The amendment consists of constructing an expansion of the existing taxiway “G” and “South Apron”, 1200 Airport Drive. CONTEXT The Development Review Board was scheduled to review this application on December 6, 2020. The Board continued the hearing to December 20, 2022, for purpose of giving the applicant time to work out the details of their proposed stormwater management plan with the City Stormwater Section. The applicant did not have an updated plan prepared in time to be included in this packet. However, Staff considers that should these plans be finalized and approved by the City Stormwater Section prior to the hearing on December 20, 2022, the Board may hear this application with the understanding that all stormwater-related comments have been resolved. If the applicant does not provide revised plans to the specifications of the City Stormwater Section prior to the hearing on December 20, 2022, Staff recommends the Board continue this application without discussion to January 4, 2023, and hear it then. The applicant was represented by ___. Based on the plans and materials contained in the document file for this application, the Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The City of Burlington/Burlington International Airport, hereinafter referred to as the applicant, is seeking site plan approval to amend a previously approved plan for an airport complex. The amendment consists of constructing an expansion of the existing taxiway “G” and “South Apron”, 1200 Airport Drive. 2. The owner of record of the subject property is the City of Burlington/Burlington International Airport. 3. The subject property is located in the Airport and Airport Industrial Zoning Districts. 4. The application was received on November 9, 2022. 5. The purpose of the proposed expansion is to extend the existing apron and taxiway from its current terminus to establish a connection with the proposed building and hangar approved as part of #SD-21-28. (1) All applications for development within the AIR District involving new or expanded buildings or structures shall comply with the requirements of Section 13.03, Airport Approach Cones. No new buildings or structures are proposed. B) SITE PLAN REVIEW STANDARDS 14.06 General Review Standards A. Relationship of Proposed Structures to the Site. (1) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. The applicant is proposing to expand Taxiway G and the South Apron. The Board finds the proposed expansion will not affect compliance with this criterion. (2) Parking: (a) Parking shall be located to the rear or sides of buildings. Any side of a building facing a public street shall be considered a front side of a building for the purposes of this subsection. The project does not affect parking. The Board finds this criterion not applicable. (3) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or anticipated adjoining buildings. No new buildings are proposed. The Board finds this criterion not applicable. #SP-22-055 3 14.07 Specific Review Standards In all Zoning Districts and the City Center Form Based Codes District, the following standards shall apply: A. Environmental Protection Standards. All proposed development shall be subject to the applicable requirements of Article 12, Environmental Protection Standards. No impacts to natural resource areas are proposed. The Board finds this criterion not applicable. B. Site Design Features. All proposed development shall comply with standards for the placement of buildings, parking and loading areas, landscaping and screening, open space, stormwater, lighting, and other applicable standards related to site design pursuant to these Land Development Regulations. The proposed lighting changes are to FAA-owned navigational aids. Stormwater management standards are discussed below. No changes affecting other elements of this criterion are proposed. The Board finds this criterion met. C. Access and Circulation. All proposed development shall comply with site access and circulation standards of Section 15.A.14. No changes to site access or circulation are proposed; the proposed project involves the extension of an existing airport taxiway. The Board finds this criterion met. D. Transportation Demand Management (TDM) [reserved] E. Building Form. Development within the City Center Form Based Code District, the Urban Design Overlay District, and other districts with supplemental building form standards shall adhere to the standards contained therein. No buildings are proposed. The Board finds this criterion not applicable. F. Streetscape Improvements. A proposed new construction or extension/expansion of an existing structure exceeding the thresholds listed in either (a) Section 14.09(B) or (b) Section 8.11(D) within the City Center Form Based Code, or Section 3.11(D) in all other zoning districts, shall be required to upgrade adjacent sidewalks, greenbelts, and related street furniture (trees, benches, etc.) to the standards contained within the applicable Street Type and Building Envelope Standard. Nothing in this subsection shall be construed to limit requirements for additional upgrades as necessary to meet the requirements of these Regulations. No construction or expansion of structures is proposed. The Board finds this criterion not applicable. G. Access to Abutting Properties. The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial or collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. The Board finds that no additional land is needed to support access to abutting properties. H. Utility Services. Electric, telephone and other wire-served utility lines and service connections shall be underground insofar as feasible and subject to state public utilities regulations. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Standards of Section 15.A.18, Infrastructure, Utilities, and Services, shall also be met. #SP-22-055 4 Wire-served utility services are not proposed to be affected. The South Burlington Water Department Director reviewed the plans on 11/19/2022 and offers the following comments. The Existing Conditions plan does not include the 12” water line that runs from Valley Road to the Air National Guard site, that could be impacted by the proposed project. That line must be shown on all future plans. The SBWD will review the project again after the water line is accurately placed on the project plans. The Board finds the applicant must revise the plans to address the comments of the South Burlington Water Department Director, subject to the Director’s review and approval, prior to issuance of a zoning permit for the project. I. Disposal of Wastes. All dumpsters and other facilities to handle solid waste, including compliance with any recycling, composting, or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). Small receptacles intended for use by households or the public (ie, non-dumpster, non-large drum) shall not be required to be fenced or screened. No changes affecting compliance with this criterion are proposed. C) OTHER 13.05 Stormwater Management Stormwater standards apply when one-half acre or more of impervious surface exists or is proposed to exist, and where 5,000 sf of impervious is created or reconstructed. The City Stormwater Section reviewed the proposed plans on 11/23/2022 and offers the following comments: 1. This project is located within in the Muddy Brook watershed. 