HomeMy WebLinkAboutSP-23-008 - Decision - 0045 San Remo Drive#SP-23-008 - 1 - CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CHAMPLAIN OIL COMPANY, INC. – 45 SAN REMO DRIVE SITE PLAN APPLICATION #SP-23-008 FINDINGS OF FACT AND DECISION Champlain Oil Company, Inc., hereinafter referred to as the applicant, is seeking to amend a previously approved plan for a medical office. The amendment consists of adding mounted lights to the building exterior and an appropriately screened waste receptacle, 45 San Remo Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a medical office. The amendment consists of adding mounted lights to the building exterior and an appropriately screened waste receptacle, 45 San Remo Drive. 2. The owner of record of the subject property is Champlain Oil Company, Inc. 3. The subject property is located in the Form-Based Code Transect Zone 4 and in the Transit Overlay District. 4. The applicant had previously submitted a Site Plan application (#SP-22-038) to modify the site by adding building mounted lights and a waste receptacle. This application was approved on September 21, 2022, but the applicant did not get a Zoning Permit for that work within six months of that approval. As such, the approval became null and void. This application serves to approve the items included in the earlier application #SP-22- 038 and to include further modifications to the exterior lighting plan. 5. A complete application was received on March 27, 2023. 6. The submitted plans consist of the following. All other standards will continue to be met. #SP-23-008 - 2 - 13.03 Bicycle Parking and Storage 7. As per Table 13-3, the minimum number of short-term bicycle parking spaces for any office use is 4. These parking spaces must adhere to the design guidelines laid out in Section 13.03.B(2) of the LDRs. The applicant has proposed two ‘inverted U’ bicycle racks, providing four short-term bicycle parking spaces in accordance with the standards. As such, the Administrative Officer finds this criterion met. 13.04 Snow Storage 8. Per Section 13.04(B)(7), “snow storage areas must be specified and located in an area that minimizes the potential for erosion and contaminated runoff into any adjacent or nearby surface water.” The snow storage area is indicated on the site plan in the northwest corner of the lot. The Administrative Officer find this criterion met. 13.07 Exterior Lighting 9. Per Section 13.07.A, exterior lighting “shall have such shielding as will direct the light downward and will prevent the source of light from being visible from any adjacent residential property or street”. Four new and four replaced building-mounted lights are proposed to be installed at a height of ten feet on all four sides of the building. All lighting fixtures proposed are downcast, as indicated on the provided lighting cut sheet. The proposed lighting fixtures will not create a glare of greater than 0.3 footcandles on any adjacent property. As such, the Administrative Officer finds this criterion met. 14.07 Disposal of Wastes 10. Per Section 14.07.I, dumpsters “shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s)”. One dumpster is noted on the plan and is proposed to be constructed on a concrete pad within an enclosure of opaque fencing. As such, the Administrative Officer finds this criterion met. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-23-008 of Champlain Oil Company, Inc., subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months from the date of this decision or this approval expires and is null and void. The applicant may submit a request for an extension to obtain a zoning permit under the terms outlined in Section 17.04 of the LDR’s, but the request must be submitted prior to the expiration of this approval. #SP-23-008 - 3 - 4. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 5. Any exterior lighting shall be downcast and shielded per Section 13.07 of the Land Development Regulations. 6. Bicycle parking must meet the minimum standards of Section 13.03. of the Land Development Regulations. 7. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the amended features. 8. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan must meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. 9. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations.
