VA N` ^7r ,s ,i 'Wo CITY OF SOUTH BURLINGTON 2 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\su b\h arrocks\final.doc Jane Harrocks, hereafter referred to as the applicant, is requesting sketch plan review of a project to subdivide a 0.7 acre parcel with an existing single-family dwelling into two (2) lots of 20,129 square feet (Lot 1) and 11,095 square feet (Lot 2), 42 Country Club Drive. The subject property is located in the Residential 4 (R4) Zoning District. The Development Review Board reviewed the sketch plan for this project on June 1, 2004 (minutes enclosed). Associate Planner Brian Robertson and Administrative Officer Ray Belair, referred to herein as Staff, have reviewed the plans submitted on June 3, 2004 and have the following comments. Some of the dimensional requirements are not applicable to the project because Lot 2 is vacant. SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\su b\harrocks\final.doc The Superintendent of City of South Burlington Water Department, Jay Nadeau, reviewed the plans for the proposed project and provided comments in a memorandum dated July 14, 2004 (attached). According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. The plans depict the location of the existing sewer line on the subject property. The new lot will be served by a sewer line extending from the main line along Country Club Drive. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. 1. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Buffington Land Development Regulations. In addition, the grading plan shall meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. Both of the subject properties will be accessed by private driveways off of Country Club Drive. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. There are no wetlands on the subject property. The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. The proposed project is compatible with the planned development patterns in the area, as specified by Section 4.03(A) of the Land Development Regulations. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. This criterion is not applicable to the proposed project. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. Staff does not feel that this project warrants review by the South Burlington Fire Chief. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. This criterion is not applicable to the proposed project. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \d rb\sub\harrocks\fi nal. doc Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. 2. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). Staff feels the proposed boundary line adjustment on this property is in conformance with the South Burlington Comprehensive Plan. Lot Layout According to Section 15.10 of the South Burlington Land Development Regulations, a minimum width to length ratio of one to five (1:5) shall be used as a guideline by the Development Review Board in evaluating lot proportions. Square or roughly square lots shall not be approved. The two lots proposed through this project are in compliance with this criterion. RECOMMENDATION Staff recommends that the Development Review Board approve Final Plat Application #SD-04-45 as submitted. Dinklage, Chair; R. Farley, M. Kupersmith, M. Boucher. G. Quimby Also Present: R. Belair, Administrative Officer; B.Robertson, Associate Planner; J. Harrocks, T. Meeker, E. Flannagan, K. Killeen 1. Other Business: a. Mr. Belair gave members a draft of a letter of support for a grant the School District will be applying for. Members agreed to sign the letter. b. Ms. Kupersmith asked if the Board could meet with the City Attorney to discuss some policy and procedural issues. Mr. Belair suggested the 7 September agenda. 2. Minutes of 6 July 2004: It was noted that on p. 2, the reference to Burlington Country Club should read Burlington Tennis Club. Mr. Boucher moved to approve the Minutes of 6 July as amended. Mr. Farley seconded. Motion passed 4-0 with Ms. Quimby abstaining. 3. Public Hearing: Final Plat Application #SD-04-47 of Verizon to amend a previously approved planned unit development consisting of 117 multi- family residential units in 16 buildings. The amendment consists of. 1) constructing an 11'x17'5" utility hut, and 2) adding decorative fencing along Hinesburg Road and Eldredge Street frontage, 33 Eldredge Street: Mr. Belair said there were no changes from sketch plan review, and staff had no issues with the plan. Mr. Boucher moved to approve Final Plat Application #SD-04-47 of Verizon subject to the stipulations in the draft motion. Ms. Quimby seconded. Motion passed unanimously. Public Hearing: Final Plat Application #SD-04-45 of Jane Evans Harrocks to subdivide a 31,224 sq. ft. lot developed with a single family dwelling into two lots of 11,095 sq. ft. (lot #48) and 20,129 sq. ft. (lot #48A), 42 Country Club Drive: Mr. Belair said staff has no issues with the plan as presented. Motion passed unanimously. 