Assignment of Open Space
Assignment #4
This assignment of Open Space is made pursuant to Section 8.08.E of the City of South
Burlington Land Development Regulations (effective May 23, 2022) and the
Development Review Board’s approval of the Large Development Area Open Space in
Miscellaneous Application #MS-19-06 (dated 02-03-20).
A total of 62,760 square feet of qualifying Open Space was approved in the Large
Development Open Space. Qualifying Open Space may be assigned by South
Burlington City Center, LLC (the landowner) to one or more site development projects.
Proposed site development on Lot B located at 224 Market Street (Building B2), 268
Market Street (Building B1), and 339 Garden Street (Building B3) (the Project) is
subject to FBC Site Plan application #SP-__________, which was approved by the City
of South Burlington Acting Administrative Officer on ___________________. An
assignment of 5,397 square feet of Open Space to the Project is hereby made from the
previously approved Large Development Area Open Space.

1,290 square feet Assignment #2 – Lot D / 324 Garden Street

5,397 square feet Assignment #4 – Lot B / Market Street & Garden Street
50,835 square feet Remaining unassigned qualifying Open Space
This assignment of Open Space is contingent upon the following:
obtaining Zoning Permits for the phased construction of the buildings and
improvements approved by FBC Site Plan #SP-_________ within the time
requirements of the Land Development Regulations
Failure to obtain Zoning Permits as described above will result in this assignment of
Open Space being null and void – with the assigned Open Space reverting to South
Burlington City Center, LLC.
