SITE PLAN APPLICATION #SP-22-029 FINDINGS OF FACT AND DECISION Heritage Automotive Group, Inc., hereinafter referred to as the applicant, is seeking to amend a previously approved site plan for a 112,453 sq. ft. automotive dealership. The amendment consists of replacing an existing sidewalk with a concrete walkway and seating area, 1600 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved site plan for a 112,453 sq. ft. automotive dealership. The amendment consists of replacing an existing sidewalk with a concrete walkway and seating area, 1600 Shelburne Road. 2. The owner of record of the subject property is Heritage Automotive Group, Inc. 3. The subject property is located in the Commercial 2 Zoning District. 4. The application was received on August 15, 2022. 5. The plans submitted consist of the following: Only those aspects of the site plan which are proposed to be modified are identified and reviewed for compliance. Relationship of Proposed Structures to the Site. (1) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. The applicant is proposing to remove two existing sidewalks between various parking areas and the Heritage Ford building and replace them with a concrete sidewalk which will link the parking areas with the building and with one another. The proposed sidewalk is wider than the existing sidewalk and will feature benches and landscaping elements. As such, the Administrative Officer finds this criterion met. 13.04 Landscaping. The applicant is proposing to maintain all existing landscaping features and add two plantings along the proposed walkway. As such, the Administrative Officer finds this criterion met. 13.03 Bicycle Parking. Pursuant to Section 13.03.B of the Land Development Regulations, the applicant must provide one short-term bicycle parking space for every 5,000 square feet of gross floor area for this use. The property has several buildings, totaling 112,453 square feet GFA, and therefore is required to provide short-term parking spaces for 22 bicycles. As per Section 13.03.B(1)(a), the applicant must meet at least 50% of the short-term bicycle parking requirement as part of the first Site Plan Amendment and meet 100% of that same requirement as part of any subsequent Site Plan Amendments. This is the first site plan amendment since the rule was implemented. As such, the applicant must provide 11 total short-term bicycle parking spaces to meet 50% of the total requirement. The applicant is proposing to install six inverted-U bike racks, providing 12 short-term bicycle parking spaces. The Administrative Office finds this criterion met. 13.04 Snow Storage. Snow storage areas have been indicated on the plan. 13.07 Exterior Lighting. All lighting fixtures shall be downcast and shielded. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-22-029 subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Administrative Officer concurrently issues Zoning Permit #ZP-22-350. 3. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the new walkway. 4. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 5. All short-term bicycle parking spaces must adhere to the standards outlined in Section 13.03.B(2) of the Land Development Regulations. 6. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations. #SP-22-029 - 3 – Signed on this 30 day of September, 2022 by Marla Keene, Acting Administrative Officer PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by filing a Notice of Appeal with the secretary of the Development Review Board.
