SITE PLAN APPLICATION #SP-22-037
FINDINGS OF FACT AND DECISION
Burlington UMall Owner, LLC, hereinafter referred to as the applicant, is seeking to amend a
previously approved Planned Unit Development for a 705,335 sf shopping center complex. The
amendment consists of reconfiguring the striping of the parking area to create twelve ‘Target
Drive-Up’ spaces and an employee loading zone, and a crosswalk linking the main building and
modified parking area, 155 Dorset Street.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved Planned Unit
Development for a 705,335 sf shopping center complex. The amendment consists of
reconfiguring the striping of the parking area to create twelve ‘Target Drive-Up’ spaces
and an employee loading zone, and a crosswalk linking the main building and modified
parking area, 155 Dorset Street.
2. The owner of record of the subject property is Burlington UMall Owner, LLC.
3. The subject property is located in the Form Based Code Transect Zone 4 Zoning District
and the Transit Overlay Zoning District.
4. A complete application was received on October 24, 2022.
5. The submitted plans consist of the following.

SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will continue to be
met.
Vehicle Parking
6. The proposed project eliminates 16 parking spaces and replaces them with 12 ‘Target
Drive-Up’ spaces, reducing the number of available spaces by four. As per 13.02B(1),
there is no minimum number of parking spaces. As such, the Administrative Officer finds
this criterion met.

Access and Circulation
7. 15.A.14(E) pertains to access and circulation and requires safe access to abutting
properties, minimization of curb cuts, and shared vehicular access to the extent feasible.
The project includes the creation of a striped crosswalk to facilitate the safe transition of
Target employees from the interior of the store to the ‘To-Go’ spaces. As such, the
Administrative Officer finds this criterion met.
Short-term Bicycle Parking
8. Pursuant to Section 13.03(B) of the LDRs, the applicant must provide short-term bicycle
parking spaces. The minimum requirement for bicycle parking is one space per every
5,000 square feet of retail use or one space per every 20,000 square feet of
warehousing use. The applicant demonstrated that they had 87 existing short-term
bicycle parking spaces distributed throughout the site. The total minimum number of
required short-term bicycle parking spaces is 128. The applicant proposed the addition
of 42 short-term bicycle parking spaces, all in accordance with the applicable standards
of the LDRs and located nearby principal entrances of the various buildings on the site.
The proposed addition brings the total number of short-term bicycle parking spaces to
129 for the site, one greater than the minimum requirement. As such, the
Administrative Officer finds this criterion met.
Traffic
9. There is no proposed change in use and no proposed change in the previously approved
trip generation.
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site plan
application #SP-22-037 of Burlington UMall Owner, LLC, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. The Administrative Officer concurrently issues Zoning Permit #ZP-22-392.
3. This project shall be completed as shown on the plan and shall be on file in the South
Burlington Department of Planning and Zoning.
4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to
use of the proposed modifications.
5. Any change to the site plan shall require approval by the South Burlington Administrative
Officer or the Development Review Board, as allowed under the Land Development
Regulations.
