Re: Findings of Fact, application of Brad Rabinowitz to amend a
previously approved site plan for a 12,250 square foot warehouse.
The amendment consists of adding 250 square feet of mezzanine space
for storage, 45 Commerce Avenue.
On the 12th day of August, 1997, the South Burlington Planning
Commission approved the request of Brad Rabinowitz for site plan
approval under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1 . This project consists of amending a site plan previously
approved on 5/27/97 for a 12,250 square foot warehouse. The
amendment consists of adding 250 square feet of mezzanine space for
storage. No other changes are proposed.
2. This property located at 45 Commerce Avenue lies within the IC
and CO Districts. It is bounded on the north by Commerce Avenue,
on the east by a multi -use industrial/commercial building and on
the south and west by undeveloped property.
3. Access/circulation: Access is provided by a 30 foot wide
ingress and egress curb cut on Commerce Avenue. No changes.
Circulation on the site is adequate.
4. Coverage/ setbacks: Building coverage is 18.2% (maximum allowed
is 30%). overall coverage is 44% (maximum allowed is 70%). Front
yard coverage is 29% (maximum allowed is 30%).
Setback requirements are being met.
5. Parking: A total of nine (9) spaces are required and nine (9)
spaces will be provided including one (1) handicapped space. A
bike rack is provided as required under Section 26.253(b) of the
zoning regulations.
6. Landscaping: No additional landscaping required, based on
building costs, for the additional mezzanine space. The cost of
this additional space was included in the original estimated cost.
7. Sewer: No additional allocation needed.
8. Traffic: ITE estimates that the current facility generates 9.1
vehicle trip ends (vte's) during the P.M. peak hour and with the
additional space to generate 9.3 vte's.

DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the application of Brad Rabinowitz to amend a
previously approved site plan for a 12,250 square foot warehouse.
The amendment consists of adding 250 square feet of mezzanine space
for storage, 45 Commerce Avenue as depicted on a two (2) page set
of plans, page one (1) entitled "North Country Mechanical
Insulators, South Burlington, Vermont," prepared by Brad
Rabinowitz, Architect, dated 8/15/96, last revised 10/3/96, with
the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the existing building with the additional mezzanine space to
generate 9.3 vehicle trip ends (vte's) during the P.M. hour.
3. The applicant shall obtain a zoning permit within six (6)
months pursuant to Section 27.302 of the zoning regulations or this
approval is null and void.
4. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to
occupancy of the additional mezzanine space.
5. Any change to the site plan shall require approval by the South
Burlington Planning Commission.
