FINDINGS OF FACT AND DECISION
Pizzagalli Properties, LLC, hereinafter referred to as the applicant, is seeking to amend
previously approved plan for a 28,000 sq. ft. mixed use building consisting of: 1) 18,000
sq. ft. of medical office use, 2) 9,400 sq. ft. of general office use, and 3) 200 sq. ft. of
retail food establishment use. The amendment consists of adding a sidewalk to
emergency egress exit on the north side of the building, 118 Tilley Drive. Based on the
plans and supporting material contained in the document file for this application, the
Administrative Officer finds, concludes, and decides as follows:
FINDINGS OF FACT
1. The applicant is seeking to amend previously approved plan for a 28,000 sq. ft.
mixed use building consisting of: 1) 18,000 sq. ft. of medical office use, 2) 9,400
sq. ft. of general office use, and 3) 200 sq. ft. of retail food establishment use.
The amendment consists of adding a sidewalk to emergency egress exit on the
north side of the building, 118 Tilley Drive.
2. The owner of record of the subject property is Pizzagalli Properties, LLC.
3. The subject property is located in the Industrial and Open Space (10) Zoning
District.
4. The plan submitted is entitled, "Mountain View Business Park Lot B Site
Development Proposed Sidewalk Addition", prepared by Donald L. Hamlin
Consulting Engineers, Inc., dated 8/16/06, with a stamped received date of
August 23, 2006.
The applicant is proposing to construct a sidewalk that would connect the emergency
exit on the north side of the building to the parking lot. The sidewalk is proposed to be
approximately 70 linear feet. The impacts to overall coverages are negligible. The
applicant has stated that the construction of the sidewalk will not impact the existing
landscaping on the north side of the building.
Some landscaping will be removed. The applicant must relocate or replace the
landscaping that was disturbed.
There are no dimensional, parking, or traffic changes associated with this application.

DECISION
Based on the above findings of fact, the Administrative Officer hereby approves site plan
application #SD-06-50 of Pizzagalli Properties, LLC to amend a previously approved
plan for a 28,000 sq. ft. mixed use building consisting of: 1) 18,000 sq. ft. of medical
office use, 2) 9,400 sq. ft. of general office use, and 3) 200 sq. ft. of retail food
establishment use. The amendment consists of adding a sidewalk to emergency egress
exit on the north side of the building, 118 Tilley Drive, based on the following conditions:
1. All previous approvals and stipulations shall remain in full effect, except as
amended herein.
2. The plan shall be revised to show the change below and require approval of the
Administrative Officer. Three (3) copies of the approved revised plan shall be
submitted to the Administrative Officer prior to permit issuance.
a) The plan shall be revised to show the relocated or replaced landscaping that
needs to be removed as a result of the construction of the new sidewalk.
3. The applicant shall obtain a zoning permit within six (6) months of this decision
pursuant to Section 17.04 of the Land Development Regulations, or this approval is
null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance prior to the use
of the newly constructed sidewalk.
5. This project shall be completed as shown on the plan submitted by the applicant,
and on file in the South Burlington Department of Planning and Zoning.
6. Any changes to the site shall require approval of the South Burlington
Development Review Board or the Administrative Officer.

Please note: Pursuant to 24 VSA § 4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $110 filing fee and be filed within 15 days
of the date of this decision.
