Dear Greg,
This jurisdictional opinion is written in response to your emails and phone call of February 16, 2022, regarding Site Plan Review in accordance with 24 V.S.A. Section 4416 and the applicability of 19 V.S.A. Section 1111 jurisdiction
over the proposed Infant Care Facility at the Homestead School. This analysis is based on your jurisdictional opinion request submittals and files in our office. For the reasons set forth below, it is determined that a Section 1111 permit is required for the proposed Infant Care
Facility:
• Work is proposed in the state highway right-of-way.
• Permit #44051 to upgrade the full-service access at 1475 Shelburne Road was issued 8/21/2020 and accepted by D5 9/03/2021. This Jurisdictional Opinion takes the place of a Letter of Intent (LOI) for the purpose of 24 V.S.A. § 4416. The Agency approves the concept as shown on the attached plan “Proposed Infant Care Facility Site Plan” by
Krebs & Lansing Consulting Engineers, dated 02/04/22, last revised 02/15/22. The 19 V.S.A. § 1111 permit application should include the following revisions (additional revisions may be required):
• The entrance lane should be 18 feet wide for at least the first 30 feet from the white fog line.
• Add gate-posted “do not enter” signs at the north end of the parking area and white arrow “one-way” pavement markings along the one-way aisle.
• Add details showing curb and sidewalk construction referencing the appropriate VTrans standards.
• The proposed water service valve should be outside of the highway right of way. If you have any further questions about this matter, please call me at (802) 498-8946.
