HomeMy WebLinkAboutSP-22-030 - Decision - 1475 Shelburne Road#SP-22-030 - 1 - CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING REPERIO PROPERTIES, LLC – 1475 SHELBURNE ROAD SITE PLAN APPLICATION #SP-22-030 FINDINGS OF FACT AND DECISION Reperio Properties, LLC, hereinafter referred to as the applicant, is seeking to amend a previously approved plan for a 9,100 sf building approved as a 60-student child care facility, licensed non-residential use. The amendment consists of: 1) parking lot modifications to connect to the approved parking lot at 1459 Shelburne Road 2) fence modifications and 3) Stormwater improvements, 1475 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a 9,100 sf building approved as a 60-student child care facility, licensed non-residential use. The amendment consists of: 1) parking lot modifications to connect to the approved parking lot at 1459 Shelburne Road 2) fence modifications and 3) Stormwater improvements, 1475 Shelburne Road. 2. The owner of record of the subject property is Reperio Properties, LLC. 3. The subject property is located in the Commercial 2 (C2) zoning district and in the Transit Overlay District. 4. A complete application was received on June 17, 2022. 5. The submitted plans consist of the following. Front Yard Coverage 30% No change  Zoning Compliance SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Parking 6. 14.06A(2) requires parking to be located to the side or rear. The administrative officer finds this criterion met. Access and Circulation 7. 15.A.14(E) pertains to access and circulation and requires safe access to abutting properties, minimization of curb cuts, and shared vehicular access to the extent feasible. The project consolidates access to 1459 and 1475 Shelburne Road into a singular vehicular loop. The administrative officer finds this criterion met. Short-term Bicycle Parking 8. Pursuant to Section 13.03(B) of the LDRs, the applicant must provide short-term bicycle parking spaces. The applicant has provided six bicycle racks, providing parking for twelve bicycles, split between the site and the adjoining site containing the associated childcare to the north (1459 Shelburne Road). The minimum requirement for bicycle parking is as follows. Per Section 13.04(B)(7), “snow storage areas must be specified and located in an area that minimizes the potential for erosion and contaminated runoff into any adjacent or nearby surface water.” Snow Storage areas are noted on the plan. The administrative officer finds this criterion met. Landscaping 10. Section 13.04B pertains to landscaping of parking areas. All off-street parking areas are required to be landscaped around the perimeter of the lot with trees, shrubs, and other plants. In all parking areas containing twenty-eight (28) or more contiguous parking spaces, at least ten percent (10%) of the interior of the parking lot shall be landscaped with trees, shrubs, and other plants. All interior and perimeter planting must be protected by curbing unless specifically designated as a collection and treatment areas. Planted islands must have a minimum dimension of six (6) feet on any one side and must have a minimum square footage of sixty (60) square feet. Site plan approval #SP-22-006 found that the parking areas of 1459 Shelburne Road and 1475 Shelburne Road shall be aggregated for the purposes of compliance with this criterion. The applicant has provided a sketch entitled “Sketch for Parking Calculations,” dated 4/7/2022, demonstrating this criterion is met. #SP-22-030 - 3 - Traffic 11. There is no proposed change in use and no proposed change in previously-approved trip generation. Stormwater Management 12. The City Stormwater Section indicated there were no comments on the proposed design, which was approved as part of SP-22-006, on 3/24/2022. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-21-009 of Hebron Group, LLC, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The Administrative Officer issued Zoning Permit #ZP-22-249 concurrently with this approval. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the modified parking area and playground. 5. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan must meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. 6. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations.
