occurring around the same time as the city's branding project. Draft Land_ Development Regulations SEQ-Neighborhood Residential North / JAM Golf amendments: Conner provided a brief history of the settlement; it would be designated as Neigh- borhood Residential North, allow 4.67 acres/parcel with different public works standards, and have a landscape buffer between Wheeler Park and the neighborhood. Louisos observed the landscape buffer was outside the property. In the draft, there's a provision that would make this permissible when the request is granted through the city council, Con- ner said. Staff showed a map of the area with three regions designated for single -story structures. A rec path was also outlined. Commissioners agreed on the amendments. Review table of uses in the Form Based Codes area: The table had a list of allnwahle and nrnhihitPd nsPc shelters; commercial kennels; cannabis cultivation; equipment repair; lumber/contractors' yards; taxi companies, storage and auto or truck repair garages. List of prohibited uses that could nowbe permitted if they conform to FBC: auto/motorcycle/service and repair; car wash; equipment service/sales/rental; warehousing/storage; light manufacturing; manu- facturing and assembly from previously prepared materials and components. Conner said that a use that is not explicitly prohibited is allowable under Form Based Code. Other member / staff items from draft LDRs: Con- ner noted two items being worked on: rooftop and doorway issues. The commission may be able to have a vote at the next meeting (the special meeting, June 30), but the LDRs are still under legal review and might therefore only be partially reviewed by the time of the vote. Other Business The commissioners agreed on a June 30 special meeting. Staff wouldn't have graphics available and the legal review may be partial. COMMENTS Administrative Officer Ray Belair and Planner Temporary Assignment, Dan Albrecht referred to herein as Staff, have reviewed the plans submitted on June 18, 2014 and have the following comments. BACKGROUND The applicants are seeking after -the -fact conditional use approval to allow a new 7.5' X 10' entry to project three (3) feet into the front yard setback, 34 Cortland Avenue. Section 3.06(1) of the Land Development Regulations establishes standards for consideration of exceptions to setback requirements for lots existing prior to February 28, 1974 as a conditional use. The application is therefore reviewed as a conditional use. CONDITIONAL USE CRITERIA Pursuant to Section 14.100 of the Land Development Regulations, the proposed conditional use shall not result in an undue adverse effect on any of the following: (a) The capacity of existing or planned community facilities. Staff feels that the proposed addition will not have an undue adverse effect on community services. (b) The planned character of the area affected, as defined by the purpose or purposes of the zoning district within which the project is located, and specifically stated policies and standards of the municipal plan. The property is located within the Residential 4 Zoning District. The purpose of the District is stated as follows: 4.03 (A) Purpose. A Residential 4 District is hereby formed in order to encourage residential use at moderate densities that are compatible with existing neighborhoods and undeveloped land adjacent to those neighborhoods. Any use not expressly permitted is prohibited, except those that are allowed as conditional uses. The Comprehensive Plan, last adopted March 9, 2011, includes several objectives and recommendations related to housing in the community. Housing Objective 2 (page 40) states: "Identify and protect existing and developing residential neighborhoods" Staff recommends that the Board discuss this item in concurrence with the standards within Section 3.06(J). Currently, the existing dwellings on this street share a common setback that creates a CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING CU 14 06 34CortlandAve Cardwell Ohlsson deck afterfact.doc neighborhood feel. An encroachment into this setback will allow other dwelling units in this neighborhood to encroach further into the established setback, under Section 3.06(J) of the Land Development Regulations. In this case, the new entry constructed by the applicants projects into the setback more than the average of the abutting properties. In making its determination, the Board should assess whether such an encroachment creates an adverse effect, AND if so, whether the adverse effect is undue on the planned character of the area. Based on this information above, staff feels that this application does not rise to the level of creating an undue adverse affect on the planned character of the area. (c) Traffic on roads and highways in the vicinity. The proposed addition will not affect traffic in the vicinity. (d) Bylaws and ordinances then in effect. The proposed addition would encroach into the front yard setback requirements outlined in table C-2 of the Land Development Regulations. An exception is allowed for lots existing prior to February 28, 1974 in Article 3, Section 3.06(J) of the Land Development Regulations. See below for these standards. (e) Utilization of renewable energy resources. The proposed addition will not affect the utilization of renewable energy resources. 