DECISION AND FINDING OF FACT
On the 23rd day of September, 1996 the South Burlington Zoning
Board of Adjustment heard testimony regarding a conditional use
application of Kenneth Smith, 49 Commerce Avenue.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question is zoned I-C District.
2) Section 15.20 Conditional Uses and Section 26.65 Multiple uses
requires approval by the ZBA, Section 26.05 applies.
3) The applicant is proposing to occupy a 1001x 2501 (25,000
square feet) structure with a 10,000 square foot mezzanine
with a series of conditional and permitted Uses.
4) Type of uses proposed are automotive repair and rental, taxi
companies, rental equipment, contractors, general/medical
offices, printing/publishing and indoor/outdoor recreational
uses.
5) The applicant merged two (2) lots for a total lot size of 2.5
acres.
Conclusion
1) original approval granted a maximum of ten (10) tenants, all
permitted uses.
2) The applicant has interest in automotive related uses to
include sales of specialty parts.
3) Present tenants include light manufacturing, contractors and
storage/distribution. Applicant has approximately 25,000
square feet of builidng leased.
4) The proposed uses should not generate more than 30 vehicle
trip ends during the P.M. peak hour.

5) Municipal facilities are available to this location and
allocation is not a problem.
Based upon the findings and conclusion set -forth above, the Zoning
Board of Adjustment hereby grants the applicants request to occupy
the proposed structure located at 49 Commerce Avenue with multiple
conditional and permitted uses.
Subject to a stipulation that the applicant obtain Administrative
Officer approval prior to occupancy.
