CITY COUNCIL AUGUST 6, 1984 AMENDMENT TO MINUTES OF AUGUST 6, 1984 Mr. Mona noted that at the bottom of page 1, his comment had been that the conversion issue had aroused strong feelings "both ways." The South Burlington City Council held a regular meeting on Monday, August 6, 1984, at 7:30 pm, in the Conference Room City Hall, 575 Dorset Street. Members Present Paul Farrar, Chairman; Leona Lansing, Michael Flaherty, George Mona Member Absent William Peters Others Present William Szymanski, City Manager; Jane Bechtel, City Planner; Margaret Picard, City Clerk/Treasurer; Bill Arnold, Tim O'Connell Will Moore Ms. Bechtel reported that the grant applied for by Fire District #2 was not funded. It was her assessment that public facilities were not considered as important as private housing and also that South Burlington was not considered as needy a community as other applicants. The problems are still very serious, and other alternatives are being considered for funding. Comments & questions from the public not related to items on the Agenda There was no discussion. Mr. Farrar noted a memo of August 3, 1984 from the City Manager indicating expenditures in 1983-84 of $29,500 over budget. He also noted that this was within the $30,000 appropriated by the Council to cover the anticipated deficit. Review proposed amendments to Zoning Regulations as recommended by Planning Commission Ms. Bechtel advised that there are still three areas in which recommended changes are being considered: revised landscaping requirements, conversion of single family residences into single family plus accessory apartment, and rezoning requests on Williston Road. Ms. Bechtel advised that they will have 120 days from August 3, in which to take action and suggested holding one public hearing which would include the 3 areas still being considered. Mr. Szymanski asked whether the question of a single family dwelling becoming a multi family dwelling if the lot is big enough is also being considered. Ms. Bechtel advised she is working on that with the City Attorney. Mr. Mona noted that conversion of single family residences to include an accessory apartment had aroused strong feelings and suggested public sentiment be asked for. Mr. Farrar felt that this should be discussed at the next meeting and if there were no problems, the changes should be held until the final three items had been submitted. Sign Resolution and Warning for proposed Airport Parkway Sewage Treatment Plant Construction Bond Issue Mr. Farrar read the warning (attached). Mr. Flaherty then moved that the Council sign the warning as read. Mr. Mona seconded, and the motion passed unanimously. Mr. Szymanski then advised that the consulting firm had learned that the State has a sizable surplus of Federal money because projects came in for less than appropriated. South Burlington is in a position to take advantage of this money if the project is "segmented," which will put it in another class which can be grandfathered. This would decrease the city's share by about $1,000,000. They will also fund up to 2 million gallons of expansion up to 75%. Mr. Farrar noted that this means a difference of $2,000,000 if the bond issue passes in September. Ms. Lansing said that she would vote in favor because of the possibility of the extra funding. Mr. Farrar then read the resolution (attached). Mr. Flaherty moved that the Council sign the resolution as read. Mr. Mona seconded with unanimous approval. Continue Discussion on Proposed Bond Issue Mr. Farrar said they need to get wording from the City Attorney for the proposed charter change to establish an incremental tax district. He added that it will be important to get an accurate picture of possible additional funding from the state. This may be vital in getting the bond issue passed. Petitions for Buried Phone Cable The City Manager presented petitions for burined phone cable on Shunpike Rd., in connection with the new bridge, Bartletts Bay Road, and Dorset Street near Potash Brook. Mr. Flaherty moved to empower the City Manager and City Council Chairman to sign petitions for buried telephone cable on Shunpike Road, Bartlett Bay Road, and Dorset Street near Potash Brook. Ms. Lansing seconded with unanimous approval. Review Zoning Board Agenda There was no discussion. Read Minutes of July 16, 1984 Mr. Flaherty noted that the vote on item 1 should have been 3-1 instead of 4-1. Ms. Lansing then moved the amended minutes be accepted. Mr. Flaherty seconded with unanimous consent. Sign Disbursement Orders Disbursement Orders were signed. Old Business Mr. Farrar advised he had met with the School Board & the State and had decided the Dorset St. problem could be solved by moving the south end of the road 7 feet closer to the west. Mr. Flaherty moved to direct the City Manager to send a memo with this proposal to the Highway Planning Engineer. Mr. Mona