FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: preliminary and final plat applications #SD-01-56 & #SD-01-61, respectfully, of James
Barron and K. P. Smith consisting of a boundary line adjustment between 45 and 49 Commerce
Avenue.
On the 6th of November, 2001, the South Burlington Development Review Board approved the
preliminary plat and final plat applications under Section 203 and 204 of the South Burlington
Subdivision Regulations based on the following findings:
1) This project consists of a boundary line adjustment between 45 and 49 Commerce Avenue.
2) The owners of record are James Barron and K. P. Smith.
3) The property is located within the Mixed Industrial and Commercial District. The property is
bound to the north by Commerce Avenue on the east and west by light commercial industry,
the south by undeveloped land and wetland.
4) Lot Size: The lot at 45 Commerce Avenue will be reduced in size to 40,317 sq.ft. which meets the
minimum lot size requirement of 40,000 sq.ft.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
preliminary plat and final plat applications of James Barron and K.P. Smith, respectfully,
consisting of a boundary line adjustment between 45 and 49 Commerce Avenue as depicted on a
plat plan entitled "K. P. Smith Lots 25-27 Commerce Avenue, South Burlington, VT Site Plan
and Boundary Line Adjustment Plat," prepared by Lamoureux and Dickinson Consulting
Engineering Inc, dated 6/8/01 last revised 10/31/01, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2) The plat plan shall be revised to show the changes below and shall require approval of the
Director of Planning and Zoning. Four copies of the approved revised plat plan shall be
submitted to the Director of Planning and Zoning prior to recording.
a) The final plat plan shall be revised to add a notation that the old property line is to be
dissolved.
b) The final plat plan shall be revised to show the metes and bounds information for 49
Commerce Avenue.
3) The final plat plan shall be recorded in the land records within 90 days or this approval is null and
void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording
the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format
of the digital information shall require approval of the Director of Planning and Zoning.
4) Any change to the plat plan shall require approval by the South Burlington Development Review
Board.

Re: site plan application # SP-01-74 of James Barron of amending a previously approved site
plan for a 12,500 sq. ft warehouse. The amendment is to decrease the size of the lot at 45
Commerce Avenue.
On the 6th of November, 2001, the South Burlington Development Review Board approved the
site plan application under Section 26.10 of the South Burlington Zoning Regulations based on
the following findings:
1) This project consists of amending a previously approved site plan for a 12,500 sq. ft
warehouse. The amendment is to decrease the size of the lot at 45 Commerce Avenue.
2) The owner of record is James Barron.
3) The property is located within the Mixed Industrial and Commercial District. The property is
bound to the north by Commerce Avenue on the east and west by light commercial industry,
the south by undeveloped land and wetland.
SITE PLAN CRITERIA
4) Coverage/ Setbacks: There are no proposed changes to front yard coverage. There is a change
in total and building coverage. Total coverage is 38% and proposed is 59.1% (maximum
allowed is 70%) and building coverage from 18.2%, proposed is 28.5% (maximum allowed is
30%). Setbacks will be met from the new rear property line.
5) Parking: The plan does not show the nine (9) approved parking spaces. It should be revised
to show nine (9) spaces including the one (1) handicapped space and a bike rack.
6) Landscaping: The plan should be revised to show the existing landscaping.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
site plan application #SP-01-74 of James Barron consisting of amending a previously approved
site plan for a 12,500 sq. ft warehouse. The amendment is to decrease the size of the lot at 45
Commerce Avenue, as depicted on a site plan entitled "K. P. Smith Lots 25-27 Commerce
Avenue, South Burlington, VT Site Plan and Boundary Line Adjustment Plat" prepared by
Lamoureux & Dickinson Consulting Engineers Inc. dated 6/08/01 last revised 10/31/01, with the
following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2) The plan shall be revised to show the changes below and shall require approval of the Director of
Planning and Zoning (hereinafter Director). Three (3) copies of the approved revised plan shall
be submitted to the Director prior to permit issuance.
a) The plan shall be revised to show all existing landscaping.
b) The plan shall be revised to show the nine (9) approved parking spaces, including the one (1)
handicapped space and a bike rack.
3) Any change to the site plan shall require approval by the South Burlington Development Review
Board.
