HomeMy WebLinkAboutMinutes - City Council - 01/05/1987CITY COUNCIL 5 JANUARY 1987 The South-Burlington City Council held a regular meeting on Monday, 5 January 1987, at 7:30 pm, in the Conference Room, City Hall, 575 Dorset Street. Members Present George Mona, Francis X. "Murray, Molly Lambert Also Present William Szymanski, City Manager; James Goddette, Fire Chief 1. Elect a Chairman for this meeting Mr. Szymanski explained that since both the Chairman and Vice Chairman were absent, an acting chairman would have to be elected for this meeting. Mr. Murray nominated Mr. Mona. Ms. Lambert seconded. Mr. Mona was elected unanimously. 2. Comments & Questions from the public (not related to items on the Agenda No issues were raised. 3. PUBLIC HEARING on "An Ordinance Relating to the Use of Fire Alarm Systems Mr. Murray moved to waive the reading of the Ordinance. Ms. Lambert seconded. Motion passed unanimously. Following a brief discussion, Mr. Murray moved that the Ordinance be passed as written. Ms. Lambert seconded. Motion passed unanimously. 4. Review Planning & Zoning Agendas Mr. Mona called attention to the item on the Zoning Agenda for John Larkin's proposed expansion of the nursing home on Williston Rd. and noted that Williston Rd. has been the most intensive battleground re: usage issues. 5. Minutes of 15 and 22 December Members agreed to postpone review of theMinutes as 2 members present had not attended the meetings in question. 6. Sign Disbursement Orders Disbursement Orders were signed. Old Business a. Mr. Mona raised the question of the light at Lindenwood Drive. Mr. Szymanski noted he had called the Estate and a meeting is planned with State people and Rep. David Kaufman. After a discussion, members agreed that the City Manager should write to Ms. Crampton at the Agency of Transportation saying the city wants the red-green cycle turned back on again. Members felt the light was not a hindrance to Shelburne Rd. traffic, and its alteration to a yellow blinking light was causing undue problems to residents of Lindenwood Drive when they attempted to get out of their street. b. With regard to the report of the City Center Committee, members asked the City Manager to draft a letter from the Council recognizing and appreciating the work. Mr. Murray moved that the Council accept the report of the City Center Committee, endorse its concepts, and send a communication on behalf of the Council to Committee members thanking them for their work and looking forward to receiving the advice and further detailed recommendations for implementation from the Planning Commission. Ms. Lambert seconded. Motion passed unanimously. c. Mr. Mona reminded members they are a month delinquent in the evaluation of the City Manager. d. Mr. Mona mentioned receiving a call from a neighbor who had been asked to circulate a petition on behalf of alterations to the present Burlington Southern Connector plans. Ms. Lambert noted that bidding will be posted on the project this Friday. e. Members briefly discussed items for the next agenda as the meeting will be held at Central School. Items considered to be of interest to that neighborhood include plans for Williston Rd. widening, Corporate Circle development plans, the White Street intersection, and related concerns. Ms. Lambert will prepare a letter to go home with Central School children. As there was no further business to come before the Council, the meeting adjourned at 8:15 pm. AN ORDINANCE RELATING TO THE USE OF FIRE ALARM SYSTEYS The Council of the City of South Burlington hereby ordains: Section 1: It shall be unlawful for anyone to activate any fire alarm for the purpose of summoning a fire department or other emergency personnel except in the event of a fire or other emergency, or for anyone having knowledge that an alarm was activated in the absence of a fire or other emergency to fail to immediately notify the appropriate emergency personnel. Section 2: For a fire department response to any false alarms (as defined in Section 3, below) the fire department shall charge and collect from the person having or maintaining such fire alarm on premises owned or occupied by him, fees as follows: (a) For a response to premises at which no other false alarm (as defined in Section 3, below) has occurred within the preceeding six (61 month period, herein- after referred to as a "first response", no fee shall be charged, but the fire department will inspect the alarm system and ascertain the cause of the false. alarm and notify the person having or maintaining such fire alarm system of any corrective action which must be taken. Within three (3) days after such notice, the person having or maintaining the fire alarm system shall make a written report to the chief of the fire department certifying that the corrective action has been taken. (b) For a second response to a false alarm to premises within six (6) months after the first response, a fee of $100.00 shall be charged and for each succeeding response thereafter within six (6) months of the first response, afee of $200.00 shall be charged. Section 3: For the purpose of this ordinance, the term "false alarm'' shall mean the activation of a fire alarm by other than a fire or what is determined by the fire department to be a legitimate emergency. Section 4: Anyone 'convicted of a violation or failure to comply with any of the provisions of this'ordinance, including the failure to make a required report or to pay any fee, shall be fined not more than $100.00 for each offense.
