HomeMy WebLinkAboutSP-22-017 - Decision - 1200 Airport Drive#SP-22-017 1 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CITY OF BURLINGTON/BURLINGTON INTERNATIONAL AIRPORT—1200 AIRPORT DRIVE SITE PLAN APPLICATION #SP-22-017 FINDINGS OF FACT AND DECISION City of Burlington/Burlington International Airport, hereinafter referred to as the applicant, is seeking to amend a previously approved plan for an airport complex. The amendment consists of: 1) the addition of approximately 317 linear feet of ornamental fencing along the property line between Heritage Aviation and Eldridge Cemetery, and 2) the addition of landscaping along the same area, 1200 Airport Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved plan for an airport complex. The amendment consists of: 1) the addition of approximately 317 linear feet of ornamental fencing along the property line between Heritage Aviation and Eldridge Cemetery, and 2) the addition of landscaping along the same area, 1200 Airport Drive. 2. Specifically, these amendments are connected to an effort to establish a cohesive campus from a specific approved site plan for the overall landscape plan (#MS-20-01), issued by the Development Review Board on June 6, 2020. 3. The owner of record of the subject property is City of Burlington/Burlington International Airport. 4. The application was received on February 15, 2022. 5. The property lies within the Airport Industrial Zoning District. 6. All other standards will continue to be met. 13.04 Landscaping, Screening & Street Trees Pursuant to Section 13.04 A of the Land Development Regulations, landscaping and screening shall be required for all uses subject to site plan and planned unit development review. The proposed landscape elements were part of Miscellaneous approval #MS-20-01 which estimated the cost for all improvements to be $1,347,500. The proposed improvements under this project are estimated to cost $64,230 and they are consistent with the elements that were previously approved. The Administrative Officer finds this criterion met. 13.11 Fencing Pursuant to Section 13.11 B(1) of the Land Development Regulations, all fences shall be erected within the boundaries of the applicant’s property and shall be placed wholly within but not on the property boundaries. The proposed plan shows the fence to be aligned upon the property boundary line. The Administrative Officer finds that the applicant must revise the plans to locate the fence within the property boundaries as required in the regulations. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-22-017 of City of Burlington/Burlington International Airport, subject to the following conditions: 1. All previous approvals and stipulations which are not changed by this decision, will remain in full effect. 2. This project must be completed as shown on the plans submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months from the date of this decision or this approval expires and is null and void. Prior to issuance of zoning permit, the plans must be revised to locate the fence within the property boundaries as required in the regulations #SP-22-017 3 4. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. 5. This project will account for $64,230 towards the overall Airport Landscape Master Plan budget. 6. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of any structure or building. 7. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations Signed this _13_ day of __June___ 2022, by _____________________________________ Dalila Hall, Administrative Officer PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by filing a Notice of Appeal with the secretary of the Development Review Board. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
