HomeMy WebLinkAboutMinutes - City Council - 04/19/1993CITY COUNCIL 19 APRIL 1993 The South Burlington City Council held a meeting on Monday, 17 April 1993, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset St. Members Present: Michael Flaherty, Chairman; James Condos, William Cimonetti, Robert Chittenden Also Present: Charles Hafter, City Manager; Sid Poger, The Other Paper; Peg Strait, Assistant City Manager; Brian Searles, Police Chief; James W. Goddette, Sr., Fire Chief; Dick Ward, Zoning Administrator; Sandy Greiner, Free Press; G. Lane Maxfield 1. Comments & Questions from the Audience (not related to Agenda Items): No issues were raised. 2. Public hearing on Security Alarm Ordinance; Second Reading of Same: Mr. Flaherty noted that changes suggested at the last reading had been made. Chief Searles advised that last year there were over 1,000 false alarms from security systems. Mr. Cimonetti asked how many places have alarm systems. Mr. Ward said last year they licensed 197, but there are many that don't have licenses. Chief Searles said they need disclosure on alarm systems. Mr. Cimonetti asked if there had been any comments from alarm system users or third party monitors. Mr. Hafter said there had not. Mr. Cimonetti felt the Ordinance should be gotten to the monitoring companies to see if they have any comments. Chief Searles said some companies are aware of it, and he had no problem getting it to them. Mr. Cimonetti moved to continue the public hearing and instruct the City Manager and Police Chief to solicit comments on the proposed ordinance from security alarm system users and monitoring companies. Mr. Condos seconded. Motion passed unanimously. 3. Consideration of Approval of Application for Engineering Planning Advance, State of Vermont, Bartlett Bay Final Design: Mr. Condos moved to approve the application as presented. Mr. Cimonetti seconded. Mr. Chittenden asked why it hadn't been put to bid. Mr. Cimonetti explained that it has been treated as an extension to the existing contract. There is still an urgency to get to the top of the list with the State as these will be add-ons to state funding if there are additional federal funds available. Mr. Condos noted that this could save the city over $180,000 a year for 20 years. In the vote that followed, the motion passed unanimously. 4. Consideration of Training Stipend for Call-Men in Fire Department: Mr. Flaherty noted that Department regulars are being paid for training and the call-men felt this was unfair. Mr. Hafter said he had spoken with Mr. Ward regarding the budget, and the proposal is that the city provide a stipend of $200 a year, provided the call men take a minimum of 4 hours training per month per quarter. This would cost the city $6,000 for the year. Mr. Chittenden said he felt the Fire Department contract was bad and is causing this problem. Mr. Cimonetti asked about a trade-off on the equipment budget and what impact this will have. Mr. Hafter said the city needs 25% of the funds for the new pumper. There is some excess for this in the budget for this year and the rest can be made up next year. Mr. Cimonetti moved to approve the proposal as presented. Mr. Condos seconded. Motion passed unanimously. Mr. Condos complimented the work of the Fire Department, both the regulars and call-men. 5. Items for Information: Mr. Hafter noted that the Route 7 Advisory Committee will need to appoint a citizen from the residential neighborhood and a business representative. He suggested doing this at the next meeting. 6. Minutes of 5 April 1993: Mr. Condos moved to approve the Minutes of 5 April 1993 as presented. Mr. Chittenden seconded. Motion passed unanimously. 7. Sign Disbursement Orders: Disbursement Orders were signed. 8. Other Business: Mr. Cimonetti suggested that the name of Dorset St. be changed to Dorset Boulevard as the new look is a classic boulevard design. He said there is time to order signs, etc, but the decision should be made soon. Mr. Cimonetti then moved to rename Dorset Street between Kennedy Drive and Williston Road Dorset Boulevard. Mr. Condos seconded. Motion passed unanimously. 9. Tobacco licenses: Mr. Hafter noted the city has to give tobacco licenses. Fees go to the state. He then presented the list of renewals. Mr. Chittenden moved to accept the list of tobacco license applications presented by the City Manager and attached hereto. Mr. Condos seconded. Motion passed unanimously. 10. Liquor Control Board: Mr. Chittenden moved the Council adjourn and reconvene as Liquor Control Board. Mr. Condos seconded. Motion passed unanimously. Mr. Hafter presented a list of liquor license renewals. Members agreed to consider the Bambino's renewal separately. Mr. Condos then moved to approve all the liquor license renewals as presented by the City Manager and attached hereto, with the exception of the Bambino's license renewal. Mr. Chittenden seconded. Motion passed unanimously. Mr. Cimonetti asked for a status report on problems occurring at establishments other than Bambino's. Mr. Flaherty then drew attention to a memo from the Police Chief regarding problems at Bambino's. Mr. Kunin said there were only occasional noise problems during the winter but there were problems this weekend with a thumping bass that could be heard in the neighborhood. He said he had heard there are new speakers with a heavy bass. He gave the Board copies of a letter from another neighbor. Neighbors feel the conditions on Bambino's license should remain in place. Mr. Brown noted there had been a substitute DJ at Bambino's this weekend. Mr. Cimonetti said the noise has to be controlled no matter who is the DJ. That is the condition of the permit. If the condition is broken, the permit will be revoked. Mr. Condos said he is encouraged by the improvement in the situation. Chief Searles said that noise is the only continuing problem. Mr. Chittenden then moved to renew Bambino's liquor license with the existing stipulations. Mr. Cimonetti seconded. Motion passed unanimously.
