HomeMy WebLinkAboutSP-23-007 - Decision - 0650 Spear Street#SP-23-007 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING UNIVERSITY OF VERMONT – 650 SPEAR STREET SITE PLAN APPLICATION #SP-23-007 FINDINGS OF FACT AND DECISION Site plan application #SP-23-007 of the University of Vermont to amend the plan for an existing agricultural complex. The amendment consists of modifying the previously-approved silt fence at the previously approved outdoor storage area, 650 Spear Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The University of Vermont is seeking to amend the plan for an existing agricultural complex. The amendment consists of amending the previously approved silt fence at the previously approved outdoor storage area, 650 Spear Street. 2. The applicant received site plan approval (#SP-22-047) on 11/04/2022 to add outdoor storage for the purpose of storing steel. Temporary silt fencing for erosion control was approved as permanent as part of that site plan. The applicant is now proposing to only retain a limited portion of the previously approved silt fencing for project demarcation purposes. 3. The application was received on February 9, 2023 4. The subject property is located in the Institutional and Agricultural South Zoning District, the Interstate Highway Overlay District, River Corridor Overlay District and the Environmental Hazards Wetland Overlay. 5. The plans submitted consist of: Sheet No. & Title Prepared by Plan Last Revised on: C-1.0 Steel Laydown Site Plan Krebs & Lansing 02/02/2023 C-1.1 Steel Laydown Site Restoration Plan Krebs & Lansing 02/02/2023 The applicant is proposing to amend its previously approved site plan (#SP-22-047). The amendment includes revised plans that removed the silt fence along the driveway and shows a silt fence that is funcƟoning as a construcƟon limit demarcaƟon instead of its typical funcƟon for sediment control, which is not necessary aŌer construcƟon is complete. Combined Review Pursuant to Section 14.09(E), the applicant has requested a combined administrative site plan and zoning permit review. The Administrative Officer finds the criteria for combined review to be met. #SP-23-007 DECISION The Administrative Officer hereby approves Site Plan Application #SP-23-007 of the University of Vermont, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plan submitted by the applicant and on file in the South Burlington Department of Planning and Zoning as conditioned herein. 3. A digital PDF version of the approved final plan set must be delivered to the Administrative Officer before issuance of a zoning permit. 4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the project. 5. The Administrative Officer hereby issues zoning permit #ZP-23-058 concurrently with this application. 6. Any changes to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer as allowed by the Land Development Regulations.
