This project, consisting of adding a day-care center for 1.1
children and 2 staff within building #2 of the two building
complex previously approved in permit PB-4-1085 and known as One
Twin Oaks located off Twin Oaks Drive in the City of South
Burlington, Vermont is hereby approved under the requirements of
the regulations named above, subject to the following conditions.
This Permit does not constitute Act 250 approval under Case
Number 4CO294 (.and amendments.
GENERAL
(1) The project shall be completed as shown on the plans Pr.o.ject
Number 85006 Sheet 1 of 4 "Site Plan" dated Oct. 1985 last
revised 7/30/86 prepared by Fit.zPat.rick-I.,.lewellyn, Inc. and
which have been stamped "approved" by the Wastewater
Management Division. The project, shall not deviate from the
approved plans without prior written approval_ from the
Wastewater Manavement Divi-sion.

(4) The Wastewater Management Division now reviews the sewage
and water systems for public buildings under 10 V.S.A.,
Chapter 61 - Water Supply and Wastewater Disposal Permit.
(5) All conditions set forth in Land Use Permit #PB-4-1085 dated
November 5, 1985 shall remain in effect except as modified
or amended herein.
WATER SUPPLY-
(6) The project is approved for water supply by connection to
the municipal water system. No other means of obtaining
potable water shall be allowed without prior review and
approval. by the Wastewater Management. Division.
SEWAGE DISPOSAL
(7) The project is approved for connection to the South.
Burlington Airport Parkway wastewater treatment facility for
a maximum of 2300 gal -Ions of sewage per day.

Mr. Austin moved the Planning Commission approve the final plat
application of Mary Provencher for subdivision of approximately
6,135 sq. ft. of land containing two single family dwellings into
two lots of approximately 1,845 sq. ft. and 4,290 sq. ft. 41 and
43 Central Avenue as depicted on a plat entitled "Plat of Survey,
2 Lot Subdivision, Mary M. Provencher, Prop. No. 41-43 Central
Avenue, Queen City Park North, South Burlington Vermont," pre-
pared by Warren A. Robenstein, dated June, 1972 with a last
revision date of 9/25/93, with the following stipulations:
1. All previous approvals and stipulations which are not super-
seded by this approval shall remain in effect.
2. The applicant shall submit the legal document for the access
easement for review and approval by the City Attorney. This doc-
ument shall be recorded in the land records, prior to or at the
same time the final plat is recorded.
3. The plat shall be revised to show the "well lot" as part of the
lot at 41 Central Avenue. Three copies of the revised final plat
shall be submitted to the City Planner prior to recording the final
plat.
4. The applicant shall record the final plat in the South Burling-
ton land records within 90 days or this approval is null and void.
The Planning Commission Chair or Clerk shall sign the plat prior to
recording.
Mrs. Maher seconded. Motion passed unanimously.
6. Site plan application of One Twin Oaks Associates for conversion
of 600 sq. ft. of office space to day care use, 200 Twin Oaks
Terrace:
Mr. Thibault said the condo association has agreed to everything in
principle and a letter is expected from them to this effect. The
space in question is presently general office use. Grandville
Condos are allowing use of the land for a play area. There will be
a 4 ft. picket fence across the back line and wire fencing back
into the trees. No trees will be cut down. The facility will ac-
commodate 12 children.
Mr. Burgess noted the fencing is not shown on the plan. Mr.
Thibault said it is required by the State.
Mr. Austin moved the Planning Commission approve the site plan ap-
plication of One Twin Oaks Associates for conversion of 600 sq. ft.
of office space to day care use, 200 Twin Oaks Terrace as depicted
on a two page set of plans, page one entitled "One Twin Oaks South
Burlington Vermont Site Plan" prepared by Fitzpatrick -Llewellyn

Inc, dated October, 1985 with a last revision date of 7/30/86, with
the following stipulations:
1. All previous approvals and stipulations which are not superseded
by this approval shall remain in effect.
2. All exterior lighting shall be downcasting and shielded so as
not to cast light beyond the property line. Any change in existing
lighting or new lighting shall be approved by the City Planner
prior to installation.
3. Applicant must submit a letter to the City, prior to issuance of
a zoning/building permit, from the adjacent condominium association
agreeing to the play area which is proposed to be on the condomin-
ium property.
4. An additional sewer allocation of 500 gpd is granted. The ap-
plicant shall pay the required sewer allocation fee prior to is-
suance of a zoning/building permit.j
5. The applicant shall obtain a zoning building permit within six
months or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to occupancy of the day care facility.
7. Any changes to the site plan shall require approval by the South
Burlington Planning Commission.
8. As expressly represented by the applicant, the applicant will
install a 4 foot high fence around the play area which will consist
of a mixture of wood picket and wire mesh.

