Construction Staging/Tree Protection a. During construction, access from Valley Road must be kept clear. b. All staging will occur within the project limits. c. All efforts must be made to avoid reducing grade within the tree protection zone. If grade reduction within the tree protection zone is deemed necessary, excavation must be kept to a minimum and be performed with air excavation tools such as an Air Spade or Air Knife following all best practices for tree health/maintenance. d. If the Permittee fails to enforce tree protection measures, the Permittee shall replace damaged/lost tree(s) with a 4" caliper substitute. They may also be subject to additional enforcement actions by the Administrative Officer. 2. Field Changes & As Built Plans. Per Section 14.05(H) of the Land Development Regulations: (1) Field Changes (a) During construction, the Administrative Officer may authorize or require, in writing, at his/her own determination or upon the request of the applicant, minor adjustments to a site plan which does not affect the substance of the site plan approval. Such minor adjustments shall be consistent with the intent of the approved site plan. All determinations of eligibility for field changes are subject to the discretion of the Administrative Officer. (b) Where conditions are encountered which constitute a material change to an approved site plan or where the developer otherwise wishes to modify the approved site plan, an amendment to the approval shall be filed with the Development Review Board or Administrative Officer for review in accordance with procedures required for such applications. 2 (2) As-Built Plans (a) Upon completion of any development or redevelopment pursuant to an approved final site plan involving field changes as set forth in (1) above, and prior to the issuance of a certificate of occupancy by the Administrative Officer, the applicant shall submit to the Administrative Officer as-built plans in paper and digital form, prepared and certified by a licensed engineer, architect, landscape architect or surveyor, showing the location of all site improvements as constructed. (b) Said as-built plan shall be reviewed by the Administrative Officer to determine if it is in compliance with the approved site plan, including any field changes authorized under subsection 1(a) above. The Administrative Officer shall indicate compliance with the Land Development Regulations by signature, and shall file with the Department of Planning and Zoning. 3. Performance Standards. If construction entails blasting/pile work or any other noise/hazard inducing work, the permit holder may be required to provide the Administrative Officer with the following information as outlined in Section 3.16(E) of the Land Development Regulations. Evidence of application for state and/or federal permits for the handling of potentially hazardous conditions, and/or the following information, at minimum, may be required for determination of compliance with performance standards or for conditional use review of potentially hazardous conditions: a) Description of proposed machinery, operations, and products. b) Amount and nature of materials to be used. c) Mechanisms and techniques to be used in restricting the emission of any hazardous and objectionable elements, as well as projected or actual emission levels. d) Method of delivery and disposal or recycling of any hazardous elements. e) Other information as may be necessary. 4. In addition to the specific standards listed above, all other performance standards listed in the Land Development Regulations remain in effect. 5. The City’s Public Nuisance Ordinance is also applicable.
