CITY COUNCIL 27 APRIL 1998 The South Burlington City Council held a regular meeting on Monday, 27 April 1998, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset Street. Members Present: James Condos, Acting Chair; Joan Britt, David Austin Also Present: Charles Hafter, City Manager; Peg Strait, Assistant City Manager; Albert Audette, Highway Dept; Anna Johnston, The Other Paper; Tom Moreau, Linda Kingsbury-Ring, John Guttler, Chittenden Solid Waste District; Peter Goldsmith 1. Comments & Questions from the Audience (not related to Agenda items): No issues were raised. 2. Announcements & City Manager's Report: Mr. Hafter announced the following: a. an invitation from Champlain Water District to celebrate their 25th year at an open house, May 2, 10 a.m. -2 p.m. b. opening ceremonies for South Burlington Youth Baseball, May 2, at noon c. the start of excavation for the expansion of the Bartlett Bay Sewage Treatment facility Mr. Audette reported on the following: a. repair work done at Overlook Park b. all neighborhoods cleaned up from ice storm debris; work now starting on schools and parks. The city will be reimbursed for overtime labor. Mr. Condos noted that yard waste can be taken to the Intervale and Patchen Rd. facilities free of charge. c. Shelburne Rd. work is progressing. Mr. Hafter also announced: a. a meeting of the Commuter Rail Steering Committee, 29 April, 9 a.m. b. a pre-construction meeting for the Main St. Project, 30 April, 9 a.m. 3. Presentation of FY '99 Chittenden Solid Waste District Budget; consideration of approval: Mr. Condos noted the District has come a long way. From a budget of $12,300,000 in FY '96, the District is now operating with a budget of $5,200,000 for FY '99. Ms. Kingsbury-Ring said they are looking for action on the budget by 9 May. "No action" will be viewed as a positive action. The District has a 17th member, Bolton. 64% of its revenues come from user fees, and there will be no member assessment. The transfer station is now privately operated. The District is focusing on education, compliance and enforcement. They are currently seeking a location for a limited service dropoff near the city of Burlington. The option on the Williston land has been extended, and the assumption is that the Supreme Court will confirm necessity. The District now has 26 FTE employees. Base pay for the three lowest grades was increased which will result in an $8,200 net impact on the budget (covers 6 FTE's). Legal fees have been anticipated at $182,000, a significant reduction from the $454,000 in FY'96. Mr. Hafter said the city appreciates the way the District has worked to protect communities with regard to the sludge problem and bio-solids plant. Mr. Audette asked the status of the suit by Hinesburg Sand & Gravel. Mr. Moreau said it is still sitting in Federal Court, and he felt they will wait until there is a decision on the appeal. Following a brief discussion, Mr. Austin moved to approve the FY'99 budget of Chittenden Solid Waste District. Ms. Britt seconded. Motion passed unanimously. 4. Public Hearing/informational meeting related to items on the 5/19/98 ballot: a. Second public hearing on Charter amendment to change the tax due dates: Mr. Hafter explained that this amendment is necessitated by Act 60 under which the 15 July tax due date was no longer workable. The new language allows the City Council to set due dates for taxes each year. No issues were raised by the public or Council. Mr. Austin moved to close the public hearing. Ms. Britt seconded. Motion passed unanimously. b. Informational meeting on bond for Queen City Park Fire protection water main installation: Mr. Hafter explained that Queen City Park maintains its own water system, but the system is not adequate for fire protection. A new system is to be installed. City residents will be responsible for $90,000 of the cost, and Queen City Park residents will be responsible for an equal amount. All revenues will be collected by the Water District, and there will be no impact on the tax rate. There will also be no increase in water rates since other bonds are being paid down this year. 5. Consideration of Procedure for Street/Sidewalk Obstruction Encumbrance Application Process: Mr. Hafter said they are trying to keep the process simple. There will be a $25 application fee. The application will be reviewed by the Public Works Dept. and then the City Council which will have the authority to issue a permit. The city must be named as additional insured. Mr. Austin was concerned that $100,000 insurance was too low and suggested discussing this with the City Attorney. Members also felt that if there is additional seating being requested that the application should go through site plan review. It was suggested that the permit should be for one year. 6. First Reading of an Amendment to Motor Vehicle Ordinance establishing a No Parking Zone on Swift Street Extension and a No Parking Zone on Hayes Avenue: Ms. Britt felt the ordinance should cover the full Swift St. Extension. She asked if there is adequate parking in the park so that people won't feel they have no alternative than to park on the street. Mr. Audette said they have added 3 new parking locations in the park and he felt this was adequate. Members suggested asking area businesses about the parking situation on Lafayette Rd. Mr. Condos felt the area needs to striped visibly and cars that then violate this should be towed. Members agreed to strike the words "to the end of Swift Street Extension" from the proposed wording. Mr. Austin moved to waive the reading of the proposed amendment and approve the first reading with the amendment to the wording as proposed, and to set a public hearing on 2 June 1998. Ms. Britt seconded. Motion passed unanimously. 7. Consideration of Special Event Permit for South Burlington Youth Baseball Opening Day, 5/2/98, Dorset Park, d.j., Noon-5 p.m.: Mr. Hafter said the event will include food, prizes, a high school baseball game, and a parade. Traffic control has been reviewed and approved. Mr. Austin moved to approve the Special Event Permit for South Burlington Youth Baseball Opening Day as presented. Ms. Britt seconded. Motion passed unanimously. 8. Consideration of Approval of Entertainment License for Breakers Billiards, 2069 Williston Rd., d.j. and live bands: Mr. Hafter said the establishment will have weekly local and state tournaments and occasional live bands. They are trying to run a smoke-free environment. Ms. Britt moved to approve the entertainment license for Breakers Billiards as presented. Mr. Austin seconded. Motion passed unanimously. 9. Review Zoning Notice for Public Hearing on 11 May 1998: Mr. Austin questioned Item #6 and asked how the Zoning Board can change a district boundary. Mr. Hafter felt that they can't. Mr. Condos felt that Item #4 involved a "use variance" which is not legal. Mr. Hafter will check on both of these. 10. Review Planning Commission Agenda for 28 April 1998: No issues were raised. 11. Review Minutes of 6 April and 18 April: Ms. Britt moved to approve the Minutes of 6 April with a typo correction. Mr. Austin seconded. Motion passed unanimously. Liquor Control Board: Ms. Britt moved the Council adjourn and reconvene as Liquor Control Board. Mr. Austin seconded. Motion passed unanimously. a.
