HomeMy WebLinkAboutMinutes - City Council - 04/30/1984CITY COUNCIL APRIL 30, 1984 The South Burlington City Council held a Special Meeting on Monday, April 30, 1983, at 7:30 pm, in the Conference Room, City Hall, 575 Dorset Street. Members Present Hugh Marvin, Chairman; Leona Lansing, Paul Farrar, William Peters Member Absent Michael Flaherty Others Present William Szymanski, City Manager; James W. Goddette, Fire Dept.; Richard Carter, Police Dept.; Margaret Picard, City Clerk/Treasurer; Stewart McConaughy, Eugene Ward, III, Ricky Ward; WCAC-TV film crew Meet as Liquor Control Board to discuss Liquor License renewals Mr. Szymanski presented the following renewals which had been held over from the previous meeting pending resolution of tax and other problems: 1. Spillanes, 1116 Shelburne Rd - The Police Chief says they had a 5-day suspension for selling liquor to a minor, but have since had no problems. 2. Wessons Diner, Shelburne Rd - They have a case pending which is not liquor related 3. Kohaula Mauna - Taxes have now been paid. 4. City Nights - $170 in taxes owed by the prior owner have not been paid as of tonight. 5. Quarry Hill - They have paid $4,000 of $9,345 real estate taxes due and have assured that the rest will be paid when club renewals are due, in about a month. 6. Solomons - Taxes have been paid. 7. Friar Johns - Have paid $502, about half of what is due, with no indication of when thr rest will be paid. 8. Club New England - Mr. Szymanski met with the Fire and Police Chief and have agreed that Mr. Ward will employ on weekends a local off-duty policeman or sheriff from 10 PM till 2:30 AM or whenever they run a busy special activity. They also discussed overcrowding, and Mr. Ward agreed to have people stationed to count all patrons entering the upstairs part of the facility. Mr. Ward also met with the neighbors (the Cady's, Davis's, and Weatherly's). Mrs. Davis says that lately it has been better and they are willing to work with Mr. Ward. Mr. Ward has agreed to hire an architect to work out soundproofing problems. He has also agreed to answer any complaint calls personally. Mr. Peters asked what was the nature of most of the previous disturbances. Mr. Szymanski said most related to people refusing to leave the premises, kids letting air out of tires, etc. He felt that if the noise were controlled and the lot was patrolled on weekends, the problems should abate. Mr. McConaughy, Atty for property owner, said he felt part of the problem was that the staff had been calling the police every time there was a problem. He said they are willing to try to handle more in-house, and felt that having a policeman on the premises will take care of that. Chief Carter said that most calls did involve parking lot problems. Mr. Marvin asked if people will be turned away when the count in the upstairs room reaches the limit. Chief Goddette said that is the agreement. Ms. Lansing asked how they will control people going from one level to another. Mr. Ward said they will now use only one door and will have a person counting. Chief Goddette said he would like to see a 90-day schedule and then report back. Ms. Picard noted that the Council can suspend the license for a few weeks if there is a problem again. Mr. Farrar then moved that the liquor license of the Club New England be approved with the following stipulations: 1) An off-duty policeman or sheriff's deputy be hired on weekends to help with interior and exterior control; 2) Adequate crowd control be provided to prevent overcrowding in the upstairs room, with the maximum occupancy set at 300 persons; 3) The noise abatement procedures discussed with the neighbors be instituted and maintained; 4) the City Manager report back in two months as to the adequacy of compliance. Ms. Lansing seconded, and the motion passed 3-1 with Mr. Peters voting against. Mr. Farrar then moved that the Board sign the other renewals on the recommendation of the City Manager who will assure that the stipulations agreed to have been carried out. Ms. Lansing seconded with unanimous consent. Mr. Farrar moved that the Liquor Control Board adjourn and reconvene as the City Council. Ms. Lansing seconded with unanimous consent. Other Business Mr. Szymanski reported he has an opportunity to hire a Junior or Senior Engineering student for 12 weeks at a cost to the City of $1,000, and he would like to do so. He felt this person could assist on several projects: the speed limit reduction study, updating landfill plans for the State, drainage problems on Wright Court, and the extension of Shunpike Rd. Mr. Marvin asked if this would mean a delay in hiring an Assistant City Manager, and felt it would be taking a step backward not to hire one as soon as possible. Mr. Szymanski said he felt if they approved the engineering student, it might mean August 1, before an Assistant City Manager could be hired. Mr. Farrar said he felt the work is worthwhile and felt it should be done. He also felt a search for an Assistant City Manager should be started immediately. Mr. Szymanski agreed to do so. Mr. Marvin asked if it is true that there is a drainage problem into the river from the dump. He heard it was getting serious. Mr. Szymanski said they have agreed to treat that in the sewage treatment plant when it is upgraded. He hadn't heard anything new on it lately. It will probably cost $5,000-$10.000 to pump it up to the plant. Ms. Lansing asked if there have been studies to determine what is in the leakage and whether there is anything toxic. Mr. Szymanski said this is monitored very closely and there has been no toxic waste found. Mr. Farrar then moved that the City Council adjourn to go into Executive Session to discuss labor negotiations and to reconvene only for the purpose of adjournment. Ms. Lansing seconded with unanimous consent. The City Council came out of Executive Session at 8:30 P.M. and by motion of Mr. Farrar and 2nd by Ms. Lansing the meeting was adjourned.