7. Site plan application of Chittenden County for conversion of an
existing 6000 sq. ft. building from property management use to a
state/county facility (i.e., County Sheriff's facility), 70 Ethan
Allen Drive;
Mr. Shields said there will be no changes to the building or lot,
only a change in use. They got permission from the Zoning Board
for the new conditional use.
Mr. Weith said there are no outstanding issues.

application of Chittenden County for conversion of an existing
6,000 sq. ft. building from property management use to a state/
county facility (i.e, County Sheriff's facility), 70 Ethan Allen

This is to confirm the fact that the South Burlington Planning
Commission at their meeting held on December 14, 1993 approved an
additional sewer allocation of 500 gpd. This allocation was
granted to Twin Oaks Associates in addition to the 1800 gpd
already allocated for the property at 200 Twin Oaks Terrace.
This property is served by the Airport Parkway Treatment Facility
which has sufficient capacity to handle this additional demand.

Zoning Board attached the following stipulation: "That if
satisfactory parking can't be reconciled to the satisfaction of the
Planning Commission, that this variance if granted be null and
void". This sketch plan was reviewed by the Planning Commission on
6/22/93 (minutes enclosed).
This property is located at 41-43 Central Avenue and is in the
Queen City Park District. This property is bounded on north, south
and west by single-family homes and on the east by Central Avenue.
Access: The property has two (2) existing curb cuts off from
Central Avenue, one for each of the homes. There are no changes
proposed to these access points.
Coverage/setbacks: The southerly lot at 43 Central Avenue will
exceed building coverage by approximately 19% (maximum allowed is
20%). Overall coverage will also be exceeded by an undetermined
amount (maximum allowed is 40%). The Zoning Board granted
variances to exceed these coverage limitations.
The new property lines to be created will run in an east -west
direction and result in a zero lot line situation for the southerly
side of the home at 41 Central Avenue. An easement is proposed
which would allow access to the house on the southerly side for
maintenance, etc. The Zoning Board granted a variance for the zero
lot line configuration. The applicant should submit the legal
document for the access easement for review and approval by the
City Attorney prior to recording.
Other: The plan needs to be revised to show the "well" lot as part

This property located at 200 Twin Oaks Terrace lies within the R-7
District. It is bounded on the north by Kennedy Drive, on the east
by Twin Oaks Terrace, on the south and west by the Grand View
residential development.
Access/circulation: Access is provided via a 30 foot curb cut on
Twin Oaks Drive. No access changes proposed.
Circulation is adequate.
Coverage/setbacks: Building coverage is 11.4% (maximum allowed is
25%). Overall coverage is 47.9% (maximum allowed is 60%). Front
yard coverage is 30.8% (maximum allowed is 30%). This is an
existing situation which will not be made worse by this
application.
Setback requirements are met.
Parking: This project requires a total of 74 parking spaces and 78
spaces are being provided including four (4) handicapped spaces.
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project. The existing landscaping is
shown on a separate plan. Landscaping is adequate.
Sewer: The applicant is requesting an additional 500 gpd of sewer
allocation. The applicant will be required to pay the per gallon
fee prior to permit.
Lighting: No additional lighting proposed. Existing exterior
lighting consists of the following:
--- thirteen (13) downcasting and shielded 70 watt high pressure
sodium lamps on 15 foot poles.
--- eight (8) 70 downcasting and shielded watt high pressure
sodium lamps mounted on the building.

On behalf of Twin Oaks Associates, we have been asked to update the
existing state permits on the above facility. Currently, the
building has an permitted allocation of 1,800 gallons per day of
sewage. A recent tabulation of the building's existing and
proposed tenants revealed a shortfall of approximately 500 gallons
per day. To meet the permit application requirements, a letter on
sewer and water allocation for the increase in permitted allocation
is required.
The flow quantities outlined in Appendix 7-A of the Environmental
Protection Rules require an additional allocation of 500 gallons
per day to accommodate existing and future users. Would you please
provide a letter, to be used in conjunction with our application,
allocating an additional 500 GPD of water and sewer to the

