Minutes of 5 June, 10 July, and 24 July: Mr. Cameron moved to approve the Minutes of 5 June as written. Mr. Kupferman seconded. Motion passed 4-0 with Ms. Quimby abstaining. Site plan application #SP-01-42 of Leonard Charland and Donald Jones to amend a previously approved site plan for a 5,000 sq. ft. manufacturing and warehouse building. The amendment consists of constructing a 240 sq. ft. addition for a total of 6,240 sq. ft. of manufacturing and warehouse use, 38 Commerce Avenue. Approved b. Site plan application #SP-01-47 of the City of South Burlington to amend a site plan for a 4,500 sq. ft. structure used for a not -for -profit organization whose primary purpose is the provision of educational or research services, related to agriculture, horticulture, forestry, natural resource preservation, the arts or recreation. The amendment consists of the installation of pedestrian trails and associated bridges, 1100 Dorset Street. Approved No issues were raised. 4. Public Hearing: Preliminary plat application #SD-01-42 of R & L Taft Building, Inc., to amend a planned residential development consisting of 296 residential units and an 18 hole golf course. The amendment consists of subdividing 10 lots off from Golf Course Road with access between lots #86 and 87: Mr. Belair distributed copies of letters from Priscilla Crummer and George A. Dacey and also noted receipt of a letter from John A. Kane. W I T N E S S E T H WHEREAS, Developer has received site plan approval from the Municipality's Planning Commission for the construction of a commercial building as depicted on a plan entitled Lot 15 Ethan Allen Drive dated , prepared by Jim Wood and WHEREAS, Developer is required by said approval, at its own expense, to oomplete certain public improvements; and WHEREAS, the parties to this agreement wish to establish a mechanisd to secure the obligations of -the Developer as set forth above, aAd WHEpEAS, the bank executes this agreement solely in the capacity of issuer of the Letter of Credit hereinafter specified. The Bank shall incur no liability to the Developer do account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. The Municipality shall not file with the Bank a statement of default until sixty (60) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 9. All monies released by the Bank to the Municipality pursuant to paragraph 6 shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgment of the Municipality shall accomplish the work most expeditiously and economically. 10. If monies are released by the Bank to the Municipality pursuant to paragraph 6 and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this agreement. 11. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or hinder such payments by the Bank to the Municipality. Staff discovered the parking area was expanded without site plan approval and requested the applicant obtain approval from the Planning Commission. This site was approved on 7/13/93 (minutes enclosed). This property located at 38 Commerce Avenue lies within the I-C, District. It is bounded on the north by Ethan Allen Drive, on the east by an industrial building (Top Shop), on the south by Commerce o� Avenue and on the west by a warehouse/office building under construction. Landscaping: The minimum landscaping requirement for this project is $1800 which is being met. Plantings will include Flowering'` Crabapple, Arborvitae, Red Maple and Blue Spreading Juniper. The, landscaping schedule indicates that 52 Arborvitae are proposed but the plan shows only 48 of these trees. Also, the size of the Juniper is missing. Staff recommends these Junipers be a minimum of 2 gallon in size. Parking: A total of 10 parking spaces are required and 11 spaces are being provided including one (1) handicapped space. Sewer: The sewer allocation required for this project is 210 gpd. The per gallon fee will have to be paid prior to permit. Exterior lighting: The two (2) lighting fixtures proposed will be mounted on the building and will use 75 watt high pressure sodium lamps. The ` money would go towards improvements to Ethan Allen Drive. 7) L&M PARK - BANK ADDITION - SKETCH PLAN This project consists of a 116 square foot net increase addition to an existing drive-in bank facility, a five (5) foot extension to the drive-in canopy to add an ATM lane and parking changes. The bank property is part of the L&M Park PUD which was last amended on 3/23/93 when the Planning Commission approved the subdivision of the project into two (2) lots. The bank property located at 1117 Shelburne Road lies within the Cl District. It is bounded on the north by an auto dealership, on the west by the site of a proposed retail building, on the south by McDonald's restaurant and on the east by Shelburne Road. Access/circulation: Access is via a 24 foot curb cut on Shelburne Road for ingress only and an access drive on the west side for ingress and egress connecting the bank property to the L&M Park commercial development. Circulation is one-way around the bank building and is adequate. Coverage/setbacks: The following coverage information pertains to the commercial portion of the L&M Park project. Building coverage is 65,416 square feet (maximum allowed is 125,453 square feet). Overall coverage is 253,874 square feet (maximum allowed is 292,723 square feet). The applicant should provide front yard coverage calculation for lot "C" andthe bank lot combined. Setback requirements will be met. Parking: No additional parking spaces provided and no additional parking spaces required. A sewer allocation of 450 gallons per d� per lot is made in accordance with the South Burlington sewer policy. 