MINOR LOT LINE ADJUSTMENT APPLICATION #AD-22-01
FINDINGS OF FACT AND DECISION
JJJ South Burlington, LLC, hereinafter referred to as the applicant, is seeking approval for the
establishment of 77 footprint lots within an approved residential subdivision of 142 homes,
1580 Dorset Street & 1699 Hinesburg Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the follow:
FINDINGS OF FACT
1. The applicant is seeking approval for the establishment of 77 footprint lots within an
approved residential subdivision of 142, 1580 Dorset Street & 1699 Hinesburg Road.
2. The owner of record of the subject properties is JJJ South Burlington, LLC.
3. The subject properties are located in the Southeast Quadrant Neighborhood Residential &
Southeast Quadrant Village Residential Zoning Districts.
4. The application was received on December 16, 2022.
5. The subject properties consist of four lots totaling approximately 38.5 acres in a previously
approved planned unit development along Aurora Road, Senator Street, Nadeau Drive,
Liberty Lane, and Russet Road. The proposal is to establish 77 building footprint lots within
these 4 existing lots.
6. The plats submitted are numbered Sheet PL2, “Subdivision Plat of Cider Mill Phase II - South
Burlington, Vermont”, prepared by O’Leary-Burke Civil Associates, PLC, with a last revised
date of 11/21/2022; and PL3, “Subdivision Plat of Cider Mill Phase II - South Burlington,
Vermont”, prepared by O’Leary-Burke Civil Associates, PLC, last revised on 11/21/2022.
DIMENSIONAL STANDARDS
The applicant proposes to create 77 ‘footprint’ lot lines, designed to contain proposed single-
family homes and the separately owned halves of duplexes, within four lots totaling
approximately 38.5 acres in a previously approved planned unit development. This action would
create non-conforming lots (being of insufficient individual size and not meeting maximum
building or lot coverage requirements) and therefore will not be considered individual lots for
the LDRs. For purposes of the LDRs, the seventy-seven footprint lots in this proposal shall be
considered four lots as approved previously. The applicant will be required to record a “Notice
of Condition” to this effect which has been approved by the City Attorney prior to recording the
final plat plan. The applicant is concurrently seeking subdivision approval to establish the single
family home lots as individual lots.

DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves Minor Lot Line
Adjustment Application #AD-22-01 of JJJ South Burlington, LLC, for the establishment of
footprint lots within an approved residential subdivision, 1580 Dorset Street & 1699 Hinesburg
Road, subject to the following conditions:
1. All previous municipal approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plat and will be on file in the South
Burlington Department of Planning and Zoning.
3. For purposes of the LDRs, the lots included in this subdivision shall be considered four (4)
lots as approved previously. The applicants shall record a “Notice of Condition” to this effect
which has been approved by the City Attorney prior to recording the final plat plan.
4. The final plat plan must be recorded in the land records within 180 days or this approval is
null and void. The plan must be signed by the Administrative Officer prior to recording.
Prior to recording the final plat plan, the applicant must submit a copy of the survey plat in
digital format. The format of the digital information will require approval of the South
Burlington GIS Coordinator.
5. Any change to the plat plan will require approval by the South Burlington Development
Review Board or the Administrative Officer.

must be accompanied with a $233 filing fee and be filed within 15 days of the date of this
decision.