seconded with unanimous approval. Liquor Control Board Mr. Flaherty moved that the City Council meet as the Liquor Control Board. Ms. Lansing seconded with unanimous consent. Mr. Szymanski first presented an entertainment permit for Bogarts, 1216 Williston Road. The request is for band, dancing, singing, movies, and live entertainment from noon till 2 AM. They expect most entertainment to occur between 9 PM and closing, probably on Friday and Saturday nights. They have requested a 7-day permit because they will be doing weddings and small parties possibly on other days. The question of "live entertainment" was raised and it was felt that this designation was covered by the other language. The City Clerk advised that she had presented the request to the Police as a courtesy and there was no problem. Mr. Flaherty moved to approve the entertainment permit for Bogarts deleting the words "live entertainment" from the application with the understanding that "live entertainment" is already conveyed by "singing, dancing, band and movies." Ms. Lansing seconded with unanimous approval. Mr. Szymanski then presented an entertainment permit request from the Olympiad for an outdoor party. He advised that there had been one problem with noise from a prior party, and that Club New England had at first been blamed for the noise. Mr. Moore advised that the music will be soft rock and that when there was a problem, they had immediately quieted down. They are also not as close to homes as the Club New England, and they will run only until 1 AM. Mr. Flaherty then moved that the Board approve the indoor entertainment permit with one outdoor function to be held during this calendar year. The Olympiad is to notify the City Manager at lease 24 hours before the outdoor event is held. Implicit in this approval is the approval of the Police and Fire Chiefs. Ms. Lansing seconded and the motion passed unanimously. Mr. Szymanski then presented a liquor license request for the China Lite Restaurant. Mr. Flaherty moved that the Board approve the request of China Lite for a liquor license. Ms. Lansing seconded with unanimous approval. Mr. Flaherty then moved that the Liquor Control Board adjourn and reconvene in Executive Session for the purpose of discussion labor negotiations and reconvene only to adjourn. WARNING CITY OF SOUTH BURLINGTON SPECIAL MEETING SEPTEKBER 11, 1984 The legal voters of the City of South burlington are hereby notified and warned to meet at their respective polling places at the Chamberlin School on White Street, the South Burlington Middle School on Dorset Street and the Orchard School off Shelburne Road on Tuesday, September 11, 1984 at 7:00 o'clock in the forenoon, at which time the polls will open, until 7:00 o'clock in the afternoon at which time the polls will close, to vote by Australian ballot on the following AIRPORT PARKWAY SEWAGE TREA'IXENT FACILITY IMPROVEMENTS Shall bonds or notes of the City of South Burlington in an amount not to exceed $2,100,000 be issued for the purpose of constructing improvements to the Airport Parkway Sewage Treatment Facility, which improvements will provide secondary treatment with phosphorous removal and increase the capacity of the treatment facilities by 1,050,000 gallons per day at a total estimated cost of $8,500,000, the balance of such cost to be paid from anticipated Federal and State aid. NOTE: $1,300,000 of the total bond issue of $2,100,000 will be used for the expansion portion of the project and will be partially, if not totally, retired by revenues from new developments connecting to the Airport Parkway Sewage Treatment Facility. Peters RESOLUTION RESOLVED : It is hereby determined that the public interest and necessity of the City of South Burlington demand the improvement hereinafter set forth and that the cost of the same will be too great to be paid out of the ordinary annual income and revenue of the City: Improvements to Airport Parkway Sewage Treatment Facility which improvements will provide secondary treatment with phosphorous removal and increase the capacity of the treatment facility by 1,050,000 gallons per day at a total estimated cost of $8,500,000, the balance of such cost to be paid from anticipated Federal and State aid. FURTHER RESOLVED AND ORDERED: That the proposition of incurring a bonded debt be submitted to the qualified voters of the City of South Burlington in the following form: Shall bonds or notes of the City of South Burlington in an amount not to exceed $2,100,000 be issued for the purpose of constructing improvements to the Airport Parkway Sewage Treatment Facility, which improvements will provide secondary ' treatment with phosphorous removal and increase the capacity of the treatment facility by 1,050,000 gallons per day at a total estimated cost of $8,500,000, the balance of such cost to be paid from anticipated Federal and State aid.
