Re: Findings of Fact, application of Ben & Jerry's Homemade, Inc. to amend a previously approved
plan for a 270,780 square foot building consisting of 65,000 square feet of general office use, 20,000
square feet of warehouse use, and 185,780 square feet of light manufacturing use, 3,0 Communes
Drive. The amendment consists of correcting the total building square footage, which is 276,566
square feet, with the following use breakdown: 88,030 square feet of general office use, 18,000
square feet of warehouse use, and 170,536 square feet of light manufacturing use.
On the 3
rXday of August, 1999, the Director of Planning & Zoning approved the request of
Ben & Jerry's Homemade, Inc. for site plan review under Section 26.10 of the South Burlington
Zoning Regulations based on the following findings:
1. This project consists of amending a previously approved plan for a 270,780 square foot building
consisting of 65,000 square feet of general office use, 20,000 square feet of warehouse use, and
185,780 square feet of light manufacturing use, 30 Community Drive. The amendment consists of
correcting the total building square footage, which is 276,566 square feet, with the following use
breakdown: 88,030 square feet of general office use, 18,000 square feet of warehouse use, and
170,536 square feet of light manufacturing use. The only issues affected by this amendment are
landscaping, parking, traffic and sewer.
2. Landscaping: The minimum landscaping requirement, based on building cost, is $18,480 which
is not being met. Applicant requested a waiver due to the presence of extensive landscaping currently
on the site. The site is currently well landscaped.
3. Sewer: This building currently has a sewer allocation of 14,000 gpd. The proposed and existing
uses would need 5,175 gpd of the overall allocation. This leaves 8,825 gpd for the future tenants in
the remainder of the building.
4. Parking: The existing and proposed uses require a total of 459 spaces and 1,000 spaces are
available including a bike rack.
5. Traffic: Based on ITE, it is estimated that the existing approved uses generate 289.4 vehicle trip
ends (vte's) during the P.M. peak hour and with the proposed change in use to generate 310.4 vte's.
This represents a 21 vte increase.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Director of Planning & Zoning
(hereinafter Director) approves the site plan application of Ben & Jerry's Homemade, Inc. to amend
a previously approved plan for a 270,780 square foot building consisting of 65,000 square feet of
general office use, 20,000 square feet of warehouse use, and 185,780 square feet of light
manufacturing use, 30 Community Drive. The amendment consists of correcting the total building
square footage, which is 276,566 square feet, with the following use breakdown: 88,030 square feet
of general office use, 18,000 square feet of warehouse use, and 170,536 square feet of light
manufacturing use, as depicted on a two (2) page set of plans, page one (1) entitled, "Technology
Park," dated "received" 7/8/99, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. For the purpose of calculating required road impact fees under the South Burlington Impact Fee
Ordinance, the Director estimates that the proposed change in use will fit within the approved
number of trip ends for the property and therefore will generate zero (0) additional trip ends during
the P.M. peak hour.
3. Pursuant to Section 26.105(a) ofthe zoning regulations, the Director grants a $18,480 landscaping
credit for existing landscaping.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the
zoning regulations or this approval is null and void.
5) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer
prior to the use of the newly converted space.
6) Any change to the site plan shall require approval by the South Burlington Development Review
