FINDINGS OF FACT AND DECISION
Stonington Circle Homeowners Association, Inc., hereinafter referred to as the applicant, is seeking site
plan approval to amend a previously approved plan for a 47-unit multi-family development. The
amendment consists of replacing 11 trees in poor condition with replacements; 0 Stonington Circle.
Based on the plans and materials contained in the document file for this application, the Administrative
Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking site plan approval to amend a previously approved plan for a 47-unit
multi-family development. The amendment consists of replacing 11 trees in poor condition with
replacements; 0 Stonington Circle.
2. The owner of record of the subject property is Stonington Circle Homeowners Association, Inc.
3. The subject property is located in the Residential 12 Zoning District.
4. The complete application was received on August 1, 2022.
5. The plan submitted is titled, “Landscaping Plan – Stonington Circle O’Brien Home Farm Old Farm
Road South Burlington Vermont, Sheet L-4”, dated May 1, 2001, prepared by Krebs and Lansing
Consulting Engineers Inc., and last revised on June 28, 2022 by Michael Fallis, certified arborist,
Limbwalker Tree Service.
DIMENSIONAL REQUIREMENTS
6. No changes to coverages proposed.
7. Setback requirements are being met.

Landscaping
10. The applicant is proposing to replace a 11 trees which the arborist has identified as dead, dying,
or too close to buildings. Pursuant to LDR Section 13.04I, replacement of trees exceeding 5”
caliper shall require a site plan amendment.
11. Trees range in size and are proposed to be replaced in substantially the same locations with the
same genus except as recommended by the Arborist. The total value of trees to be replaced is
estimated at $8,810; the installed replacement cost is estimated to be $11,450. The
Administrative Officer finds this criterion met.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-
22-027 of Stonington Circle Homeowners Association, Inc., subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. This project shall be completed as shown on the plan and shall be on file in the South Burlington
Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit prior to the start of construction. Said permit must be
obtained, or extension shall be requested and approved within six months of the date of this
decision or this decision shall be null and void.
4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use or
occupancy of the site modifications.
5. Any change to the site plan shall require approval by the South Burlington Development Review
Board or the Administrative Officer.
