HomeMy WebLinkAboutSP-93-0000 - Decision - 0038 Commerce AvenueFINDINGS OF FACT & DECISION STATE OF VERMONT e- r x COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Jim Wood for construction of a 5,000 square foot building for manufacturing and warehouse use, 38 Commerce Avenue On the 13th of July, 1993, the South Burlington Planning Commission approved the request of Jim Wood for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 5,000 square foot building for manufacturing and warehouse use. The Planning Commission approved an 8,000 square foot building for warehousing and manufacturing on this property on 6/14/88 which was never constructed. 2. This property located at 38 Commerce Avenue lies within the I-C District. It is bounded on the north by Ethan Allen Drive, on the east by an industrial building ( Top Shop) , on the south by Commerce Avenue and on the west by a vacant lot. 3. Access/circulation: Access will be provided by a 30 foot curb cut on Commerce Avenue. There will be no access to Ethan Allen Drive. Circulation is adequate. 3. Coverage/setbacks: Building coverage is 12% (maximum allowed is 30%). Overall coverage is 41.8% (maximum allowed is 70%). Front yard coverage is 28.3% (maximum allowed is 30%). Coverage percentages noted on plan are incorrect. They should be revised to note the above numbers. Setback requirements are met. 5. Landscaping: The minimum landscaping requirement for this project is $1800 which is being met. Plantings will include Flowering Crabapple, Arborvitae, Red Maple and Blue Spreading Juniper. The landscaping schedule indicates that 52 Arborvitae are proposed but the plan shows only 48 of these trees. Also, the size of the Juniper is missing. Staff recommends these Junipers be a minimum of 2 gallon in size. 6. Parking: A total of 10 parking spaces are required and 11 spaces are being provided including one (1) handicapped space. 1 7. Sewer: The sewer allocation required for this project is 210 gpd. The per gallon fee will have to be paid prior to permit. 8. Exterior lighting: The two (2) lighting fixtures proposed will be mounted on the building and will use 75 watt high pressure sodium lamps. The lamps must be shielded so as not to cast light beyond the property line. 9. Dumpster: The dumpster should be suitably screened and so noted on the plan. 10. Other: The subdivision approval to which this lot was a part of requires that$1,000 be paid when permits are issued for the first five (5) lots. This would be the 5th lot with a building. The money would go towards improvements to Ethan Allen Drive. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Jim Wood for construction of a 5,000 square foot building for manufacturing and warehouse use as depicted on a plan entitled "Lot 15 Ethan Allen Drive, 5000 square foot Sheet Metal Fabrication Building", prepared by Jim Wood and dated 5/11/93, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall post a $1,800 landscaping bond prior to issuance of a zoning/building permit. The bond shall remain in effect for three (3) years to assure that the planted landscaping takes root and has a good chance of surviving. 3. A sewer allocation of 210 g.p.d. is granted. The applicant shall pay the required sewer allocation fee prior to issuance of a zoning/building permit. 4. All exterior lighting shall be downcasting and shielded and shall not cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 5. The plan shall be revised prior to issuance of a zoning/building permit to show the changes identified below. The revised plan shall be approved by the City Planner. a) The plan shall indicate the correct coverage calculations. b) The landscape plan and schedule shall be consistent as to the number of proposed plantings, and the schedule shall indicate the size of proposed Junipers. 2 . c) The location of the dumpster shall be correctly shown and shall be appropriately screened. 6. Prior to issuance of a zoning/building permit, the applicant shall pay a $1,000 fee for improvements to Ethan Allen Drive. This requirement is a condition of the original subdivision approval granted on 5/12/86 which created this lot. 7. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 8. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy of the building. 9. Any change to the site plan shall require approval by the South Burlington Planning Commission. Chair an or Clerk, South Burlington Planning Commission Date 3