3.06(J) EXCEPTIONS TO SETBACK AND LOT COVERAGE REQUIREMENT FOR LOTS EXISTING PRIOR TO FEBRUARY 28, 1974. The following exceptions to setbacks and lot coverages shall be permitted for lots or dwelling units that meet the following criteria: the lot or dwelling unit was in existence prior to February 28, 1974, and the existing or proposed principal use on the lot is a single-family dwelling or a two- family dwelling. (1) Side and Rear Setbacks. A structure may encroach into the required side or rear setback up to a distance equal to 50% of the side or rear setback requirement of the district, but in no event shall a structure have a side setback of less than five (5) feet. (2) Front Setbacks. A structure may encroach into a required front setback up to the average distance to the building line of the principal structures on adjacent lots on the same street frontage, but in no event shall a structure have a front setback of less than five (5) feet. (3) Additional Encroachment Subject to DRB Approval. I am seeking a remedy to finalize the approval process of CU # 14-06 prior to the sale and closing of your house scheduled for July 20th 2015 as we will be relocating to Alexandria VA due to my wife's job situation. This issue, if not resolved, will have a far reaching effect on 4 families as the lender has notified us that they will not fund the loan until the issue has been resolved. Therefore the new owners cannot close on the house, we cannot close on the home in VA (scheduled for the following week) and the owners of the home we are purchasing in VA will not be able to move to their new home in GA... During a number of a -mails between Ray Belair and myself yesterday I was made aware for the first time that a second zoning permit was required to be applied for within 6 months of the approval date of the CU (although I already had an active zoning permit in place for the front breezeway and deck). Ray was very helpful and responsive in answering many questions I had in gaining understanding of the policy and procedure. The misunderstanding was due to the reading of the Decision section within the Finding of Fact and Decision document I received after the board's approval the section reads: The South Burlington Development Review Board approves Conditional Use application #CU-14- 06 of Carlee Cardwell and Lance Ohlsson subject to the following stipulations: 1. All previous approvals and stipulations shall remain in effect except as amended herein. 2. This project shall be completed as shown on the plan submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6 months pursuant to Section 17.04 of the Land Development Regulations or the approval is null and void. The issue arises in the reading and understanding of the above in the following manners: - When I applied for my original zoning permit — 2P13-302 (attached) it included the front breezeway and porch (the issue for the CU requirement was not the fact that I built a unauthorized structure but that there was a miss -measurement of the setback at the front of the house by 3') - The zoning permit was in effect during the construction and at the time of the CU approval meeting (this was confirmed by Ray in a -mails yesterday) As there was already a permit in place that included the proposed breezeway and deck, #1 above states that all previous approvals shall remain in effect, I took this at face value that the zoning permit requirements had been met. I did not anticipate that a second permit would be required In the e-mail exchanges yesterday with Ray he acknowledged that I did in fact have an active permit in place during the construction and CU approval but a second permit was required (which is not stated in the Building Development Standards) I understand that the department and the Review Board has rules and guidelines that need to be followed, it is my hope that the rules can be somewhat flexible if the intent is met. I would offer the following to demonstrate why I feel the intent of the rules have been met: - Any new building or structure requires a zoning permit (I had one) - Fees based on the estimated construction costs need to be collected ( I paid all required fees) - Proper approval and documentation needs to be in place (The original application for zoning permit # 213-13-302 had the intended breezeway and deck included) - The CU decision states a zoning permit is required, nowhere does it state a second is required My situation may be unique in the fact that it was an "After -the -Fact" Conditional use situation, which, I would imagine most After the Fact approvals are projects that never had a zoning permit to begin with, mine did. The issue was not that I did not inform, apply and gain a permit for the originally intended project but a simple miss measurement requiring additional approval. Please let me know if there is anything I can do to finalize this issue without going through the full approval process again which will cost 4 families thousands of dollars and tremendous time and energy. .)
