HomeMy WebLinkAboutSP-22-035 - Decision - 0899 Dorset Street - SP-22-035_899 Dorset Street Methodost Gazebo_FFD_ADMIN#SP-22-035 - 1 – CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING 899 DORSET STREET – David Leblanc, Next Generation VT SITE PLAN APPLICATION #SP-22-035 FINDINGS OF FACT AND DECISION The David LeBlanc of Next Generation VT, hereinafter referred to as the applicant is seeking to amend a previously approved site plan for a 15,750 sq. ft. place of worship with child care and indoor recreation as accessory uses. The amendment consists of constructing a 24’x24’ post and beam gazebo, 899 Dorset Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved site plan for a 15,750 sq. ft. place of worship with child care and indoor recreation as accessory uses. The amendment consists of constructing a 24’x24’ post and beam gazebo, 899 Dorset Street. 2. The owner of record of the subject property is the Faith Methodist Church of SB, LLC. 3. The subject property is located in the Residential 2 Zoning District. 4. The application was received on July 20, 2022. 5. The plans submitted consist of one (1) page set of plans: • “Faith United Methodist Church Proposed Addition Site Plan”, Sheet 1, dated 11-2-99 prepared by Civil Engineering Associates and with markups indicating proposed additions prepared by Camiryn Belen on behalf of Next Generation dated 7/20/2022. The detached accessory structure (open sided gazebo) will be located at least 5’ from all property lines. The Administrative Officer finds this criterion met. SITE PLAN REVIEW STANDARDS Only those aspects of the site plan which are proposed to be modified are identified and review of compliance. 13.03 Bicycle Parking. A bicycle rack is shown on the plan. Pursuant to Section 13.14 of the Land Development Regulations, bicycle parking shall be provided on the subject property. A building of this size, 15,750 sq. ft.., is required to have a total of four (4) bicycle parking spaces (bps) per Table 10. An approved type inverted “U” rack can accommodate two (2) bikes. Under this amendment, the applicant will be required to provide 50% of their total short-term bicycle parking spaces (bps) requirement per Section 13.14(1)(a)(ii). The Administrative Officer finds that the applicant must install an approved type bicycle rack that meets the standards of Section 13.14 at the location where one is indicated on the plan. This will fulfill the 50% minimum of two bicycle parking spaces for this application. 13.04 Snow Storage. Snow storage areas have been indicated on the plan. 13.07 Exterior Lighting. All lighting fixtures shall be downcast and shielded. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-22-035 subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Administrative Officer concurrently issues Zoning Permit #ZP-22-295. 3. The bicycle rack shall include a minimum of two parking spaces and meeting the installation requirements of Appendix G of the Land Development Regulations. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the gazebo. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the gazebo. 6. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 7. All new fencing must be installed on the subject property and no pointed metal tops are permitted. #SP-22-035 - 3 – 8. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan must meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. 9. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations.
