CITY COUNCIL DECEMBER 3, 1984 The South Burlington City Council held a regular meeting on Monday, December 3, 1984, at 7:00 p.m., in the Conference Room, City Hall, 575 Dorset Street. Members Present Paul Farrar, Chairman; Michael Flaherty, George Mona, William Peters Member Absent Leona Lansing Others Present William Szymanski, City Manager; Sidney Poger, William Burgess, Planning Commission; Jane Bechtel, City Planner Executive Session Mr. Flaherty moved that the Council meet in Executive Session for the purpose of hearing the grievance of Diane Sweet Reynolds. Mr. Mona seconded with unanimous approval. Regular Session Comments & questions from the audience not related to items on the agenda No issues were raised. Review of Sketch Plan for proposed 93-acre, 153 lot subdivision of property of Homer & Marie Dubois located along west side of Hinesburg Road The question of the timing of the project was again raised. Mr. Mona noted that 2-acre development in the area has been delayed because there were no city services. That is not now the case. He added that he had a problem with several "unknowns" including the impact on traffic and the entire question of "orderly growth". He felt that 2 units per acre was too high for the area. Mr. Poger added that he felt there are places where there should be visual areas, some places perhaps for clustering, etc. He said he wouldn't mind some commercial development there. The key, he felt, was to wait and see what kind of mixtures would be best. Mr. Mona added that he did not want to have to depend on the developer for open space. Mr. Farrar felt it was not inconsistent with a reasonable way to develop the southeast quadrant and felt the plan was a good one. He added that he thought the city had done its share of cluster developing. Following the discussion Mr. Flaherty moved that the Council approve the concept of the Dubois proposal dated November 16, 1984, as presented. Mr. Peters seconded, and the motion passed 3-1 with Mr. Mona voting against. The Council then considered the question of ownership of the "open space" land. Ms. Bechtel indicated that the Dubois would prefer to deed 7 acres of the northern portion of open space to the City but keep the southern portion for possible future development. She added that they definitely want to keep the area just below the inner road for 6 additional units to be built at a later date. Ms. Bechtel said she felt it was in the City's interest to get ownership of both the land and the development rights as it may be the only chance to get more than 10 acres in one piece. Mr. Poger said he could envision a 300 foot strip with no development along the length of Hinesburg Road. Following the discussion, Mr. Mona moved that the City gain ownership of the land and development rights of a 300 foot strip north of the new road and a portion of the open land south of that road and also acquire development rights to the parcel on which the Dubois home now is located. This does not preclude the right of the Dubois to develop 6 additional units west of the Dubois home. Mr. Flaherty seconded with unanimous approval. Zoning Board Agenda Mr. Flaherty raised the question of the proposed grocery store/gas station on Dorset Street. He noted the potential traffic problem and also the fact that there are residential homes just behind the site. Ms. Bechtel noted the area is zoned residential and this proposed use was not included in the uses in the proposed transitional zone. By common consent it was agreed that the City Manager would write to the Zoning Board indicating the Council's feeling that the proposed use was not consistent with present zoning or with any planned change in zoning, and that no hardships could be seen to prevent developing with approved uses. Sign Disbursement Orders Disbursement Orders were signed. Minutes of November 19, 1984 Mr. Flaherty moved that the Minutes of November 19, 1984 be approved as printed. Mr. Mona seconded with unanimous consent. Old Business Mr. Farrar felt that the Council should decide whether to protect the right of way for the proposed Southern Connector which had been defeated in a ballot item. He said he thought the plan was still reasonable but that only 2 lanes were needed now. He said the right of way can be protected only if it is shown on the official City map. It was agreed that this item would be put on the agenda as soon as possible. Liquor Control Board Mr. Flaherty moved that the Council meet as the Liquor Control Board. Mr. Mona seconded with unanimous approval. Mr. Szymanski presented a request for a liquor license from the BNV Corporation, new owner of Bogards. He said there were no problems with the application. Mr. Flaherty moved that the Board grant a liquor license to the BNV Corp. as presented by the City Manager. Mr. Peters seconded with unanimous approval. Mr. Szymanski presented a catering permit request from John J. Plunkett of Kings Cove Restaurant for a Christmas party to be held at K of C Hall on December 15, 1984, from 5 P.M. to 1 A.M. Mr. Mona moved that the Board approve the catering permit for Kings Cover Restaurant for a Christmas part at K of C Hall, 15 December 1984, from 5 P.M. to 1 A.M.
