HomeMy WebLinkAboutMinutes - City Council - 01/07/1985CITY COUNCIL JANUARY 7, 1985 The South Burlington City Council held a Regular Meeting on Monday, January 7, 1985, at 7:30 p.m., in the Conference Room, City Hall 575 Dorset Street. Members Present Paul Farrar, Chairman; Leona Lansing, George Mona Members Absent Michael Flaherty, William Peters Others Present William Szymanski, City Manager; Margaret Picard, City Clerk/Treasurer; Jane Bechtel, City Planner; Richard Ward, Zoning Administrator; Sidney Poger, Planning Commission; Ruth Poger, the Other Paper; Vince Bolduc, Kyle Wheel, Lowell Krassner Comments & questions from the public (not related to items on the Agenda) No issues were raised. Continue Public Hearing on proposed amendments to Zoning Regulations Ms. Bechtel advised that the City Attorney felt that with regard to "group homes", the Zoning Regulations should either use the State language or say nothing. Mr. Farrar suggested that a parenthetic inclusion of the State language could solve the problem and would also cover the City in case the State language were changed. Vince Bolduc then presented a petition on behalf of the neighbors of the proposed "group home" on Dorset Street in which they state their belief that the proposed home is not in conformity with either the Zoning Regulations or State statute. Mr. Farrar outlined the procedure the petitioners should follow: the first determination will be made by the Zoning Administrator; if the petitioners are still dissatisfied, they can then petition the Zoning Board to hold a hearing. Mr. Ward then explained that since he is a neighbor of the proposed home, and thus has a conflict of interest, he has stepped down in the matter, and the decision will now be made by the City Planner and the City Attorney. Mr. Mona then moved to change the proposed language to make reference to the State Statute and repeat the State Statute in the appropriate part of the Zoning Ordinance. Ms. Lansing seconded, and the motion passed unanimously. Ms. Bechtel then advised that a new public hearing will be necessary. Mr. Mona moved to schedule the new public hearing for the first warned meeting in February. Ms. Lansing seconded with unanimous approval. Ms. Lansing suggested that the City representatives by invited to this meeting so that they will understand the City's position in the matter. Mr. Farrar indicated that he felt the Council should not note take a stand in the particular proposed "group home" in question. However if the matter did go to the Zoning Board, the Council could express an opinion as to what it felt would be in the best interests of the City. Discuss proposal for rezoning a 7.9 acre parcel of land located along the east side of Hinesburg Road The land in question includes lands owned by the Tilley Farm. Pizzagali has an interest in the land and is considering it as a location for their entire operation. The land east of the parcel in question is Industrial Commercial, so it would be an extension of that. The neighbors were warned of the subdivision and will be warned again when the City has a hearing. So far there has been no reaction. Some of the issues involved include the land to the north which is zoned residential and also whether this parcel was large enough to rezone because of the possibility of a full interchange to I-89. Mr. Mona moved that the public hearing to discuss the proposal for rezoning a 7.9 acre parcel of land located along the east side of Hinesburg Road be set for the third Monday in February. Ms. Lansing seconded with unanimous approval. Sign Resolution accepting easements and rights-of-way dedicated to the City over the past several years Mr. Farrar read the Resolution (attached together with list of easements and rights-of-way). Ms. Lansing then moved that the Council sign the Resolution accepting easements and rights-of-way. Mr. Mona seconded with unanimous consent. Discuss City Attorney's letter of December 20, 1984 regarding the December 10, 1984 action to settle the police grievance Mr. Szymanski explained that there had been a misunderstanding with Diane Reynolds as to whether the settlement was tied into the Union contract. Mr. Farrar said the settlement should be as an amendment to the present contract. Review Planning & Zoning Agendas No issues were raised. Sign Disbursement Orders Disbursement Orders were signed. Accept Minutes of December 10, 1984 Ms. Lansing moved that the Minutes of December 10, 1984 be approved as printed. Mr. Mona seconded with unanimous consent. Old Business Ms. Lansing questioned whether there could be an alternate to the Airport Commission for occasions when Mr. D'Acuti cannot attend meetings. Mr. Farrar said he would have to check with their Charter to see if an alternate could vote or attend Executive Sessions. There have been applicants in the past who could serve in such a capacity. Mr. Farrar raised the question of the upcoming decision on the City's health insurance program. He asked if there could be a survey sent out to see what the problems have been. Liquor Control Board Ms. Lansing moved that the Council adjourn and reconvene as the Liquor Control Board. Mr. Mona seconded with unanimous approval. Discussion continued on the request of Club New England for a modification of their entertainment permit. Mr. Szymanski reported that he had received notification of a hearing which the State had issued to Club New England citing them with violation of general rule #981, which includes "obscene, lewd indecent entertainment". The hearing will consider suspension and revocation of the Club New England's First & Third Class Licenses, and will be held on January 22nd in Montpelier. Chip Ward, Attorney for Club New England restated the Club's position that there had been no problems with the crowd on the occasion of that performance and that they were cited for allegedly showing male buttocks on stage. He said that any future performances would be in conformance with all codes. Mr. Mona said he felt it very difficult to consider expansion of Club New England's license when they already have restrictions due to not unrelated problems. Mr. Farrar said there were obviously 3 Board members who opposed the request and suggested the Club reapply after the hearing with the State and also present an update on the Club's other problems. Mr. Szymanski presented a request for a Second Class License for Doug's Quick Stop on Shelburne Rd. The request is due to a change of lessee. Mr. Mona expressed his regret at having issued a second class license to the gas station at Williston Rd. and Dorset St. He noted that the Planning Commission had made an effort to eliminate fast food places from such heavily travelled areas and now the Board was creating the same turning motions be allowing second class licenses. Mr. Farrar said the place to discuss this is in the Zoning document. Ms. Lansing then moved to grant a Second Class Liquor License to Doug's Quick Stop on Shelburne Rd. Mr. Mona seconded and the motion passed 2-1, Mr. Mona opposing. Mr. Farrar noted that the Planning Commission will be going through the Master Plan soon and this could be considered at that time. An amendment to the Zoning Ordinance could also be proposed to the Council which would refer it to the Planning Commission for a hearing. Mr. Poger noted that a convenience store was originally approved for such locations so people would not have to go downtown for small grocery purchases. This was in the days before there were so many major markets in the city. Mr. Mona then moved that the Liquor Control Board adjourn and reconvene as the City Council to go into Executive Session for the purpose of discussing union negotiations with the understanding that the only business to follow the Executive Session would be adjournment. We believe they are ready to be accepted by the City Council. The streets have been reviewed by Sonny who has agreed to the acceptance of these. Construction has been completed to City Standards. The easements should not include any easements for the future widening.
