Re: Findings of Fact, conditional use application #CU-01-02 and site plan application #SP-
01-05 of Technology Park Partners to amend a previously site plan for a 276,566 square
foot building used for: 1) 122,030 square feet of general office use, 2) 35,600 square feet of
warehouse use, and 3) 118,936 square feet of light manufacturing use. The amendment
consists of utilizing 220 parking spaces of a 1057 space parking area as a private parking
facility for Fletcher Allen Health Care employees, 30 Community Drive.

On the 20th of February 2001, the South Burlington Development Review Board
approved the conditional use application under Section 26.05 and site plan application
under Section 26.10 of the South Burlington Zoning Regulations of Technology Park
Partners based on the following findings:
This project consists of amending a previously site plan for a 276,566 square foot
building used for: 1) 122,030 square feet of general office use, 2) 35,600 square feet
of warehouse use, and 3) 118,936 square feet of light manufacturing use. The
amendment consists of utilizing 220 parking spaces of a 1057 space parking area as a
private parking facility for Fletcher Allen Health Care employees, 30 Community
Drive.
2. The owner of record is Technology Park Associates, Inc.; PMF Energy, Inc.; and
Axinn-Vermont, Inc.
3. This property is located within the Mixed Industrial and Commercial District,
Conservation and Open Space District, and the within the Airport Approach Cones.
4. Access/Circulation: The proposed changes will not affect access or circulation.
5. Parking: The applicant requested designating 220 parking spaces as a private parking
facility.
6. Landscaping_ The minimum landscaping requirement is not applicable.
7. Lighting; No additional lighting is proposed.
8. Traffic: The July 9, 1996 Planning Commission approval of the Technology Park
subdivision allocated 647 P.M. peak hour vehicle trip ends (vte's) for the entire 14 lot
subdivision. The Planning Commission requested that a traffic study be conducted if
the P.M. peak vte's exceed 647 for the entire subdivision. This has yet to be done.
ITE estimates that the approved use on Lot #7 will generate 96.85 P.M. peak vte's.
The approved use for Lot #2 is estimated to generate 71.52 P.M. peak vte's. The
current use on Lot #8A is estimated to generate 243.4 P.M. peak vte's. ITE estimated
that the proposed private parking use on Lot # 8A will generate 141.928 additional
P.M. peak vte's. This will result in 93.3 trip ends available for the other undeveloped
lots. Traffic impact fees should be paid only on additional P.M peak vte's above the
647 approved P.M. peak vte's.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves conditional use application #CU-01-02 and site plan application #SP-01-05 of
Technology Park Partners to amend a previously site plan for a 276,566 square foot
building used for: 1) 122,030 square feet of general office use, 2) 35,600 square feet of
warehouse use, and 3) 118,936 square feet of light manufacturing use. The amendment
consists of utilizing 220 parking spaces of a 1057 space parking area as a private parking
facility for Fletcher Allen Health Care employees, 30 Community Drive, as depicted on a
one (1) page set of plans, entitled, "Technology Park Kimball Avenue So. Burlington, VT
Master Site Plan", prepared by Trudell Consulting Engineers, Inc., dated 5/22/96, last
revised on 10/10/00, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. The site plan shall be revised to show the changes listed below and shall require approval
of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the
approved revised site plan shall be submitted to the Director prior to permit issuance.
a) The site plan shall be revised to depict the 220 parking spaces to be
designated for use by Fletcher Allen Health Care employees.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the private parking facility.

5. Any change to the site plan shall require approval by the South Burlington Development
Review Board.

24 V.S.A. § 4471 and V.R.C.P. 76, in writing, within 30 days of the date this decision is issued. The fee is
$150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be
lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d)
(exclusivity of remedy; finality).
