HomeMy WebLinkAboutSP-22-036 - Decision - 1855 Williston Road - SP-22-036_1855 Williston Road_TD Bank_ffd admin#SP-22-036 - 1 - CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING O’BRIEN BROTHERS, LLC – 1855 WILLISTON ROAD SITE PLAN APPLICATION #SP-22-036 FINDINGS OF FACT AND DECISION TD Bank hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for an 8,786 sq. ft. general office building with a drive-through bank. The amendment consists of landscaping modifications, 1855 Williston Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for an 8,786 sq. ft. general office building with a drive-through bank. The amendment consists of landscaping modifications, 1855 Williston Road. 2. The owner of record of the subject property is O’Brien Brothers, LLC. 3. The subject property is located in the Commercial 1 – Residential 12 Zoning District. 4. The application was received on April 27, 2022. 5. The plan submitted is titled, “TD Bank 1855 Williston Road South Burlington , VT Revised Landscaping Plan”, prepared by O’Leary-Burke Civil Associates, PLC dated 12/9/2021, and last revised on 3/30/22. DIMENSIONAL REQUIREMENTS 6. No changes to coverages proposed. Building coverage is 5.3% (maximum allowed is 40%). Overall coverage is 31.8% (maximum allowed is 70%). Front yard coverage is 16.8% (maximum allowed is 30%). 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Vehicular access 8. Access is provided via curb cuts off Williston Road and Kennedy Drive. No changes are proposed. Circulation 9. Circulation on the site is adequate. #SP-22-036 - 2 - Parking 10. Parking is located on the front and rear of the building, no additional parking spaces are proposed. 11. Pursuant to Section 13.01(G) (5) of the Land Development Regulations, bicycle parking shall be provided on the subject property. A bicycle rack is shown on the plan. This criterion is being met. Landscaping 12. The applicant is proposing to replace a 3” Japanese lilac with two 2.5” Japanese lilac elsewhere on the property. The Administrative Officer finds this meets the requirements of Section 13.04I. Landscaping on the north side of the building is also modified. 13. Pursuant to Section 13.06(B) (7) of the Land Development Regulations, snow storage areas must be shown on the plan. The plan does indicate the snow storage area(s). Outdoor Lighting 14. Pursuant to Section 13.07(A) of the Land Development Regulations, all exterior lighting for all uses in all districts except for one-family and two-family uses shall be of such a type and location and shall have such shielding as will direct the light downward and will prevent the source of light from being visible from any adjacent residential property or street. Any new lighting fixtures must meet this requirement. Pursuant to Sections 14.06 and 14.07 of the Land Development Regulations, the following review standards shall apply to site plan applications: (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). 15. No dumpster storage areas proposed. This criterion is being met. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP- 22-036 of TD Bank, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. #SP-22-036 - 3 - 3. All exterior lighting shall consist of downcasting, shielded fixtures. Prior to the issuance of a zoning permit, the applicant shall provide the Administrative Officer cut-sheets of any new exterior light fixtures. 4. This decision is issued concurrently with Zoning Permit #ZP-22-297. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the site modifications. 6. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
