Findings of Fact, Conclusion of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on January 12, 1998
by application of E&M Mechanical, Inc., Joseph Eddy, the appellant for a conditional use
approval to build a 14,000 square foot structure and occupy with a maximum of three (3) tenants
to include light manufacturing, research and testing labs, wholesale establishments, warehousing,
storage and distribution, equipment service and repairs and associated accessory uses at 41
Commerce Avenue, Ethan Allen Industrial Park according to plans submitted. The Board of
adjustment finds as follows:
1) The property in question is zoned I-C District.
2) Uses proposed are those currently permitted within the IC District.
3) Section 26.65 requires conditional use approval for multiple occupancy of a structure.
4) The proposed structure has a footprint of 12,000 square feet and a second floor area of
2,000 square feet.
5) The applicant proposes to occupy 7400 square feet and lease the balance for two
additional tenants.
6) Proposed traffic impacts are 50 vehicle trip ends and 6 peak hour trips.
7) Sewer affocation is 250 gpd which does not create any adverse impacts.
8) Land use permit #4cO643-15 is being amended to allow for these impacts.
9) No manufacturing which would handle hazardous materials will be permitted.
10) Subject to zoning administrative review for any tenant occupying the building.
ORDER
The conditional use approval to to construct a 12,000 square feet building (2000 square feet 2 d
floor area) and occupy with a maximum of three (3) tenants at 41 Commerce Avenue is hereby
GRANTED.