5. PUBLIC HEARING: Final Plat application of John Bolter for continuation of the industrial subdivision with loto #9=21 at Ethan Allen Farm Industrial Park (repeated due to applicant's failure to meet filing deadlines) Mr. Belter stepped down during this discussion. Mrs. Lafleur said the application is identical to the one passed except one of the stipulations on the last approval was the dedication of the 5.25 foot wide strip on either side of Ethan Allen Drive. It is not shown on the plan but the deed is already in the City's possession. She added that work on Ethan Allen Dr. will start in 1987-88. Sonny Audette is applying for special funds for fixing dangerous inter- sections. Ms. Peacock asked for some background on the project as she had not been on the Commission when it was passed. Mr. Jacobs provided a brief summary. Mrs. Maher moved that the S. Burlington Planning Commission approve the Final Plat application of John Belter for the 13 lot industrial subdivision as depicted on a plan entitled "Ethan Allen Farm, Industrial Subdivision lots 9-21" as prepared ]2y Warren A. Site Plan application of Dave Desautels, agent for Partner Tire, for construction of a 10,200 sq.. ft. building on lot 13 of the Fassett's 3-lot subdivision, 1785 Shelburne Rd. Mr. Desautels explained this will be a 3-tenant building, all automotive related. The multiple use has Zoning Board approval. There will be a common drive between lots 2 & 3, and this building will use that drive. Mr. Desautels said the use is a relatively low traffic generator. They expect 16 or 17 cars maximum in a peak hour. Mrs. Lafleur said the traffic overlay zone allows 89 cars. She noted that any change in use would have to come back to the Commission. Mrs. Maher asked how developers' projections are checked. Mrs. Lafleur said she uses ITE data. In this case, there are no comparable businesses, but specialty retail would generate 23 cars per peak hour, hardware 53, and a service station 31. She didn't think there would be a problem in exceeding the traffic overlay with the proposed uses. Mr. Desautels added he checked with the Partner Tire people and the prospective tenants on their present figures. He noted that no gas will be dispensed on the site. Regarding parking, Mr. Desautels noted the brook goes through the site. He felt the parking shown on the plan would be enough without having to cross the brook for additional parking. They agreed to review the situation after a year to see if the additional parking is necessary. Mrs. Lafleur felt the landscaping plan should be revised with more moved up front. Mrs. Maher suggested substituting some- thing for the flowering crab which are not doing well in many parts of town. Mrs Lafleur also noted a Wagner, Heindel & Noyse study will be required. Mr. Belter said he hoped that when and if they ever came back for more lots he hoped the issue would not come up again. He felt he had made his contribution to fixing the road. Mrs. Hurd pointed out that whenever a developer comes before the Commission, they always try to get as much as they can. I4r. Belter said he would like to pay for the improvements to the road on a per lot basis and the Commission agreed, if it were paid after the first 3 or 4 lots. 5 was agreed to. Mr. Dooley had a motion. Final plat application of LTH, Inc., for the Planned Commercial development for a 200 unit hotel and existing restaurant located on the Benes Inn lot and lot ##10 of the LTH properties, at 1710 Shelburne Road Mr. Belter rejoined the Commission. Ms. Bechtel noted that this plan would provide for better fire protection. It was noted that the hydrological study had just been received tonight. Ms. Bechtel said she could summarize it. Data put through the computer model showed that a retention pond was needed, and a 44,000 gallon size had been recommended. It was also found that this area is close to the drainageway, so the peak runoff time for its drainage will come before the peak runoff from the Spear Street area gets to this part of the drainage ditch. Mr. Krebs said Mr. Larkin had agreed to put in a pond, even though they do not feel it is needed. Mr. Dooley wondered whether, if the drainage in this area were slowed through the retention pond, it would then be released when the peak upstream drainage passed by, thus increasing the problem. Ms. Bechtel said she would ask the consultants. Mr. Krebs said they would install a series of catch -basins and would plan on flooding the parking lots as a way to slow drainage discharge. They are not planning on one large pond. Mr. Belter asked whetner the study covered just the area planned for development, or the whole area. Mr. Dooley said he did not want to see 200 units with access only to Shelburne Road. He noted that this plan did not show lot 10, through which a the secondary access will pass. Mr. Larkin said they would build that road. Mrs. Hurd noted that the Fire Chief had told the Commission that he could not guarantee protection to something this large this far from the station. :4r. Jacob noted that the city had mutual protection and aid with Uhelburne; and he said that the Council was looking into land for a station on Shelburne Hoag. 's. Bechtel said revised landscaping plans were needed. ?,Ir. Scott Tower of 4 Seasons went over the l�;ndscaping plans. Mrs. Iaher wanted the Planner to carefully review the landscaping plans. Ms. Bechtel said this was the first she had seen of it but she would verify the worth. Mr. Reg Boucher said he was the president of the Bartletts Bay Association and he asked about the drainage report. He asked for a copy and said he would like to review it before final approval was given.
