HomeMy WebLinkAboutSP-14-24 - Decision - 0030 Community Drive#SP-14-24 l CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING 30 COMMUNITY DRIVE, LLC — 30 COMMUNITY DRIVE SITE PLAN APPLICATION #SP-14-24 FINDINGS OF FACT AND DECISION 30 Community Drive, LLC, hereinafter referred to as the applicant, is seeking site plan approval for: 1) replacement of old light fixtures with new light fixtures, and 2) adding additional handicapped parking spaces, 30 Community Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking site plan approval for: 1) replacement of old light fixtures with new light fixtures, and 2) adding additional handicapped parking spaces, 30 Community Drive. 2. The owner of record of the subject property is 30 Community Drive, LLC. 3. The subject property is located in the Mixed Industrial and Commercial Zoning District. 4. The application was received on May 30, 2014. 5. The plan submitted consists of a two (2) page set of plans, page one (1) is entitled, "30 Community Drive, LLC 30 Community Drive South Burlington, Vermont Site Plan", prepared by Trudell Consulting Engineers, dated 04-30-2014, last revised on 05/12/2014. DIMENSIONAL REQUIREMENTS 6. The proposed site modifications will be in compliance with the dimensional requirements. 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Vehicular access 8. Access is provided via multiple curb cuts on Community Drive. Circulation on the site will remain unchanged through the proposed project. Parking 10. Changes proposed involves adding five (5) handicapped parking spaces. All the new spaces will placed on existing paved surfaces involving new stripping. 11. Pursuant to Section 13.01(G) (5) of the Land Development Regulations, bicycle parking shall be provided on the subject property. Bicycle racks are shown on the plans but are not labeled. Landscaping 12. No changes. 13. Pursuant to Section 13.06(B) (7) of the Land Development Regulations, snow storage areas must be shown on the plan. The previously approved plans indicate the snow storage areas. Outdoor Lighting 14. There will be changes to outdoor lighting proposed. Applicant will be replacing old light fixtures with new light fixtures, which includes conduit, light bases and LED fixtures. 15. Pursuant to Section 13.07(B) (3) of the Land Development Regulations, poles shall be rustproof metal, cast iron, fiberglass, finished wood or similar structural material, with a decorative surface or finish. This requirement is being met. 16. Pursuant to Sections 13.07(B) (5) of the Land Development Regulations, poles shall not exceed thirty (30) feet in height, and shall utilize underground wiring. This criterion will continue to be met. 17. Pursuant to Section 13.07(B) (8) of the Land Development Regulations, if light poles are placed between parking rows in the interior of the lot, the poles should be located on the center line of double rows of parking stalls and not placed on the stall line between cars where fender damage might occur. This criterion will continue to be met. Traffic 18. Traffic will not be affected as a result of this application. (a) The relationship of the proposed development to goals and objects set forth in the City of South Burlington Comprehensive Plan, -2— FAUSERS\Planning & Zoning\Development Review Boa rd\Findings_Decisions\2014\SP_14_24_30 Community Drive_30 Community LLC doc #SP-14-24 19. The Comprehensive Plan states that the City should encourage development while protecting natural resources and promoting a healthy and safe environment. The proposed project is in keeping with the recommended actions of the Comprehensive Plan. (b) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas 20. This criterion will continue to be met. (c) Parking shall be located to the rear or sides of buildings 21. This criterion will continue to be met. 22. As noted above, bicycle rack locations are noted on the plans but not labeled. (d) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings, 23. No changes are proposed. (e) Newly installed utility service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. 24. This requirement is being met. (t) The combination of common materials and architectural characteristics, landscaping, buffers, screens, and visual interruptions to create attractive transitions between buildings or different architectural styles shall be encouraged. 25. This requirement is being met. (g) Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures 26. This requirement is being met. (h) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 27. Dumpsters are noted on the plan but not all indicate screened enclosures. -3- FAUSERS\Planning & Zoning\Development Review Board\Findings_Decisions\2014\SP_14_24_30 Community Drive_30 Community LLC doe #SP-14-24 DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site pan application #SP-14-24 of 30 Community Drive, LLC subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plans shall be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plans shall be submitted to the Administrative Officer prior to permit issuance. a. The site plan shall be revised to label all bike racks. b. The site plan shall be revised to indicate that all dumpsters on the property will be screened in on all four (4) sides. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
