HomeMy WebLinkAboutSP-22-061 - Decision - 1560 Williston Road#SP-22-061 - 1 – CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING COMMUNITY LUTHERAN CHURCH – 1560 WILLISTON ROAD SITE PLAN APPLICATION #SP-22-061 FINDINGS OF FACT AND DECISION Site Plan application #SP-22-061 of Lawrence W. Luby Jr. to amend a previously approved plan for a 9,651 sq. ft. place of worship. The amendment consists of installing two (2) additional parking lot lights, 1560 Williston Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. Lawrence W. Luby Jr., hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 9,651 sq. ft. place of worship. The amendment consists of installing two (2) additional parking lot lights, 1560 Williston Road. 2. The owner of record of the subject property is Community Lutheran Church. 3. The subject property is located in the Residential 4 (R4) Zoning District and Traffic Overlay District – Zone 3. 4. The application was received on December 20, 2022. 5. The plans submitted consist of Sheet 1, Site Plan, prepared by Lamoureux & Dickinson Consulting Engineers, Inc, dated 2/10/2004 and last revised 3/10/2022, and a photometric drawing, unnumbered, prepared by TCE and dated 12/15/2022. ZONING DISTRICT & DIMENSIONAL REQUIREMENTS 6. Coverages are not changing as a result of this application. 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. 14.06 H. Disposal of Wastes. All dumpsters and other facilities to handle solid waste, including compliance with any recycling, composting, or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). Small receptacles intended for use by households or the public (ie, non-dumpster, non-large drum) shall not be required to be fenced or screened. 8. The dumpster is not shown as enclosed. The Administrative Officer finds the provided dumpster must be enclosed by opaque fencing at a height equal to or exceeding the dumpster height. #SP-22-061 - 2 – 13.03 Bicycle Parking 9. Pursuant to Section 13.03(B), the applicant must provide 50% of the minimum requirement of four (4) bicycle parking spaces at the time of the first site plan application. The applicant has indicated a previously approved bicycle rack location on the plan. The Administrative Officer finds the provided bicycle parking rack must provide parking for a minimum of two (2) bicycles consistent with the standards of 13.03B(1)(b) and 13.03B(2)(d)(i). The Administrative Officer finds this criterion met. 13.04B(7) Snow Storage 10. Per Section 13.04(B)(7), “snow storage areas must be specified and located in an area that minimizes the potential for erosion and contaminated runoff into any adjacent or nearby surface water.” The Administrative Officer finds the applicant must specify snow storage areas. 10.01 Traffic Overlay District (Zone 3) 11. Additional traffic is not expected as part of this application. 13.07 Exterior Lighting 12. Lighting requirements are summarized as follows. (1) Fixtures must be downcast and shielded (2) Illumination must be evenly distributed (3) Fixtures must be placed to minimize lighting from becoming a nuisance (4) Poles shall be rustproof metal, cast iron, fiberglass, finished wood or similar structural material, with a decorative surface or finish (5) Poles & building mounted fixtures may be no higher than 30-ft (6) Poles must be located in safe locations Specific requirements for maximum illumination levels are included in Appendix A and are limited to 3 foot candles average at ground level. The applicant has provided a photometric drawing indicating this criterion is met. Proposed fixtures otherwise meet the lighting requirements. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-22-061, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. #SP-22-061 - 3 – 3. The plans must be revised to show the changes below prior to issuance of a zoning permit: a. Provide a dumpster enclosure consisting of opaque fencing at a height equal to or exceeding the dumpster height. b. Show the location of snow storage area(s) per Section 13.06(B)(6) of the Land Development Regulations. 4. A digital PDF version of the approved final plan must be delivered to the Administrative Officer before issuance of a zoning permit. 5. The applicant must obtain a zoning permit within six (6) months from the date of this decision or this approval expires and is null and void. The applicant may submit a request for an extension to obtain a zoning permit under the terms outlined in Section 17.04 of the LDR’s, but the request must be submitted prior to the expiration of this approval. 6. The provided bicycle parking rack must provide parking for a minimum of two (2) bicycles consistent with the standards of 13.03B(1)(b) and 13.03B(2)(d)(i). 7. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 8. All new buildings are subject to the Stretch Code pursuant to Section 3.15: Residential and Commercial Building Energy Standards of the LDRs. 9. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. 10. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 11. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the site modifications. 12. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations.
