HomeMy WebLinkAboutSP-22-033 - Supplemental - 0112 Garden Street (20)Large Development Area Open Space South Burlington City Center Assignment of Open Space Assignment #1 This assignment of Open Space is made pursuant to Section 8.08.E of the City of South Burlington Land Development Regulations (effective ___________) and the Development Review Board’s approval of the Large Development Area Open Space in Miscellaneous Application #MS-19-06 (dated 02-03-20). A total of 62,760 square feet of qualifying Open Space was approved in the Large Development Open Space. Qualifying Open Space may be assigned by South Burlington City Center, LLC (the landowner) to one or more site development projects. Proposed site development on Lots M1, M2, & M3, located at 112 Garden Street (the Project) is subject to FBC Site Plan application #SP-20-006, which is currently under administrative review. An assignment of 3,984 square feet of Open Space to the Project is hereby made from the previously approved Large Development Area Open Space. Summary of Large Development Area Open Space 62,760 square feet Total qualifying Open Space 3,984 square feet Assignment #1 - Lots M1, M2, & M3 / 390 Garden Street 58,776 square feet Remaining unassigned qualifying Open Space This assignment of Open Space is contingent upon the following: · approval of FBC Site Plan #SP-___-_____ · obtaining a Zoning Permit for construction of the improvements approved by FBC Site Plan #SP-___-____ within the time requirements of the Land Development Regulations Failure to obtain either the FBC Site Plan approval or Zoning Permit as described above will result in this assignment of Open Space being null and void – with the assigned Open Space reverting to South Burlington City Center, LLC.
