FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Site plan application #SP-02-32 of Pizzagalli Properties to construct a 30,000 square
foot general office building on a 4.52 acre lot.
On the 16'h of July 2002, the South Burlington Development Review Board approved the
request of Pizzagalli Properties seeking site plan approval under Section 26.10 of the
South Burlington Zoning Regulations based on the following findings:
1) This project consists of constructing a 30,000 square foot general office building on a
4.52 acre lot.
2) The owner of record is Pizzagalli Properties Inc.
3) This property at 62 Tilley Drive lies within the Mixed Industrial Commercial, Traffic
Overlay Zone 5, and Conservation Open Space District. It is bounded on the north by a
residential lot (Tilley Farm), on the east by agricultural land, on the west by Hinesburg
Road, and on the south by I-89.
4) Lot coverage/Setbacks: Building coverage is proposed at 7.6% (maximum allowed is
30%). Overall coverage is 33.4% (maximum allowed is 70%). The front yard coverage
is 14.9% (maximum allowed is 30%). It was unclear to staff whether this was for
Hinesburg Road or Tilley Drive. Front yard coverage information is needed for the
other street not provided.
5) Access/ Circulation: Access to the lot is via a proposed public street (Tilley Drive) off
Hinesburg Road. Two curb cuts are proposed off the proposed city road. The access
drive to the west is for lot A only. The access to the east is a shared access to service lot
A and future development on lot B. An access drive is proposed which would connect
lot A to lot B. Circulation on the site is adequate.
6) Parking: The parking requirement for the 30,000 square foot office building is 120
parking spaces and five (5) accessible spaces. The applicant is proposing 143 spaces
with eight (8) accessible spaces. A bike rack is provided.
7) C. O. District/Wetland Buffer: The applicant is proposing parking encroachment
within the C.O. District/wetland buffer. The applicant has supplied comments from
WM. D Countryman, Environmental Assessment and Planning concerning the
wetlands (letter enclosed). Comments from the Natural Resource Committee were
distributed at the 7/2/02 meeting. At the 7/2/02 meeting, the Board did not have a
problem with the proposed encroachment into the C.O. District/wetland buffer.
8) Traffic: This property is located in Traffic Overlay District Zone 5. The applicant
submitted a traffic study. This property is allowed to generate 220 vehicle trip ends
during the PM peak hour. ITE estimates the proposed project will generate 113 vtes
during the PM peak hour. The CCMPO reviewed the traffic study submitted by the
applicant in a memorandum dated 7/16/02 from David Roberts. VTrans, in a letter
dated 7/10/02 to the applicant's engineer, stated their position that a left turn lane should
not be built at this time.
9) South Burlington Fire Chief. This application should comply with all requests from the
South Burlington Fire Department prior to issuance of a zoning permit.
10) Landscaping_ The minimum landscaping requirement based on construction cost is
$30,000. The landscape requirement is met.
11) Lighting: All exterior lighting should consist of downcasting and shielded fixtures.
The applicant provided cut sheets for proposed exterior lighting, which include: 1) two
(2) wall mounted 70W, metal halide fixtures, and 2) twenty (20), 175W pole mounted
(18') metal halide fixtures.
12) Dumpsters: The plan shows a single screened dumpster location.
13) Impact fees: The applicant was made aware that road and fire protection impact fees are
required with the construction of this building pursuant to the South Burlington Impact
Fee Ordinance.
14) South Burlington Engineer: The applicant should comply with all requests from the city
engineer prior to issuance of a zoning permit.
15) South Burlington Arborist: The applicant should comply with all requests from the city
arborist prior to issuance of a zoning permit.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves site plan application #SP-02-32 of Pizzagalli Properties, LLC to construct a 30,000
square foot general office building on 4.52 acres, as depicted on a sixteen page (16) site
plan, first page entitled "Mountain View Business Park Proposed Site Development South
Burlington, Vermont", as prepared by Donald L. Hamelin Consulting Engineers, Inc., dated
March 2002, last revised on 5/6/02, with the following stipulations:

1) All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2) The plan shall be revised to show the changes listed below and shall require approval of
the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the
approved revised plan shall be submitted to the Director prior to permit issuance.
a) The site plan shall be revised to clearly show front yard coverage information for
both Hinesburg Road and Tilley Drive which shall not exceed 30%.
3) The applicant shall comply with all requests from the South Burlington City Arborist,
Fire Chief, and City Engineer, prior to issuance of a zoning permit.
4) For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Development Review Board estimates that the general office will
generate 113 vehicle trip ends during the P. M. peak hour. This number may be reduced
by the Director of Planning and Zoning at the time of permit issuance if warranted by a
specific tenant whose projected traffic generations is less then the approved number.
5) Pursuant to Section 3.503 of the zoning regulations, the Board approves the
encroachment into the C.O. District/wetland buffer. It is the Board's opinion that the
attributes in Section 3.503 (a)-(e) of the zoning regulations will not be affected
adversely.
6) All exterior lighting shall consist of downcasting shielded fixtures. Any change to
approved lights shall require approval of the Director of Planning and Zoning prior to
installation.
7) Prior to issuance of a zoning permit, the applicant shall post a $30,000 landscape bond.
The bond shall remain in effect for three (3) years to assure the landscaping takes root
and has a good chance of surviving.
8) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
9) The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the building.
10) Any change to the site plan shall require approval by the South Burlington Development
Review Board.
