CITY COUNCIL 17 October 1994 The South Burlington City Council held a regular meeting on Monday, 17 October 1994, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset St. Members Present: William Cimonetti, Chairman; Robert Chittenden, David Maclaughlin Also Present: Charles Hafter, City Manager; Peg Strait, Asst. City Manager; Margaret Picard, City Clerk/Treasurer; Wally Possich, Fire Chief; Maja Smith, Toby Dion 1. Comments & Questions from the Audience (not related to agenda items): No issues were raised. 2. Announcements & City Manager's Report: a. Mr. Hafter advised that he had appeared before the Burlington Planning Comm. for approval of a small piece of the bike path that goes through Burlington. b) On October 19, there will be an open house at UVM's Waterman building relating to Phase II of the light rail study. c) The MPO meeting of 10/19 has been postponed. d) The Agency of Transportation is holding a public hearing on transportation issues from 4-5:30 and 5:30 - 7:00 on 25 October on interactive TV. e) On 10/27, at Contois Auditorium in Burlington, there will be a meeting regarding new enforcement of ordinances. f) Road work on both Laurel Hill Drive and Queen City Park is done. All other work will be done this week. Only one project on the list was not done, and that will be done when the new light is received for Williston Rd/Kennedy Dr. intersection. g) The Recreation Dept. has put in a new carpet at the O'Brien Center. h) Benches have been ordered for the Dorset St. Park playground which is getting a great deal of use. i) Gardens at the park have to be cleaned up by 30 October. j) The Kids and Kops program activities are getting underway. k) Residents are being warned to take care as there have been thefts from parked cars. 1) Ms. Picard reported there have been 800 voters registered since September. The last day to register is 10/22. The City Clerk's Office will stay open on 5 November (Saturday) for people who wish to vote as absentees. m) The Board of Civil Authority will meet on 10/24 to hear the reports from the two inspection committees. n) Chief Possich reported that the new doors are in and will be fully installed by tomorrow. The Open House went very well. About 2500 people attended. Many people commented favorably on the increased presence of the Department in the community. Sasha Lascala, coordinator of the Open House, said that 75% of the department's personnel assisted in the effort. 3. Acceptance & Signing of Resolution of Commendation for the South Burlington Fire Department: Mr. Maclaughlin read the Resolution. Mr. Chittenden moved the Resolution be approved and signed. Mr. Maclaughlin seconded. Motion passed unanimously. 4. Interview with Maja Smith for appointment to the Recreation Path Committee: Ms. Smith said she has a personal interest in the path as she uses and enjoys it. She is a recreation planner for the State, specifically working on Lake Champlain issues. She has been working on a bikeway system around the lake. Ms. Smith noted the South Burlington Rec Path is considered a model by other communities. The path offers the community a quality of life. Mr. Chittenden asked if Ms. Smith would be comfortable having a requirement that all people ride on the path. Ms. Smith said people may need to be educated about the path. Mr. Cimonetti noted the toughest phase is coming now. Phase IV is federally funded through the AOT, and it has taken three times longer to get started. 5. Public Hearing: Ordinance to Amend the South Burlington Motor Vehicle and Traffic Regulations to Prohibit Parking on a portion of Cedar Glen Drive and Stone Hedge Drive, second reading of same: Mr. Cimonetti read the specifics of the amendment. Mr. Hafter said the amendment came about because of an action of the Stonehedge Association. The City also supports this as it has been difficult to get emergency vehicles into these areas. Mr. Maclaughlin moved to adopt the amendment as presented. Mr. Chittenden seconded. Motion passed unanimously. 6. First Reading of an Amendment to the Zoning Regulations in Central District to add "Educational Facilities" and "Indoor Recreation" as permitted uses in CD 1 and CD 2 zones. Schedule Public Hearing: Mr. Hafter noted the Planning Commission has reviewed this and forwarded its recommendation for adoption. The second hearing would be scheduled for 11/7. Mr. Maclaughlin moved to approve the first reading of the amendment to the Zoning Regulations as presented and to schedule a second reading and public hearing on 7 November. Mr. Chittenden seconded. Motion passed unanimously. 7. Review and Discuss "Chittenden County Travels" videotape: The videotape was shown and elicited the following comments: Mr. Chittenden felt South Burlington is dealing with problems on the local level. He felt the city has supported CCTA quite well over the years. Mr. Maclaughlin agreed. He also felt the city gets a great deal of public input and the South Burlington voters have taken a lead in the county. Mr. Cimonetti said it is sad but true that State transportation planners can say how much planning has to take place. He felt there could be more work and less planning. He did not buy the theory that when you improve a road it will make more traffic, so you shouldn't fix roads. 8. Consideration of Approval of Refunding Note for Sidewalk Plow: Mr. Cimonetti advised that the note is for one year at 4.55%, and is the second of a 4-year note. The note is now at $24,000. Mr. Chittenden moved to approve the refunding note and accompanying resolution. Mr. Maclaughlin seconded. Motion passed unanimously. 9. Review Zoning Board notice of 10/24 and Planning Commission Agenda of 10/18: No issues were raised. 10. Approval of Minutes of 10/3: There was a clarification that Mr. Hafter is not a specifically an official liaison with the skating facility committee. Mr. Chittenden moved to approve the Minutes of 10/3. Mr. Maclaughlin seconded. Motion passed unanimously. 11. Sign Disbursement Orders: Disbursement Orders were signed. Executive Session: Mr. Chittenden moved that the Council adjourn and reconvene in Executive Session to discuss appointments to Boards and Committees and to resume regular session only to make such appointments and/or adjourn. Mr. Maclaughlin seconded. Motion passed unanimously. Regular Session: The Council reconvened in regular session. Bob Chittenden moved the appointment of Maja Smith to the Recreation Path Committee for a three (3) year term. Dave MacLaughlin seconded. The motion passed unanimously.
