April 7, 2023 Betsy Brown Planning & Zoning Assistant City of South Burlington 180 Market Street South Burlington, VT 05403 bbrown@southburlingtonvt.gov Re: 350 Tilley Drive Project Zoning Permit(s) ZP-22-067 (Addition) & ZP-22-074 (Interior Fit-up) The University of Vermont Medical Center (UVMMC) is pleased to provide the following information in regards to the above noted 350 Tilley Drive Zoning Permit(s), to demonstrate our continued good faith effort in moving forward with this Project. As you know, both Zoning Permit applications for this project were submitted to the City of South Burlington in March 2022, by Pizzagalli Properties, per UVMMC request, based on the understanding that our Certificate of Need application submitted in January 2022 was approved under expedited review in February of that year by the Green Mountain Care Board (GMCB). After an unexpected duration of more than a year of review with GMCB, expedited review of this C.O.N. application was closed in November 2022, after seven rounds of questions, with formal C.O.N. granted 2/24/2023. This extended period of time as you can imagine, was in large part a major contributing factor as to where we find ourselves with the project today and why we are now addressing Zoning Permit status in this letter. Having said this, subsequent to receiving the C.O.N. for this project, UVMMC has been fully reengaged with our Construction Management team at ReArch Company, in an effort re-bid the work to confirm the projects final guaranteed maximum price, currently scheduled to be received 4/14/2023. Based on the most current ReArch Company schedule, UVMMC expects construction mobilization to commence 8/14/2023, with a total projected duration of nine months, with a milestone of first patient being seen in August of 2024. It is certainly the hospitals intent to go forward with both the small addition (ZP-22-067) and the Interior fit-up (ZP-22-074). They have been diligently pursuing a Certificate of Need from the Vermont Green Mountain Care Board. Which you may have recently seen in the press, they just received approval for. The CON process took 3 longer than they expected. Obviously, a lot of work has been ongoing behind the scenes. If you would prefer, I am happy to have the hospital send you a letter of their activities concerning this project. But it is most assuredly moving forward. Please let me know how you would like us to proceed. The Notice of ZP (ie. Z Poster) is considered the public notice of issuance of said permit. Please see 17.04A of the regulations. If you can demonstrate a good faith intent to presently commence upon the permitted project, your zoning permit remains valid. If you do not intend to presently commence construction, the zoning permit and site plan will expire.
