FINDINGS OF FACT AND DECISION
The City of Burlington, Burlington International Airport, hereinafter referred to as the applicant,
is seeking to amend a previously approved plan for a 65,150 sf aircraft maintenance hangar. The
amendment consists of expanding the existing concrete pad by 12’x 57’ (684 sf) and a depth of 1
foot to place one additional fuel tank on top, 228 Aviation Avenue.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a 65,150 sf
aircraft maintenance hangar. The amendment consists of expanding the existing concrete
pad by 12’x57’ (684 sf) and a depth of 1 foot to place one additional fuel tank on top, 228
Aviation Avenue.
2. The owner of record of the subject property is the City of Burlington.
3. The subject property is located in the Airport Industrial Zoning District.
4. A complete application was received on May 27, 2022.
5. The plan submitted is titled “Fuel Tank Expansion Plan”, prepared by Stantec, dated
04/05/2022.

SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will continue to be
met.
Short-term Bicycle Parking
6. Pursuant to Section 13.03(B) of the LDRs, the applicant must provide short-term bicycle
parking spaces. The applicant has not provided bicycle racks. The minimum requirement for
bicycle parking is as follows.

The administrative officer finds that the plans must be revised to include two total short-
term bicycle spaces in the form and location acceptable per the Land Development
Regulations.
Snow Storage
7. Per Section 13.04(B)(7), “snow storage areas must be specified and located in an area that
minimizes the potential for erosion and contaminated runoff into any adjacent or nearby
surface water.” Snow Storage areas are not noted on the plan. The administrative officer
finds that prior to issuance of the zoning permit, the plans shall be revised to show the
location of the snow storage area(s).
Waste Disposal
8. Per Section 14.07(I), “All dumpsters and other facilities to handle solid waste, including
compliance with any recycling, composting, or other requirements, shall be accessible, secure
and properly screened with opaque fencing to ensure that trash and debris do not escape the
enclosure(s). Small receptacles intended for use by households or the public (ie, non-dumpster,
non-large drum) shall not be required to be fenced or screened.” The plan submitted does
not show the location of the screened dumpster area. The Administrative Officer finds that
the plan should be revised to show the location of the screened dumpster area(s).
Fences
9. The applicant is proposing to expand the fence enclosing the existing fuel tank farm to
include the area of new concrete pad. The proposed fence will be an extension of the
existing fence which is chain link with barbed wire on top. The fence is exempt from local
regulation under 24 V.S.A. § 4413.
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site plan
application #SP-22-026 of the City of Burlington, subject to the following conditions:

1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. This project shall be completed as shown on the plan and on file in the South Burlington
Department of Planning and Zoning as amended herein.
3. The applicant must obtain a zoning permit within six (6) months from the date of this
decision or this approval expires and is null and void. The applicant may submit a request
for an extension to obtain a zoning permit under the terms outlined in Section 17.04 of the
LDR’s, but the request must be submitted prior to the expiration of this approval. Prior to
issuance of the zoning permit, the plans must be revised to show the changes below. A
digital PDF version of the approved final plans must be delivered to the Administrative
Officer before issuance of a zoning permit.

4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to
use of the modified tank pad.
5. All exterior lighting must be installed or shielded in such a manner as to conceal light
sources and reflector surfaces from view beyond the perimeter of the area to be
illuminated.
6. Fences shall be maintained in a safe and substantial condition.
7. The proposed project must adhere to standards for erosion control as set forth in Section
16.03 of the South Burlington Land Development Regulations. In addition, the grading plan
must meet the standards set forth in Section 16.04 of the South Burlington Land
Development Regulations.
8. Any change to the site plan shall require approval by the South Burlington Administrative
Officer or the Development Review Board, as allowed under the Land Development
Regulations.

a Notice of Appeal with the secretary of the Development Review Board. This Notice of Appeal
must be accompanied with a $233 filing fee and be filed within 15 days of the date of this
decision.
