HomeMy WebLinkAboutMinutes - City Council - 10/01/1984CITY COUNCIL OCTOBER 1, 1984 The South Burlington City Council held a regular meeting on Monday, 1 October 1984, at 7:30 p.m., in the Conference Room, City Hall, 575 Dorset Street. Members Present Paul Farrar, Chairman; Michael Flaherty, George Mona Members Absent Leona Lansing, William Peters Others Present William Szymanski, City Manager; Margaret Picard, City Clerk; Gloria Yandow, City Bookkeeper; Diane Gadhue, Assistant City Clerk; Maria Gallant, Planning/Zoning Secretary; Alyce Piche, Deputy Tax Collector; Ruth Poger, The Other Paper; Gil Myers, Atty Comments & questions from the public not related to items on the Agenda There was no discussion. Continue hearing on City Hall employee Grievance It was noted that the City Attorney has stated that in his opinion the City Clerk has the power to make appointments. If there is anything that might override this power, it is the fact that the City Manager is a de facto personnel manager. If the two agree, the question is moot. Mr. Farrar said he felt the Council should try to add to the Rules & Regulations some clarifying language as it was not clear if this was a new position or the reclassification of an employee. He asked that the Association work with the Council in this effort. Mr. Myers said he felt this was a good procedure. He added that he had a conversation with Mr. Spokes (with the City Managers knowledge) and Mr. Spokes will send the Council a letter concerning what would happen if this position again becomes vacant. Mr. Spokes apparently feels that the posting procedure would then have to be followed. Mr. Flaherty then moved to direct the City Manager and City Attorney to come up with suggested additions to the Personnel Rules and Regulations to be sent to the Employees Association for approval. Mr. Mona seconded with unanimous approval. Consider a No Parking Resolution each side of the intersection of the new private street and Patchen Rd. serving Valley Ridge Mr. Szymanski said there is a parking problem especially when there is a game being held in the park. He added that the City is looking into additional parking possibilities for the ballfield. Mr. Farrar then read the Resolution (attached). Mr. Flaherty then moved that the City Council sign the Resolution as read by the Chairman. Mr. Mona seconded with unanimous approval. Mr. Flaherty questioned the status of the reduced speed limit signs. Mr. Szymanski said the State has indicated the City can do as it wishes as long as there is supporting data. A local engineer is to take care of the signs. Accept petition from the Police Association for placing on the ballot at the November 6, 1984 election, binding arbitration The City Clerk reported that 403 signatures were needed and 410 were verified. Mr. Farrar noted that the City Attorney advised that the petition could be rejected because of the language, but he felt this would accomplish nothing worth while. Mr. Mona asked what happens if the citizens vote against the issue. Mr. Farrar said binding arbitration would not then be required. Mr. Mona said he was concerned because of other negotiations, and felt the issue was similar to spot zoning. Mr. Farrar said he felt binding arbitration was not in the best interest of the city but also felt it should be on the ballot. He added that if it passes, binding arbitration would be a fact of life until rescinded. He said the problem is that the city has no set of standards for the arbitrator to base a decision on and he would first have to make up the standards. Mr. Flaherty then moved to accept the petition from the Police Association for the election of November 6, 1984 to vote on a binding arbitration clause. Mr. Mona seconded and the motion passed 2-1, Mr. Mona voting against. Mr. Farrar then read the warning (attached). Mr. Flaherty then moved to approve the warning as read by the Chairman. Mr. Mona seconded and the motion passed 2-1, Mr. Mona voting against. Mr. Mona explained his negative votes by stating he did not feel that binding arbitration was in the best interest of the city. The Warning was then signed. Review Zoning Board Agenda Mr. Farrar reported that he had received a letter from the City Attorney updating the zoning enforcement issues raised at the last meeting: 1) the chicken farm has been under a request for injunction since May 4; 2) the roving taxi company will be sued if a variance is not requested by Sept. 26; 3) Action has been taken against the Dorset St. antique operation; 4) the White Street antique operation is under control, per the code officer. Read Minutes of September 17, 1984 Mr. Flaherty moved that the Minutes of September 17, 1984 be approved as printed. Mr. Mona seconded and the motion passed 2-0, Mr. Mona abstaining. Sign Disbursement Orders Disbursement orders were signed. Old/New Business It was determined that the next meeting will be on October 22, 1984, following the BCA Meeting. Mr. Szymanski advised that the City must by October 17, 1984 form a handicapped grievance board and must come up with a plan to modify structures. Mr. Flaherty moved to empower the City Manager to form and appoint members to a Handicapped Grievance Committee to be comprised of three members. Mr. Mona seconded with unanimous approval. Accept Report of City Charter Committee Mr. Flaherty moved that the City Charter Committee report on proposed changes to Section 1309 be accepted with profuse appreciation. Mr. Mona seconded with unanimous approval. Mr. Farrar reported that he had discussed with the City Attorney the other charter change request regarding tax incremental districts. The language is not ready for the November 6th ballot but this is not vital. It must be done before bonds are issued and can be accomplished in May. Mr. Szymanski reported that he had verbal assurance of the lower rate for the sewage treatment plant upgrade which means there will be $1,000,000 less in the bond issue Liquor Control Board Mr. Flaherty moved that the Council adjourn and meet as the Liquor Control Board. Mr. Mona seconded with unanimous approval. Mr. Szymanski presented a catering permit request from the Sheraton for a private party for Burlington Professional Women to be held at the Green Mountain Power building on October 19, 5:15-10 P.M. Mr. Flaherty moved that the Board approve the catering permit request from the Sheraton as presented by the City Manager. Mr. Mona seconded with unanimous passage. Mr. Szymanski then presented a request for a second class liquor license from J & L Sav - Mor. which has undergone a change of ownership. Approval of police and fire have been received. Mr. Mona moved that the second class liquor license request of J & L Save More be approved. Mr. Flaherty seconded with unanimous approval. RESOLUTION ---------- BE IT RESOLVED, by the South Burlington City Council, to approve the recommendation of the City Manager, that due to increased street parking on Patchen Road, that the entrance to the Valley Ridge development be designated "NO PARKING" for a distance of sixty (60) feet to the south and for a distance of thirty (30) feet to the north of said entrance, and BE IT FURTHER RESOLVED, that the appropriate signs be installed by the direction of the City Manager.