2. The project area includes 6.2 acres of impervious, with approximately 2.5 acres of existing impervious and 3.7 acres of proposed new impervious. 3. There are existing dry swales and catch basins permitted under Permit #3028-9010.2 by the State of Vermont. 4. The project proposes to expand existing impervious area onsite by greater than 5,000 sf and disturb greater than 1 acre of land. It will therefore require a stormwater permit and construction permit from the Vermont DEC Stormwater Division. The applicant should acquire these permits before starting construction. 5. As the project proposes to expand existing impervious area by greater than 5,000 sf, as well as containing greater than one-half acre of impervious area, the project is subject to the requirements of section 13.05 of the LDRs. 6. The applicant should confirm that requirements in Section 13.05(B)(6) are met and that peak runoff rates are not increased during the 1-year storm event. 7. The applicant is required to submit the additional information outlined in Section 13.05(B), so that compliance with the City’s Stormwater Management Standards can be evaluated. The additional information required includes the following: a. Infiltration testing results, as well as a map indicating the locations where infiltration testing occurred. #SP-22-055 5 b. Stormwater worksheet information for the proposed sand filter. c. A detailed maintenance plan for the proposed stormwater treatment practices. This maintenance plan should include site specific maintenance in the event of an oil spill at the fueling location and how the sand filter will be cleaned. 8. For the lined sand filter practice, the submitted HydroCAD model indicates that during the WQv storm event, the water level in the practice would peak at 317.3’, overtopping the weir in DMH 14, which is set at 317.25’. As designed, this would allow runoff to bypass the sand filter treatment at a rate of 0.14 cfs during the 1-inch storm. The storage of this practice should be increased to prevent runoff from overtopping the weir during this storm event. 9. The applicant should provide a HydroCAD model that demonstrates existing site runoff conditions. 10. The Vermont Stormwater Management Manual (VSMM) indicates that underdrained sand filters shall have minimum 6” perforated pipe underdrain within a minimum 12” layer of stone below the filtering media. The applicant should revise the details to show this layer of stone beneath the sand filter area. 11. The applicant should provide cross-section details for the subsurface infiltration practice. 12. The applicant should indicate the pretreatment practices proposed for the subsurface infiltration practice and the lined sand filter. 13. Exhibit 15: Drainage Details Sheet 4 of 4 a. The applicant should ensure that all pipe elevations, sizes, and orientations match the elevations provided on Sheet GD1.1. Weir and RIM elevations should be confirmed as well. b. The plan view detail of DMH 14 does not show the inlet pipe from DMH 13. c. The applicant is proposing a lined sand filter due to the runoff for this practice originating from a fueling area, which is a hotspot land activity. The inlet and outlet structures for the practice contain weirs. The elevation for the underdrain pipe for the sand filter is 308.95’, which is below the outlet invert of the 24” pipe from DMH 14 to DMH 15 at 312.05. Since the practice is lined and does not infiltrate, this will create a permanent pool of water within the sand filter. The VSMM requires that sand filters drain over a maximum of 48 hours. d. The submitted HydroCAD model indicates that the subsurface infiltration system shall outlet via a 12” pipe at 308.95. The submitted plans indicate that the subsurface infiltration system shall outlet via a 24” HDPE pipe at 312.05 to DMH 12. The applicant should clarify the proposed outlet pipe size and elevation. 14. The applicant should provide an EPSC plan indicating the location of erosion control devices. 1. Staff recommends the Board require the applicant to address these comments to the satisfaction of the City Stormwater Section prior to closing the hearing. Once resolved: The City Stormwater Section provided comments on the plans on 11/23/2022. The applicant addressed the comments on ___ and the City Stormwater Section indicated there were no outstanding comments. The Board finds the stormwater management standards of 13.05 to be met. 16.03 Standards for Erosion Control during Construction #SP-22-055 6 As noted in Stormwater comment #14 above, the applicant has not submitted an EPSC plan. Staff considers these criteria will be met when the comments of the City Stormwater Section are addressed. DECISION Motion by __, seconded by __, to approve site plan application #SP-22-055 of City of Burlington/Burlington International Airport, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plan submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The applicant must regularly maintain all stormwater treatment and conveyance infrastructure. 4. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 5. The applicant must obtain a stormwater permit and construction permit from the Vermont DEC Stormwater Division prior to issuance of a Zoning Permit. 6. The applicant must revise the plans to address the comments of the South Burlington Water Department Director, subject to the Director’s review and approval, prior to issuance of a zoning permit for the project. 7. The applicant must obtain a zoning permit within six (6) months from the date of this decision or this approval expires and is null and void. The applicant may submit a request for an extension to obtain a zoning permit under the terms outlined in Section 17.04 of the LDR’s, but the request must be submitted prior to the expiration of this approval. 8. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan must meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. 9. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the new uses. 10. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer as allowed by the Land Development Regulations.
