HomeMy WebLinkAboutSP-17-27 - Decision - 0049 Commerce Avenue#SP-17-27 I FA CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING KPS 49 PROPERTIES, LLC — 49 COMMERCE AVENUE SITE PLAN APPLICATION #SP-17-27 FINDINGS OF FACT AND DECISION KPS 49 Properties, LLC, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 35,000 sq. ft. multi -use building. The amendment consists of creating a covered outside storage area of approximately 37'X 37'1 49 Commerce Avenue. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a 35,000 sq. ft. multi -use building. The amendment consists of creating covered outside storage of approximately 37'X 37'1 49 Commerce Avenue. 2. The owner of record of the subject property is KPS 49 Properties, LLC. 3. The subject property is located in the Mixed Industrial - Commercial Zoning District. 4. The application was received on April 25, 2017. 5. The plan submitted is entitled, "K.P. Smith Lots 25-26 Commerce Avenue, South Burlington, VT". prepared Lamoureux & Dickinson Consulting Engineers Inc., dated 12/14/15, and last revised on 4/24/17. DIMENSIONAL REQUIREMENTS 6. Building coverage is 18.8% (maximum allowed is 40%). Overall coverage is 67% (maximum allowed is 70%). Front yard coverage along is not changing (maximum allowed is 30%). No changes proposed to existing coverages. 7. The new accessory structure will meet the side and rear setback requirements. SITTE PLAN REVIEW STANDARDS Only the standards below will are affected by this application. All other standards will continue to be met. Parking - 1 — #SP-17-27 8. Pursuant to Section 13.01(G) (5) of the Land Development Regulations, bicycle parking shall be provided on the subject property. A bicycle rack is not shown on the plan. The plan should be revised to show a bike rack. OUTSIDE STORAGE 9. The applicant is proposing to designate a covered outdoor storage area of approximately 37X 37which would be placed on existing paved surface towards the rear of the property. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-17-27 of KPS 49 Properties, LLC, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plans must be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plans must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to show a bike rack 4. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 6. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy or use of the outdoor storage area. 7. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