Pre-sketchplan discussion with Jerry Milot regarding ro osed
commerclai developmenton Shelburne Rd.
Mr. Milot indicated their intention to use the site for a retail
shopping mall of about 350,000 sq. ft. Me said their site now
has no curb cuts on Shelburne Rd. but Vermont National ]bank is
agreeable to eliminating their building and going into the mall.
The site would then use one of the banks 2 curb cuts and eliminate
the other. zntrance to the development would be from Larkin Terrace
where a light exists. They would also service the adjacent lot
from this service road. They would want to put a litit at Laurel
Kill Drive and one at McIntosh. Me said the major concern is the
traffic overlay district. Mrs. Maher noted there will soon be a
review of the traffic overlay zone in that area and may be a
revision of figures. Mr. Milot said he couldn't claim they would
not add new traffic, but they would try to deal with it in better
ways.
Mr. Dooley asked if it was possible to require both the Milot and
pomerleau lots to be considered in tandem. Ms. Bechtel said this
is possible. Mr. Spitz, representing Ponerleau, said they felt
it important to work the two properties together. Me added they
felt a larger project should not be prohibited by the traffic
overlay zone but should meet Standard C.
Mr. Milot said there is a shale which they would consider pending.
Me realized the sewer was an issue. Ms. Bechtel said there is
25,000 gpd uncommitted including the extra 100,000 received recently.
Mrs. Maher slid she would fight for an independent traffic study.
Mr. Milot said he would pay for a firm hired by the city. Ms.
Bechtel said it may be that any development of the area would
have to be phased with the Southern Connector and also might not
get built if the Southern Connector isn't built.
Mr. Milot said he would get together with the Pomerleau people and
try to get a joint presentation within 30 days.

Ms. Bechtel said that the area is zoned R-7 and the Zoning Board
has approved the conditional use. The project meets all require-
ments for lot coverage and open space. Mr. Llewellyn noted they
had reduced the building size from 20,000 sq. ft. to 18,000 sq. ft.
to meet the open space requirement. The building will be located
at the corner of Kennedy & Twin Oaks Drives and will be similar in
style to 1 Kennedy Drive. There will be 1 access.

The buildings will have 2 sbries with access to the first floor
from the back and to the second floor from the front. Water is
from an existing main, and there will be 2 fire hydrants. Re-
tainings walls will be used to keep the project out of the con-
servation zone. The building will probably have a brick veneer.
Ms. Bechtel noted that if the building houses medical or dental
offices, it would require a higher sewer allocation than the
1200 gpd now allocated. The project may now fit in with the old
plant. Figures on that are expected soon. Mr. Brown said they
hoped to occupy one building in the fall and the other next summer.
Mr Dooley said he didn't like tying up 2400 gpd which they may not
use. Mr. Llev&llyn said 1 Kennedy Drive uses 1800 gpd and that is
1/3 medical -dental offioes.
Ms. Bechtel stressed it should be made clear that sign restrictions

MOTION OF APPROVAL
That the South Burlington Planning Commission approve the site plan
application of MSR, Inc., for construction of 2 office buildings
with 2 floors each, at one Twin Oaks Drive as depicted on a six page
set of plans entitled "One Twin Oaks, Site Plan" prepared by Fitzpatrick -
Llewellyn, Inc., and stamp dated August 2 and August 9, 1985 with the
following stipulations:
1. A $15,000 landscaping bond shall be posted prior to permit.

after 4 lots are developed, lots 5 and 6 can be withheld until conditions are brought
up to par. It was noted that this may involve a significant expense to the City or
Mr. Gregory.
At this point it is difficult to judge the impact of these lots since they are being
developed simultaneously. While the uses project under the maximum, the maximum
may be too high for todays Williston Road traffic conditions.
4. MARINE COLLECTIONS, 2073 WILLISTON ROAD
The applicant proposes to construct a 16,000 square foot boat storage building on the
P.J. Auto lot. The Zoning Board granted a multiple use permit for this building,
the fourth on this lot.
Access and Circulation: Access is proved through the existing paved areas, (including
the shared driveway with Brown) to the new boat storage facility.
Parking : Parking spaces will not change.
Landscaping: A $3750 landscaping bond is required. The proposed plan consists of white
pine and juniper but additional landscaping is needed to meet the requirement. Since
so much of the property if paved, the few landscaped areas could be enhanced.
Others: See Szymanski's and Goddette comments.
5. ONE TWIN OAKS TERRACE
The applicant proposes to construct two office buildings with a total of 18,000 square
feet on two floors. This received a conditional use permit from the Zoning Board. It
is Zoned R7.
Circulation and Access: Access is through a 30 foot wide driveway from Twin Oaks Drive.
There is circulation on three sides of the buildings. (See Bill Szymanski's comments
regarding the driveway).
Parking: This shows 72 spaces as required.
Landscaping: A �15,000 landscaping bond is required prior to permit. The plan is
sufficient.
Other: See Goddette's comments. The 100 foot set back from Potash Brook is maintained
as required.
This plan will require a sewer allocation of approximately 1200 gallons per day.
6. MILOT, PRE -SKETCH PLAN DISCUSSION
Jerry Milot would like to discuss his commerical development plan for the Fayette Property
on Shelburne Road. The major concerns are:
1. How does this tie into %(o erleau's plans?
2. What traffic impact does this have?
What improvements are needed prior to development? For what should
the developer be responsible?

improvements, etc)
