COMMENTS Options 1, 2, and 4 present arguments and/or proposed conditions of approval for the Board’s consideration but do not present changes to the physical plans, and therefore Staff has not provided an analysis of these options at this time. Options 1 and 2 would obviate options 3 and 4. Staff considers if the applicant wishes for the Board to consider options 1 and 2, the Board must make a determination on those two options before considering either options 3 or 4. While the Applicant believes that the DRB has the authority to effectuate Option 1 or 2, which is supported by the recent draft LDR language revision City Council unanimously warned, as time is of the essence, the Applicant is proposing to move forward with Option 3 only, revising the parking layout as proposed in the packet submitted on April 9, 2022 and clarified below and in the attached. For clarity, it’s critical to the Applicant that the application be closed this evening and a decision is rendered timely to mitigate the impacts and harm a lengthy continuation or decision delay would cause the Project. A) PARKING 1. Staff recommends the Board ask the applicant to generally describe their planned approach if the Board approves the plan submitted on April 9. While the approved plan must stand alone, Staff considers an understanding of the applicant’s planned timeline will facilitate the Board’s discussion. Planned Approach & Timeline – The Applicant proposes to construct only the parking shown in the documents included in this packet. This parking will accommodate a portion of the initial parking required to operationalize the A-Build phase of the project. The balance of the required parking during operational ramp-up will be off-site at previously permitted and under-utilized lots at BTV Airport; see below and Exhibit A. The remaining on-site parking will not be constructed until the commercial building construction has begun, which will be determined once a use has been identified for the building. Shuttling Plan – The Applicant will be providing shuttle service via the use of a 23-person electric zero-emission bus. Based on an internal needs analysis, the Applicant anticipates the bus will make up to ten (10) round trips per day between the off-site parking location and the assembly facility. The shuttle routing is shown below and in Exhibit A. Traffic Impacts – Since the BTV Airport lots are under-utilized and have existing permits for the proposed volume, there are no additional impacts to the surrounding road network than otherwise anticipated and allowed. Likewise, because the majority of the parking has been removed from the A-Build phase of the project, thereby reducing the total number of trips to the site, there are no additional impacts to the surrounding road network due to shuttling activities. Off-site parking lot locations are shown below and in Exhibit A. Relationship of Proposed Structures to the Site. If the Board approves the provided plans, in order to enable drafting of conditions requiring the remaining plans to be modified to reflect the proposed configuration, Staff considers the applicant must clarify exactly which elements of the project are proposed to be constructed. Applicant Response 2. Staff considers that pedestrian movement is adequate, but that the Board should require the applicant to clarify what elements of the previously proposed sidewalk are proposed to be constructed. Proposed sidewalks are shown below and include as Exhibit B, attached. Staff recommends the Board determine whether any additional information pertaining to the adequacy of the provided parking, such as how employees using remote lots will be shuttled to the proposed building, is needed. The proposed plan is discussed in the response to SC-1 above. 4. The applicant must therefore remove one parking space or shift the parking spaces west to comply with this criterion. With this parking space removed, Staff considers this criterion to be met. Applicant has removed the parking space in question as shown below and included as Exhibit C, attached. For the reasons noted above pertaining to pedestrian circulation, Staff recommends the Board require the applicant clarify exactly which stormwater elements of the project are proposed to be constructed prior to closing the hearing. The Applicant proposes to construct all the previously proposed stormwater management systems to prepare for current and proposed future development described in the master plan including catch basins, manholes, and piping and stormwater treatment practices. Phase I stormwater treatment practices to be constructed include: • Four (4) bio-retention basins; and • One (1) subsurface sand filter; and • One (1) 40,000-gallon rainwater harvesting cistern. Phase II stormwater treatment practices to be constructed include: • One (1) 40,000-gallon rainwater harvesting cistern and a gravel wetland. The practices will collect and treat stormwater runoff from impervious surfaces currently being proposed and future impervious surfaces associated with the master plan. Catch basins and manholes in areas not proposed for impervious surfaces will collect minimal amounts of stormwater runoff but be put in place to prepare for future development and temporarily reduce ponding during large rain events.
