Sargent SITE PLAN APPLICATION #SP-22-044 FINDINGS OF FACT AND DECISION Ronald D. Sargent, hereinafter referred to as the applicant, is seeking to amend a previously approved site plan for a 15,750 sq. ft. place of worship with childcare and indoor recreation as accessory uses. The amendment consists of replacing the existing walkway with an ADA-compliant walkway, thereby increasing the square footage of the walkway from 72 square feet to 150 square feet, at this property addressed 899 Dorset Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved site plan for a 15,750 sq. ft. place of worship with childcare and indoor recreation as accessory uses. The amendment consists of replacing the existing walkway with an ADA-compliant walkway, thereby increasing the square footage of the walkway from 72 square feet to 150 square feet, at this property addressed 899 Dorset Street. 2. The owner of record of the subject property is the Faith Methodist Church of SB, LLC. 3. The subject property is located in the Residential 2 Zoning District. 4. The application was received on August 19, 2022. 5. The plans submitted consist of one (1) page set of plans:  “Faith United Methodist Church Proposed Addition Site Plan”, Sheet 1, dated 11-2-99 prepared by Civil Engineering Associates and with markups indicating proposed additions prepared by Camiryn Belen on behalf of Next Generation, dated 7/20/2022. Unknown No change  Criterion met #SP-22-044 - 2 – SITE PLAN REVIEW STANDARDS Only those aspects of the site plan which are proposed to be modified are identified and review for compliance. 15.A.15 Sidewalks. Pedestrian sidewalks must meet ADA requirements. 13.03 Bicycle Parking & Storage. A bicycle rack is shown on the plan. Pursuant to Section 13.14 of the Land Development Regulations, bicycle parking shall be provided on the subject property. A building of this size, 15,750 sq. ft.., is required to have a total of four (4) bicycle parking spaces, as per Table 10. Under this amendment, found in Section 13.14(1)(a)(ii), the applicant was required to provide 50% of their total short-term bicycle parking spaces requirement as part of their most recent Site Plan application. That same amendment goes on to state that, if an applicant installs less than 50% of their required bicycle parking capacity as part of a Site Plan, they are required to install the rest of the required bicycle parking as part of any subsequent Site Plan applications. The Administrative Officer finds that, if not already provided, the applicant must install an approved bicycle rack that meets the standards of Section 13.14 at the location where one is indicated on the plan, bringing the total bicycle parking capacity at the site up to four (4) bicycle parking spaces. 13.04 Snow Storage. Snow storage areas have been indicated on the plan. 13.07 Exterior Lighting. All lighting fixtures shall be downcast and shielded. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-22-044 subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Administrative Officer concurrently issues Zoning Permit #ZP-22-350. 3. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the new walkway. 4. The applicant shall provide a total of four (4) bicycle parking spaces per Section 13.14. 5. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 6. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations. #SP-22-044 - 3 – Signed on this 29th day of August, 2022 by __________________________________ Betsy Brown, Acting Administrative Officer PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by filing a Notice of Appeal with the secretary of the Development Review Board.
