HomeMy WebLinkAboutMinutes - City Council - 08/29/1988CITY COUNCIL 29 AUGUST 1988 The South Burlington City Council held a regular meeting on Monday, 1 August 1988, at 8:00 p.m., in the Conference Room, City Hall, 575 Dorset Street Members Present Paul Farrar, Chairman; Michael Flaherty, John Dinklage, Molly Lambert Also Present William Szymanski, City Manager; Mary McKearin, Business Manager; Albert Audette, Street Dept; Sid Poger, The Other Paper, Mike Donoghue, Free Press; John Race, Lee Graham, Tonya Shultz, Paul Kissel, Police Dept; Stephen Stitzel, City Attorney; Christopher Davis, Police Assn. Attorney; Margaret Picard, City Clerk/Treasurer; Vincent D'Acuti, Lillian D'Acuti Comments & questions from the public not related to items on the agenda No issues were raised. Sign Resolutions of Commendation for past service to South Burlington for: a) Frank Murray: Mr. Farrar read the Resolution Mr. Flaherty moved the Council sign the Resolution as read. Mr. Dinklage seconded. Motion passed unanimously. b) Vin D'Acuti: Mr. Farrar read the Resolution Mr. Flaherty moved the Council sign the Resolution as read. Ms. Lambert seconded. Motion passed unanimously. Mr. D'Acuti thanked the Council and related some of his experiences in the City and declared that the City had been good to him and he was privileged to serve it. Hear a Police Grievance Mr. Davis explained that 2 positions were posted for the Senior Sendoff at Bolton: one an outside and one an inside position. Volunteers were requested for each. At some point, it was determined to pay the outside person, and this position was filled. Sometime later, the City offered compensatory time for the inside position. However, the procedure for filling a position when there is compensation was then not followed. It is the Union's contention that compensatory time is a form of compensation and the off-duty list should have been used. The concern is that this may set a precedent for circumventing established procedure. They also feel that whoever should have had this job should receive the compensatory time. Mr. Dinklage questioned whether a particular person was chosen for specific skills for this assignment. Ms. Shultz said it was originally posted as a volunteer position. If the person were chosen for specific skills, that person should have been paid at the regular overtime rate. Chief Race said that he had originally agreed to provide "somebody." In his absence, Mr. Graham noted, he received a request from the students for Officer Fraga and told him he had been requested. He said he had the impression Officer Fraga was leaning toward accepting it. Mr. Farrar suggested the possibility that the person chosen lose his/her next turn on the off-duty list. Mr. Graham noted the posting was for volunteers and because Officer Fraga went it did not mean others couldn't go as well. He also noted that compensatory time was at regular time, not overtime. 4. Appoint Voting Delegate to Vermont League of Cities and Towns Annual Meeting Mr. Flaherty moved the Chairman sign the document appointing Peggy Picard as S. Burlington representative. Mr. Dinklage seconded. Motion passed unanimously. 5. Review Planning & Zoning Agendas Mr. Farrar expressed concern with the expanding definition of "home occupation" and didn't feel that definition should be changed by the Zoning Board. This will be communicated to the Zoning Board. 6. Minutes of 8/1/88 and 8/12/88 Mr. Flaherty moved to approve the Minutes of 8/1 and 8/12/88 as written. Mr. Dinklage seconded. Motion passed unanimously. 7. Sign Disbursement Orders Disbursement orders were signed. 8. Old Business a) Central School: Mr. Farrar said he had a discussion with Mr. Munson on this and is waiting for information on a proposed land swap. The school administration is aware of this. Mr. Flaherty felt with school opening next week, something should be done. Mr. Szymanski noted the question was complicated by the purchase of the Ramada Inn. Mr. Audette noted the school was supposed to put up a "no left turn" at the exit but has not done this. Mr. Farrar said he would call Mr. Munson tomorrow. b) speeding on Van Sicklen Rd. Mr. Dinklage noted receipt of a call from a resident. Chief Race said they are moving their people around to various areas where speeding is a problem, and this is one of them. He also noted the writing up of speeding violations on Hadley Rd. where speeds have exceeded 50 mph. Violators include Correctional Center employees. c) Response to letter from South Burlington Concerned Citizens Mr. Dinklage said one suggestion was to identify critical landscape areas. The Natural Resources Committee is doing this, and it was suggested they respond to this group and tell them where they stand. d) Alternate funding for View Protection: Mr. Dinklage advised of a communication from the Vermont Housing and Conservation Trust Fund Account which might provide some funds for what the City is trying to do on Spear Street. Executive Session Mr. Flaherty moved the Council adjourn and reconvene in Executive Session to discuss progress on Union negotiations and also the Police grievance and to resume regular session only to sign Union contracts and/or make a decision on the Police grievance. Mr. Dinklage seconded. Motion passed unanimously. Regular Session Upon resumption of regular session, contracts for the Highway and Water Pollution Control Dept. were signed.
