CITY COUNCIL 22 DECEMBER 1986 The South Burlington City Council held a special meeting on Monday, 22 December 1986, at 7:00 p.m., in the Conference Room, City Hall, 575 Dorset St. Members Present Paul Farrar, Chairman; Molly Lambert, Michael Flaherty Also Present William Szymanski, City Manager; Wendy Schroeder, Business Manager; Richard Spokes, City Attorney; James Goddette, Fire Chief; Lt. Kruger, Police Dept. Executive Session Ms. Lambert moved that the Council meet in Executive Session to discuss the contract for Dorset St. Park Land with the City Attorney. Mr. Flaherty seconded. Motion passed unanimously. Regular Session 1. Approval of contract for Dorset Street park land Mr. Flaherty moved that the Council sign the basic agreement with A & G Investment Corp. and direct the City Attorney to deal with Mr. Crampton in working out the definitive language. Ms. Lambert seconded, and the motion passed unanimously. 2. Continue discussion on Police Grievance Lt. Kruger explained that following testing procedures, when scores were tabulated, Robert Lafountain was selected for the Sergeant position. There was one corporal position and two people with almost identical scores. Since the corporal position is not supervisory in nature, Lt. Kruger felt if it was OK with City Hall, he would promote both men. He spoke to the union people about it, and they felt it was a good way to boost spirits. A meeting was held and the union granted a one- time waiver, since the position had not been posted. Mr. Farrar asked what the union now wants. The reply was 6 grade 9 positions. Mr. Farrar said this could be accomplished by making the Sergeant position a corporal, and then there would be only one sergeant. It is the union's position that the proper place to reduce the number of corporals should be the bargaining table. Lt. Kruger said it was his understanding that the additional corporal position would be a permanent thing. Mr. Farrar said he could not understand why the union is objecting to management promoting someone to sergeant. The union did not feel this was wrong but objected to the decrease in Grade 9 positions. They feel if there were 6 grade 9 positions before the promotion of a man to sergeant, there should be 6 after that promotion. Mr. Flaherty said he didn't feel it was management's intent that the additional corporal position be permanent. Mr. Flaherty then moved that the Council uphold the City Manager's denial of police grievance #8604. Ms. Lambert seconded for discussion purposes. Ms. Lambert said there is a question as to how the union will perceive the action taken tonight. The union requested that the Council put its rationale in writing. In the vote which followed the motion passed 2-1, Ms. Lambert opposing. 3. Acceptance of parcel of land on Kirby Road Mr. Szymanski explained the parcel is 2.1 acres of ravine. The present owner would like to close the deal by the end of the year for tax reasons. The City Attorney has all the documents. Mr. Flaherty moved that the Council authorize the City Manager to accept the deed to the land as described and to pay no more than $100 for this land. Ms. Lambert seconded, and the motion passed unanimously. 4. Request for Fire Truck Chief Goddette explained the Department had sold a brush truck which could be used only for work in the woods. With the new hose, the present vehicle is overloaded. They tried to negotiate with Burlington to get a small truck, but this was not successful. Now, one of the firemen wants to trade in a truck he owns. It would cost the Department about $6000. This is possible in the budget considering money saved on bidding and a radio. Mr. Farrar noted that the budget would show an overage of $3600 and an unexpected revenue of $3600. Members felt this would be acceptable. 5. Liquor Control Board Mr. Flaherty moved that the Council meet as Liquor Control Board. Ms. Lambert seconded, and the motion passed unanimously. Mr. Szymanski presented a request from Jolly Associates for second class liquor licenses at 2 locations; the Mobil Short Stop at 977 Shelburne Rd. and the Getty Station at 1830 Shelburne Rd. The latter is only for a change of owner's name. Mr. Flaherty moved that the Board approve the second class liquor licenses for Jolly Associates as presented by the City Manager.