5. Sketch Plan Application #SD-04-44 of Thomas Meeker to resubdivide two lots developed with single family dwellings. The resubdivision consists of transferring 7601 sq. ft. of the lot at 15 Gilbert Street to 21 Gilbert Street: Mr. Meeker said he will retain the apple trees he has planted. He will sell the house adjacent to his with'/4 acre. There will be no fencing. He said he has no subdivision intentions. No issues were raised. 6. Public Hearing: Application #CU-04-06 of Kieren & Jennifer Killeen for conditional use approval under Section 14.10, Conditional Use Review of the South Burlington Land Development Regulations. The request is for permission to establish an accessory residential unit, 11 Beacon Street: Mr. Dinklage noted he is a neighbor of the applicant. Members did not feel this was a problem. Mr. Killeen noted they had received approval for this use, but the approval has lapsed. Mr. Belair said there are new rules that will take affect in 2005 and 2011. The Board can continue under the present rules until the regulations change. Mr. Boucher moved to approve Application #CU-04-06 of Kieren & Jennifer Killeen subject to the stipulations in the draft motion. Ms. Quimby seconded. Motion passed unanimously. 7. Site Plan Application #SP-04-24 of Dorset Communications to convert a 7020 sq. ft. GFA building from retail use to radio and television studio use, 372 Dorset Street: Mr. Belair noted that a professional landscaper must prepare the landscape plan. Mr. Belair said staff questions whether there is enough room for parking. Mr. Flannagan said they were told there is enough with angled parking. Mr. Belair said 18 spaces would be sufficient. Mr. Boucher moved to approve Site Plan Application #SP-04-24 of Dorset Communications subject to the stipulations in the draft motion. Ms. Quimby seconded. Motion passed unanimously. Dear Bob: This office is in receipt of a request for a review of the proposed boundary line adjustment involving Lots 48 and 48A located off Country Club Drive in the City of South Burlington. The proposal is to change Lot 48A to 23,778 square feet on which is an existing single family residence served by municipal sewer and water and to change Lot 48 which is a vacant lot to 11,043 that will be served by municipal sewer and water services should the lot be developed with one single family residence. The proposed boundary line adjustment is depicted on the partial plan submitted to this office identified as Project 2407, "Sketch Plan of a Boundary line Adjustment for Jane Evans Harrocks" dated April 21, 2004 and April 26, 2004 prepared by Vermont Land Surveyors, Inc. I have determined that this proposed boundary line adjustment would result in a negligible effect on the potable water supplies and wastewater systems serving the residence on Lot 48A and the potential construction of a potable water supply and wastewater systems on Lot 48. Therefore the boundary line adjustment qualifies for the exemption under Section 1-403(a)(12) of the Environmental Protection Rules. Please note, this letter does not relieve the landowner(s) from obtaining all other applicable state and local approvals. Additionally, a copy of the diagram showing the existing and proposed boundary lines and all affected potable water supplies and wastewater systems must be filed in the City of South Burlington land records along with a copy of this letter. Mr. Dinklage said it would. Mr. Armstrong said he has a sewerage overflow easement and asked if that would be affected. Mr. Dinklage said that would have to be worked out between Mr. Armstrong and the applicant. Mr. Downey, speaking for the applicant, said he didn't think they are doing anything to complicate Mr. Armstrong's situation. ('71ketch Plan Application #SD-04-35 of Jane Harrocks to subdivide a 30,543 sq. ft. lot with an existing single family dwelling into two lots of 19,500 sq. ft. and 11,043 sq. ft., 42 Country Club Drive: Ms. Harrocks said she is selling her house and wants to divide the property so she can eventually sell the other lot. Mr. Boucher asked why the property line is being changed. Ms. Harrocks said there was some confusion as to where the property line was. This is where it was eventually put. Mr. Boucher said he doesn't like property lines that "jog." Ms. Harrocks said there is a steep bank that runs down to a field plain. The jog is there so it fits within the quarter - acre. Members felt they should try to eliminate the "jog." Mr. Dinklage reminded the applicant that a permit is needed for any fill that is put in. 8. Sketch Plan Application #SD-04-30 of Dan & Leo O'Brien to subdivide a 1.02 acre parcel with an existing single family dwelling into four lots ranging in size from 0.23 acres to 0.31 acres, 10 Shunpike Road: Mr. O'Brien said this is the 4th house on the left on Shunpike Road. They will subdivide and either build or sell the lots for development. The units would be in the same market range as others on the block. Mr. Dinklage felt the lots looked like "spaghetti lots." Mr. O'Brien said he envisions a domino affect, and the neighbor to the south has already approached them to buy the rear of his lot. Mr O'Brien felt this is the most practical way to lay things out. Mr. Dinklage asked what one could expect to see of Greentree Park. Mr. O'Brien said the berm hides most of Greentree Park, and the backyards here are very nice. Mr. Dinklage raised the possibility of doing this as a PUD and clustering the homes. Mr. O'Brien said they are trying to do single family homes since it is impossible to find a single family home in the city under $200,000. Mr. Downey, speaking for the applicant, said he didn't think they are doing anything to complicate Mr. Armstrong's situation. Sketch Plan Application #SD-04-35 of Jane Harrocks to subdivide a 30,543 sq. ft. lot with an existing single family dwelling into two lots of 19,500 sq. ft. and 11,043 sq. ft., 42 Country Club Drive: Ms. Harrocks said she is selling her house and wants to divide the property so she can eventually sell the other lot. Mr. Boucher asked why the property line is being changed. Ms. Harrocks said there was some confusion as to where the property line was. This is where it was eventually put. Mr. Boucher said he doesn't like property lines that "jog." Ms. Harrocks said there is a steep bank that runs down to a field plain. The jog is there so it fits within the quarter - acre. Members felt they should try to eliminate the "jog." Mr. Dinklage reminded the applicant that a permit is needed for any fill that is put in. 8. Sketch Plan Application #SD-04-30 of Dan & Leo O'Brien to subdivide a 1.02 acre parcel with an existing single family dwelling into four lots ranging in size from 0.23 acres to 0.31 acres, 10 Shunpike Road: Mr. O'Brien said this is the 41h house on the left on Shunpike Road. They will subdivide and either build or sell the lots for development. The units would be in the same market range as others on the block. Mr. Dinklage felt the lots looked like "spaghetti lots." Mr. O'Brien said he envisions a domino affect, and the neighbor to the south has already approached them to buy the rear of his lot. Mr O'Brien felt this is the most practical way to lay things out. Mr. Dinklage asked what one could expect to see of Greentree Park. Mr. O'Brien said the berm hides most of Greentree Park, and the backyards here are very nice. Mr. Dinklage raised the possibility of doing this as a PUD and clustering the homes. Mr. O'Brien said they are trying to do single family homes since it is impossible to find a single family home in the city under $200,000. There is also a question of what might trigger a city street. The plans should be revised to show the location of the existing and proposed sewer lines on the subject property, prior to submittal of the final plat plans. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. 3. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan shall meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. Both of the subject properties will be accessed by private driveways off of Country Club Drive. 4. The plans should be revised to dearly depict the proposed access to Lot 48, prior to submittal of the final plat plans. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. There are no wetlands on the subject property. The project is designed to be visually compatible with the planned development pattems in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. The proposed project is compatible with the planned development patterns in the area, as specified by Section 4.03(A) of the Land Development Regulations. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between aayoining parcels armVor stream buffer areas. This criterion is not applicable to the proposed project. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. Staff does not feel that this project warrants review by the South Burlington Fire Chief. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners.
